SUBJECT/TITLE:
AMENDMENT #1 TO THE EXISTING AGREEMENT WITH ACHIEVEMENT HOUSE
FOR LITTER REMOVAL SERVICES
RECOMMENDATION:
Adopt a Resolution authorizing the City Manager to execute Amendment #1 to the existing Professional Services Agreement with Achievement House, Inc. for litter removal services from July 1, 2023 through June 30, 2025 in the amount of $164,509.20.
BACKGROUND:
The City has for many years used a contractor for Litter Removal and Cleanup Services for the downtown core, beach and outlying roads of the city. The proposal from Achievement House, Inc. was selected through a competitive process and reviewed by a panel of City staff in June 2021. The current Litter Removal Services Agreement expires on July 31, 2023, with the option to be extended “under the same terms for an additional one-year period or longer as the parties agree in writing.” Achievement House has been providing a high level of service that has in most cases exceeded the City’s expectations, and when deficiencies in service have been noted, Achievement House has been quick to correct any issues.
Achievement House has provided a proposal to extend their contract from July 1, 2023 until June 30, 2025 to continue to provide litter removal and cleanup services. The proposed Amendment #1 with attached proposal is included as Attachment 1.A.
Conclusion and Recommendation
This service provides the public with a clean downtown core, beach and outlying roads.
City employees also benefit from this service by alleviation of some of the workload required to keep the City clean. Staff recommends that the Council adopt a Resolution (Attachment 1) authorizing the City Manager to execute Amendment #1 to the existing Professional Services Agreement with Achievement House, Inc. for litter removal services from July 1, 2023 through June 30, 2025 in the amount of $164,509.20.
FISCAL IMPACT:
The fiscal impact of adopting the attached resolution is $164,509.20 over two years, or $82,254.60 for FY 2024 and $82,254.60 for FY 2025. The FY 2024 and FY 2025 Adopted Budgets for General Fund Public Works Facilities Division Streets Activity contract services account include sufficient funds to support this contract extension.
ALTERNATIVES:
1. Do not award the contract extension; provide staff with direction.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PISMO BEACH, CALIFORNIA AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT #1

WHEREAS, Achievement House was selected through a competitive process and their current Litter Removal Services Agreement expires on July 31, 2023, with the option to extend for an additional one-year period or longer as the parties agree in writing; and WHEREAS, Achievement House has provided a proposal to extend their contract from July 1, 2023 until June 30, 2025 to continue to provide litter removal and cleanup services; and
WHEREAS, the Fiscal Year (FY) 2024 and FY 2025 Adopted Budgets for the General Fund contract services account include sufficient funds for litter removal services.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pismo Beach hereby authorizes the Interim City Manager to execute Amendment #1 (Exhibit A) to the existing Professional Services Agreement with Achievement House, Inc. for litter removal services from July 1, 2023 through June 30, 2025 in the amount of $164,509.20 over the two-year period, or $82,254.60 for FY 2024 and $82,254.60 for FY 2025.

AMENDMENT # 1
to the
AUGUST 5, 2021 AGREEMENT BETWEEN THE CITY OF PISMO BEACH AND ACHIEVEMENT HOUSE, INC.
Pursuant to the August 5, 2021 Agreement for Professional Services between the City of Pismo Beach, hereinafter referred to as “City,” and Achievement House, Inc., hereinafter referred to as “Vendor,” City and Vendor hereby agree as follows:
1.Additional services shall be performed as set forth in the proposal dated May 19, 2023, which is attached hereto and by this reference made a part hereof.
2.Compensation for and timing of the additional services shall be as set forth in the referenced proposal. Compensation for the additional services shall not exceed the amount of one hundred sixty-four thousand five hundred nine dollars and twenty cents ($164,509.20) or eighty-two thousand two hundred fifty-four dollars and sixty cents ($82,254.60) per year, without prior written approval of the City.
3.The revised fee under the August 5, 2021 contract, plus this addendum, is three hundred twenty-two thousand one hundred sixty-three dollars and eighty cents ($322,163.80).
4.The revised term end date of this agreement shall be June 30, 2025.
5.All other provisions of the Litter Removal and Cleanup Services agreement between City and Vendor shall remain in full force and effect.

Achievement House, Inc. (AHi) a California non-profit agency is please to submit the following request to continue with providing Litter Removal Services for the City of Pismo from July 1, 2023 to June 30· 2025.
AHi will provide Litter Removal and Clean up Services 5 days a week (excluding major holidays) to areas described in the "Exhibit A Job Duties" including: Pismo Pier Parking Lot Area, Streets of Pismo and 3 Upper Parking lots, Addie Parking Lot and Boardwalk, Wadsworth Beach Access, Wilmar Beach Access, Dead end streets in Pismo, Wadsworth at Bellow, Judkins Middle School, 4th Street, Five Cities Drive, James Way, Rain Storm Day Duties, Stormwater Management Program.
AHi will provide all labor, materials, tools and equipment needed to perform the high quality work the city has come to know and trust. With many years of experience we feel that our crew can continue to provide liter removal and cleanup services that continue to meet the expectations. Attached you will find our completed documents requested.
City of Pismo has played an important part in the success of AHl's vocational training programs and AHi is committed to providing City of Pismo with high quality and consistent Litter Removal Services.
