Recommendation: Adopt a Resolution ratifying and confirming actions by the Director of Emergency Services/City Manager during the existence of a local emergency, and proclaiming the continued existence of a local emergency.

Meeting Schedule: The City Council of Pismo Beach regularly meets on the first and third Tuesdays of each month at 5:30 p.m., unless otherwise noticed. Closed and Special sessions will be duly noticed as needed.
Council Agendas: Agendas for Regular Meetings are available for public review on the City’s website at pismobeach.org/agenda and upon request from the City Clerk’s Office, typically by 4:00 p.m. on the Thursday prior to the meeting, but no later than 72 hours prior to the meeting. Agendas for Closed Sessions and other Special meetings are made available at least 72 hours prior to the meeting when possible, but no later than 24 hours prior to the meeting.

RESOLUTION NO. R-2023-XXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PISMO BEACH,
CALIFORNIA RATIFYING AND CONFIRMING ACTIONS BY THE DIRECTOR OF
EMERGENCY SERVICES/CITY MANAGER DURING THE EXISTENCE OF A LOCAL
EMERGENCY, AND PROCLAIMING THE CONTINUED EXISTENCE OF A LOCAL
EMERGENCY
WHEREAS, conditions of peril to the safety of persons and property have arisen within the City of Pismo Beach, due to flooding, bluff erosion, strong winds, and other storm- related damaged that occurred during the evening of January 8, 2023 and day of January 9, 2023, and those conditions continue to the present time; and WHEREAS, when the existence of these conditions came to the attention of the City, the City Council was not in session at that time; and
WHEREAS, Chapter 2.32 of the City of Pismo Beach Municipal Code empowers the Director of Emergency Services/City Manager of the City of Pismo Beach to proclaim the existence of a local emergency, pursuant to Government Code Section 8630 et seq., when the City is affected or likely to be affected by a public calamity and the City Council is not in session; and
WHEREAS, the Director of Emergency Services of the City of Pismo Beach did proclaim the existence of a local emergency within the City of Pismo Beach on January 9, 2023 (Exhibit A); and
WHEREAS, Government Code §8630 provides that the City Council of the City of Pismo Beach may proclaim the existence of a local emergency as defined by Government Code §8558(c).
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pismo Beach hereby ratifies and confirms the following actions taken by the City Manager, acting in the capacity of Director of Emergency Services:
1. The proclamation of local emergency on January 9, 2023.
BE IT FURTHER RESOLVED that the City Council of the City of Pismo Beach proclaims that a local emergency continues to exist throughout the City, and during the existence of said local emergency the powers, functions, and duties of the director of emergency services and the emergency organization of this City shall be those prescribed by state law, by ordinances and resolutions of this City, and by the approved emergency plans of the City of Pismo Beach.
BE IT FURTHER RESOLVED that the local emergency shall be deemed to continue to exist until its termination is proclaimed by the City Council, and the City Council shall Council Agenda 1-11-2023 3.A-1
proclaim the termination of the local emergency at the earliest possible date that conditions warrant.
BE IT FINALLY RESOLVED that the City Council shall review the need for continuing the local emergency at least once every 60 days until the City Council terminates the local emergency.
