Dear Council Members,
I am a current resident of N. Silver Shoals in Pismo Beach where there has been a STR for the last 18 months that has not been operating within the current regulations.
In relation to agenda item 12. A of the May 2, 2023 City Council Meeting, I'd like to share my thoughts on the staff report as someone who has dealt with STR problems the past year and a half.
1. The city does not have the resources to enforce the primary residence requirement. While I agree that this must be a requirement for an STR permit, the staff report does not detail how this will be enforced. Under current regulations, primary residency is a requirement, but as is evident by the STR permit that was issued at 125 N. Silver Shoals Dr., the city only looks for boxes to be checked, even while knowing that applicants are willing to perjure themselves because the city will not revoke the permit. It then becomes an issue for neighbors who either have to live with the issues or must take it upon themselves to monitor and report the activities of the STR. However, such neighbors then have no insight into what the city is doing to fix the problem as we are told everything is confidential.
2. The staff report fails to mention how two other cities that are located in the coastal zone and therefore subject to approval by the coastal commission have handled the STR's in their cities. Half Moon Bay restricts STR's to only 60 days per year. Santa Monica prohibits STR's completely and only allows home sharing. Either of these models could be implemented in Pismo Beach. Staff should study these examples and report their findings back to the City Council before any new ordinances are passed.
While the current regulations are not sufficient, the City must make sure that any new STR ordinances passed will be, otherwise this will forever negatively impact the residential neighborhoods of Pismo Beach.
Sincerely,
Pismo Beach Resident
