ACCEPTANCE OF PUBLIC IMPROVEMENTS RELATED TO TRACT 192, OCEAN VIEW ESTATES NO. 2
RECOMMENDATION:
Adopt a Resolution accepting the streets related to Tract 192, Ocean View Estates No.
2. BACKGROUND:
Tract 192, also known as Ocean View Estates No. 2, was developed in the County of San Luis Obispo, prior to Shell Beach being annexed into the City of Pismo Beach. The map was finalized and accepted by the County of San Luis Obispo on February 10, 1960. This tract established the right-of-way for, and constructed, the following streets:
Paddock Avenue
Baker Avenue
Naomi Avenue
Seacliff Drive
Coburn Lane
Ruby Court
In the course of reviewing right-of-way needs for general purposes, staff found that the streets were never accepted for public use. When the map went before the County Board of Supervisors, the County of San Luis Obispo accepted all easements on the map for public use, but it did not accept the avenues, drives, streets and lanes designated on the map, collectively referred to as “streets”. The City has been maintaining the streets located in Tract 192 since this portion of Shell Beach was annexed into the City in 1966.
Because the City has been maintaining the streets since annexation, staff recommends that the City Council accept the avenues, drives, streets and lanes as shown on the tract map. This allows the City the ability to modify or use such “streets” if it deems so necessary.
FISCAL IMPACT:
There is no direct fiscal impact to this action, as the City already maintains the avenues, drives, streets and lanes as shown on the tract map.
ALTERNATIVES:
1. Do not accept the avenues, drives, streets and lanes shown on Tract Map 192; provide direction to staff.

RESOLUTION NO. R-2023-XXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PISMO BEACH, CALIFORNIA ACCEPTING THE STREETS RELATED TO TRACT 192, OCEAN VIEW ESTATES NO. 2
WHEREAS, Tract 192, also known as Ocean View Estates No. 2 was developed in the County of San Luis Obispo, prior to Shell Beach being annexed into the City of Pismo Beach; and
WHEREAS, the tract map was finalized and accepted by the County of San Luis Obispo on February 10, 1960; and
WHEREAS, the developer of Tract 192 dedicated to the County of San Luis Obispo various easements, avenues, drives, streets and lanes for public use; and WHEREAS, the County of San Luis Obispo accepted all easements on the map for public use, but it did not accept the avenues, drives, streets, and lanes designated on the map; and
WHEREAS, the City, as successor in interest to the County through duly completed annexation proceedings, wishes to accept on behalf of the public the avenues, drives, streets and lanes designated on the map; and
WHEREAS, the City has been maintaining the streets located in Tract 192 since this portion of Shell Beach was annexed into the City in 1966; and WHEREAS, staff recommends that the City Council accept the avenues, drives, streets and lanes as shown on the tract map.
NOW, THEREFORE, BE IT RESOLVED that pursuant to Streets & Highways Code Section 1806, the City Council of the City of Pismo Beach hereby accepts the following streets related to Tract 192, Ocean View Estates No. 2 to be made a part of the City street system as public streets:
1. Seacliff Drive
2. Coburn Lane
3. Paddock Avenue
4. Ruby Court
5. Baker Avenue
6. Naomi Avenue
UPON MOTION OF Council Member , seconded by Council Member , the foregoing resolution was adopted by the City Council of the City of Pismo Beach this 7th day of February 2023, by the following vote:
