Subject: Central Coast Blue — Program Management, Permitting, and Final Design Amendment Request
Dear Ben,
Water Systems Consulting, Inc.'s (WSC) scope of services for Program Management, Permitting, and Final Design for the Central Coast Blue Program (Program) includes detailed design of the distributed infrastructure and the Advanced Water Purification Facility (AWPF), along with funding and financing support. Several recent developments have prompted the need for additional scope and budget to advance the distributed infrastructure and AWPF design, address environmental and permitting concerns related to construction dewatering, and pursue additional grant funding.

WSC respectfully requests the city of Pismo Beach (City) issue a contract amendment authorizing additional scope and budget for the following tasks. A detailed scope of services and fee estimate is enclosed.

Task 3.0 — Distributed Infrastructure Preliminary Engineering Groundwater Monitoring
WSC's scope for distributed infrastructure design includes geotechnical investigations and preparation of a geotechnical report. Fourteen borings were completed as part of the geotechnical investigation, including two borings on either side of the Union Pacific Railroad right- of-way to inform design of the trenchless pipeline crossings. Groundwater levels are critical to the selection of the trenchless construction method, so the borings were completed with PVC casings and equipped with transducers to monitor and record groundwater levels over time. The information will be used to select the trenchless construction method and will be included in the project bid documents to mitigate the risk of increased construction cost to the Partners associated with a contractor claim of changed conditions related to groundwater levels.

When obtaining an encroachment permit from the San Luis Obispo County Department of Public Works forthe borings, WSC was informed that additional approvals and permits would be required to construct temporary monitoring wells within the Coastal Zone. In total, WSC and its subconsultant procured six permits and approvals from Grover Beach and the San Luis Obispo County Departments of Public Works, Planning, Parks and Public Health. The extensive coordination and permitting process was not anticipated in WSC's original scope of work. In addition, WSC's original scope did not include provisions for extended monitoring of groundwater levels and maintenance of instrumentation.

Task 5.0 —Advanced Water Purification Design
Calvin Court Property Acquisition
The recent acquisition of the Calvin Court property to the south of the future AWPF site is anticipated to have multiple benefits for the Program including the following:
• Allows for pipelines to be rerouted through the Calvin Court property instead of through an easement on the 5Cities Homeless Coalition site on Barca, preventing property development constraints.
• Provides a staging and laydown area during construction that will reduce project costs associated with the construction contractor leasing an off -site yard. • Allows for flexibility for future facility expansion or construction of new improvements. • Removal of trees will allow for additional solar power generation above chemical storage facility.
• Reduces potential for issues with the location of chemical storage in the vicinity of the southern property line.
• Site access and circulation can be improved with access from Calvin Court in addition to Barca and Huber.

Changes to the site civil plan, building architecture, bulk chemical storage facilities, geotechnical ' investigation, stormwater control plans, and drainage report, among other items, will be required to incorporate the Calvin Court property into the AWPF design which had previously progressed past the 60% level, and permit applications which had already been drafted.

Backwash Waste Disposal and Backflow Prevention
Through numerous discussions with Grover Beach and the South San Luis Obispo County Sanitation District (SSLOCSD), it has been determined that backwash waste from the various AWPF unit processes cannot be discharged to the local sanitary sewer and conveyed to the SSLOCSD wastewater treatment plant as originally planned. Discharge of this waste to the collection system will create potential conveyance and treatment capacity issues, and SSLOCSD may impose an industrial discharge fee that would represent a significant long-term operational cost for the Program. To address these issues, backwash waste will be combined with reverse osmosis concentrate and discharged to the Pismo Beach outfall pipeline.

In addition, the State Water Resources Control Board Division of Drinking Water (DDW) has determined that backflow prevention strategies employed on other recent projects will not be allowed for Central Coast Blue. DDW requires implementation of air gaps at various locations throughout the AWPF for backflow prevention.

Re-routing backwash waste to the Pismo Beach outfall and implementing air gaps for multiple unit processes will require the construction of an additional reinforced concrete storage tank, additional yard piping and changes to the mechanical piping within the AWPF building.

Construction Dewatering
A portion of the excavation required for construction of the AWPF will extend into the groundwater table, necessitating implementation of a dewatering system. Typically, the Regional Water Quality Control Board (Regional Board) will allow groundwater produced from construction dewatering to be discharged to a storm drain system through a low threat discharge permit or under the state-wide Construction Stormwater General Permit. The storm drain system in the vicinity of the AWPF site ultimately discharges to Meadow Creek and the Oceano Lagoon, a habitat for endangered species. During construction of the test injection well, the Regional Board indicated that groundwater produced during well construction and testing could not be discharged to the storm drain without approval from California State Parks, which would require extensive testing and environmental studies that were determined to be infeasible for the test well project.

In addition, during preparation of the EIR Addendum, the City's environmental consultant identified construction dewatering at the AWPF as a potential impact to water levels in Oceano Lagoon, which is approximately 800 feet away. If dewatering at the AWPF impacts Oceano Lagoon, the City could be required to stop dewatering or implement other mitigation measures such as supplementing inflow to the lagoon, which could have significant construction cost and schedule impacts.

To mitigate risks related to the disposition of groundwater and impacts to Oceano Lagoon, WSC and its subconsultants performed an extensive evaluation of an alternative to active dewatering that included construction of a sheet pile shoring system with a tremie slab that would seal the bottom of the excavation. Evaluation of this alternative required additional time and effort by the project team.

Task 7.0 — Funding and Financinq Support
Fiscal Year 2023 Title XVI Grant Application
The City has received a total of $14,124,000 in planning and implementation grants from the United States Bureau of Reclamation (USBR) Title XVI Program. The City is eligible for additional grant funding through the Title XVI Program, up to a limit of $30 million or 25% of the total project cost, whichever is lower. USBR is scheduled to release the Fiscal Year 2023 Funding Opportunity Announcement later this month, and WSC does not currently have scope to prepare and submit an updated grant application. While some content from previous applications can be reused for the Fiscal Year 2023 grant application, significant portions of the application need to be updated with current project scope, budget, schedule and regulatory information.

We recognize the importance of the overall Program budget to the City and its partners, and we continue to actively explore ways to deliver the Program as cost effectively as possible. To that end, our enclosed fee estimate reflects a credit for the geochemical analysis task (Task 15.5), the scope of which will be significantly reduced based on preliminary feedback from Regional Board staff.
