SUBJECT/TITLE:
JAMES WAY BEAUTIFICATION PROJECT BID DIRECTION
RECOMMENDATION:
Adopt a Resolution authorizing staff to negotiate a construction contract for the James Way Beautification Project, or if negotiations are unsuccessful, to re-advertise for construction bids.
BACKGROUND:
One of the City Council’s top goals is to “build on the strength of our local community to preserve the City’s ‘Classic California’ charm and ensure an exceptional quality of life for residents.” To achieve this goal, the Fiscal Year 2024 budget includes the James Way Beautification Project. This project will enhance James Way by removing unusable hardscape and replacing it with landscaping along the ocean side of the James Way corridor, from Shamrock Lane to Crest Drive. Bid alternatives include the repair of tree wells on the opposite side of the street and restriping James Way. On June 22, 2023, the James Way Beautification Project was advertised for construction bids; however, no bids were received by the deadline of July 20, 2023. Public Contract Code 20166 states in part: “if no bids are received, the legislative body may have the project done without further complying with this chapter.”
Based on the Public Contract Code, staff can now negotiate directly with contractors in order to secure a construction contract. Alternatively, staff could also re-advertise the project for bids for another 4-week period. Because the project is one of the Council’s goals, staff recommends soliciting cost proposals from contractors and if that is unsuccessful then re-advertising for construction bids.
Conclusion and Recommendation
Staff recommends the City Council adopt a Resolution (Attachment 1) authorizing staff to initiate negotiations directly with contractors to secure a construction contract, and in the event that negotiations are unsuccessful, to re-advertise the project for construction bids.
FISCAL IMPACT:
There is no fiscal impact associated with this report. If a contract is successfully negotiated, staff with return to the Council to award a contract.
ALTERNATIVES:
1. Do not authorize staff to negotiate a contract or readvertise the project; provide staff with direction on how to proceed.

WHEREAS, the James Way Beautification project will enhance James Way by removing unusable hardscape and replacing it with landscaping along the ocean side of the James Way corridor, from Shamrock Lane to Crest Drive; and
WHEREAS, the project was advertised for construction bids; however, no bids were received by the deadline of July 20, 2023; and
WHEREAS, Public Contract Code 20166 states in part “if no bids are received, the legislative body may have the project done without further complying with this chapter”; and
WHEREAS, staff can now negotiate directly with contractors in order to secure a construction contract.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pismo Beach hereby authorizes staff to negotiate a construction contract for the James Way Beautification Project.
BE IT FURTHER RESOLVED that the City Council of the City of Pismo Beach hereby authorizes staff to re-advertise for construction bids if negotiations are unsuccessful.
