Direction to Staff – Citizens Transportation Advisory Committee Membership
13. Provide direction to staff on the appointment of a resident to the SLOCOG Citizens Transportation Advisory Committee, by either appointing an advisory body applicant to the position, or directing staff to conduct a separate and return with a future agenda item allowing the Council to make the appointment.
Additional Direction Regarding Vacancies
14. Provide direction to staff on whether to continue to recruit for, or leave vacant, any seats that may remain unfilled following this round of appointments.
BACKGROUND:
Advisory Bodies are commissions, committees, and boards consisting of volunteer community members appointed by the City Council to review matters within their assigned purview. These bodies report directly to the City Council and receive support from assigned City staff. The City of Pismo Beach has four legislative Advisory Bodies, which hold public meetings that serve as a community forum on the matters assigned to the body, make certain limited decisions, provide feedback to staff on technical matters, and make recommendations to the Council on policy issues.
The City also has two non-legislative committees consisting primarily of staff to which the City Council appoints one or two Public Members. These bodies are not created by action of the Council, but they consider requests from the public, make certain recommendations to the City Manager, and occasionally make recommendations to the City Council.
The legislative bodies, as defined by state law, are subject to the Brown Act and their members are subject to state-mandated training requirements including ethics and harassment prevention. All bodies are subject to the City's Code of Ethics and certain conflict-of-interest regulations; most members file “Form 700” statements of financial interest. Purpose, duties, meeting schedules, and attendance requirements for legislative Advisory Bodies are established by Council-adopted Bylaws, and some Municipal Code provisions also apply.
Most Advisory Body members are required to be Pismo Beach residents; some bodies have provisions for qualified non-resident members. All Advisory Body members are interviewed and appointed by the entire City Council at public Special Meetings.
All Advisory Body seats carry a term of two years, expiring the last day of February every other year, with no term limits. Terms are staggered so approximately half of each body's seats come up for reappointment each year. This approach is designed to achieve a balance between continuity of experience and diversity of viewpoints. The City Clerk's Office conducts a routine annual recruitment each winter to fill the seats with terms expiring at the end of February. Interviews and appointments are typically conducted by the Council in February, for terms beginning March 1.
Council Agenda 2-14-2023 & 2-16-2023 3.A-2
Summary of Direction Sought
•Staff seeks to fill vacancies within each of the City's legislative Advisory Bodies during the 2023 annual recruitment cycle, consisting of 11 scheduled vacancies. •In addition, staff seeks direction from the City Council regarding any desired changes to the Public Member seat(s) on the Traffic Safety Committee. •Finally, staff seeks direction from the City Council on a resident appointment to the Citizens Transportation Advisory Committee (CTAC), which is advisory to the San Luis Obispo Council of Governments Board.
Annual Recruitment for Scheduled Vacancies
The primary purpose of this agenda item is for the City Council to provide direction on filling scheduled and/or existing vacancies on all Advisory Bodies, listed below.
Information about current members, term end dates, eligibility, and analysis of any special considerations for each City Advisory Body with current or upcoming vacancies is provided as Attachments 1—4:
•Planning Commission (Attachment 1)
•Conference and Visitors Bureau Board (Attachment 2)
•Parking Advisory Committee (Attachment 3)
•Parks, Recreation and Beautification Commission (Attachment 4) A schedule of interviews will be provided to the Council on the day of interviews. All new and repeat applicants who appear to meet minimum eligibility requirements have been invited to appear for interviews. In accordance with the Council’s direction on February 3, 2023, incumbent applicants have been given the option to appear for an interview, or not.
The Council may appoint individuals appearing for interviews, or opt to appoint individuals not appearing for interviews. The Council may appoint individuals to fill all vacancies, or opt to fill only some of the vacancies. If any vacancies remain following this round of interviews and appointments, staff will continue to recruit for any seats remaining unfilled unless otherwise directed, and the Council may direct that interviews of eligible applicants on file be conducted at any future time.
Traffic Safety Committee Membership
At its February 7, 2023 meeting, a majority of the City Council directed staff to return with an agenda item allowing the Council to discuss and potentially provide direction on amending the number of Public Member seat(s) on the Traffic Safety Committee (TSC).
Staff has included the discussion as part of this special meeting agenda.
The Traffic Safety Committee is composed primarily of staff with relevant technical expertise who evaluate requests for changes and improvements to traffic safety measures throughout the city. In 2003, the City Council directed staff to add one Public Council Agenda 2-14-2023 & 2-16-2023 3.A-3
Member seat to the committee, which must be filled by a Pismo Beach resident. The term of the current Public Member is scheduled for reappointment in 2024.
Should the Council wish to direct staff to add more Public Member seat(s) to the TSC, the Council may also do one of the following:
1. Direct staff to advertise for the additional seat(s) concurrent with the scheduled annual recruitment in winter of 2023, for a term beginning March 1, 2024; or
2. Direct staff to schedule a special meeting to conduct interviews of applicants for the TSC, and make an appointment at that time; or
3. Make an appointment from among the current applicants for other Advisory Body positions, and direct staff to fill the TSC seat as soon as practicable. Should the Council wish to pursue this option, it should be noted that staff has a number of applications on file for Traffic Safety Committee service that have not been included in the current interview materials, because there is not currently a vacancy on the Committee.
Citizens Transportation Advisory Committee Appointment
In addition to the City’s advisory bodies, the City Council periodically appoints City residents to other community advisory bodies, including the Citizens Transportation Advisory Committee (CTAC), which is advisory to the San Luis Obispo Council of Governments (SLOCOG) Board. The SLOCOG Board includes a Council Member from each of the county’s seven cities, and each Council appoints one of its city’s residents to serve on the CTAC (Bylaws provided for reference as Attachment 5).
The City’s 2018 appointee to the CTAC recently resigned the position, and as such the City Council must make an appointment to fill the vacancy. Staff recommends that the Council take one of three courses of action:
1. Appoint a current Advisory Body applicant to the position at this juncture, based on their known interests and qualifications; or
2. Direct staff to conduct a separate, targeted recruitment to find applicants, and return at a future Council meeting allowing the Council to interview applicants and make the appointment at that meeting; or
3. Direct staff to conduct a separate, targeted recruitment to find applicants; appoint a two-member subcommittee of the Council to interview and select a recommended appointee; and direct staff to return at a future meeting with a consent agenda item allowing the Council to confirm the appointment.
Conclusion and Appointments
At the conclusion of each meeting day, the City Clerk will tally and announce the voting results for each body for which interviews have concluded. The top overall vote-getters Council Agenda 2-14-2023 & 2-16-2023 3.A-4
for each body will be appointed to fill the available seats. In the event of a tie among two or more applicants, the Council may choose to conduct a runoff vote among the tied candidates, or the Council may choose another method of resolving the tie.
The Council may opt to appoint individuals appearing for interviews, or opt to appoint individuals not appearing for interviews.
FISCAL IMPACT:
There is no budget impact associated with the appointment or orientation of Advisory Body members. Member stipends, supplies, training, and orientation are addressed in the existing adopted budget.
ALTERNATIVES:
1.Make appointments to fill some vacant seats; direct staff to continue recruitment for the remaining seats.
2.Decline to make appointments; direct staff to continue recruitment.
3.Direct staff to return with future agenda items amending Advisory Body policy or process.

Council Agenda 2-14-2023 & 2-16-2023 3.A-5
1. Advisory Body Interviews:
Planning Commission (PC)
Eligibility; Residency
Planning Commission members shall “be a resident of the city of Pismo Beach at the time of appointment and during the entire term of service” (Bylaw requirement) and “The Planning Commission shall consist of five members, not officials of the city, appointed by the city council from the residents of the city” (PBMC Chapter 2.20).
Resident Members
Although the City may no longer require Advisory Body Members to be registered to vote in the city in order to be eligible to serve, staff will still attempt to use voter registration as an initial way to verify an applicant’s residency. If an applicant is registered to vote at an address in Pismo Beach, it will be accepted as prima facie evidence of the applicant’s residency. If an applicant claims residency but is not registered to vote in Pismo Beach, staff will need to ask the applicant for alternative forms of proof of residency.
The City has no defined policy for verifying the residency of applicants who are not registered to vote in Pismo Beach. Absent direction from the City Council, staff will take an approach similar to that used for verifying the residency of Short-Term Rental applicants. In the alternative, the City Council may provide direction as to the specific documentation that is required, or other approach that should be taken, for verifying residency. In the event the Council wishes to appoint an applicant who is not registered to vote in the city, and the applicant is unable to demonstrate residency; staff may return to the Council with a recommendation that it appoint a different applicant to fill the vacancy.
Miscellaneous
Members must be 18 years of age or older. Members must have no felony convictions (PBMC Chapter 2.24), and may not be a City employee, or other City official. Advisory Body Members, and entities in which a member has a financial interest, may not be contractors or vendors to the City.

Analysis and Additional Considerations
There are no existing vacancies within the Parking Advisory Committee. Of the two members with terms ending this cycle, both have opted to reapply.
Recommendation and Voting
Staff recommends that the City Council conduct interviews of applicants for two Parking Advisory Committee seats that will be vacant as of February 28, 2023 for full terms ending February 28, 2025, and complete the ballot provided at the back of the interview materials binder, selecting a preferred candidate for each of the available seats. In addition to those appearing for an interview at this juncture, the Council may choose to appoint other individuals in absentia, or choose to leave one or more seats unfilled.

4. Advisory Body Interviews:
Parks, Recreation and Beautification Commission (PRBC)
Eligibility; Residency
PRBC members shall “be a resident of the city of Pismo Beach at the time of appointment and during the entire term of service” (Bylaw requirement).

The table below shows the appointment and term end dates for current members, as well as any currently vacant seats. Seats up for reappointment during this recruitment cycle are indicated in bold.
