AMENDMENT #9 TO THE AGREEMENT WITH RINCON CONSULTANTS, INC. FOR
PROFESSIONAL SERVICES RELATED TO CENTRAL COAST BLUE
ENVIRONMENTAL DOCUMENTS
RECOMMENDATION:
Adopt a Resolution authorizing the City Manager to execute Amendment #9 to the existing Professional Services Agreement with Rincon Consultants, Inc. for Preparation of Environmental Documents for Central Coast Blue in the amount of $23,053.
BACKGROUND:
In June 2017, the City Council awarded a contract to Rincon Consultants, Inc. (Rincon) for preparation of environmental documents related to Central Coast Blue, which at the time was known as the Regional Groundwater Sustainability Program or RGSP. To date, eight amendments have been prepared and executed. Five of these were executed under the City Manager’s authority and three were approved by City Council. A list of the executed amendments to date is below.
Amendment #1 – additional work related to archaeological resources services for an Extended Phase 1 study. Executed under the City Manager’s authority on February 11, 2020.
Amendment #2 – cost modification due to additional work required by the selection of the project site for the advanced water treatment facility. Executed under the City Manager’s authority on February 24, 2020. Amendment #3 – out of scope services that resulted from initial project delays and changes to the project description that occurred between 2017 and 2019 such as the location of the advanced treatment facility and revisions to the Environmental Impact Report (EIR). Approved by City Council on December 21, 2021.
Amendment #4 – additional costs associated with preparing updated technical studies and the Addendum to the 2021 Final EIR. Approved by City Council on December 6, 2022.
Amendment #5 – out of scope costs incurred during the preparation of the updated technical studies and Addendum to the Final EIR. Executed under the City Manager’s authority on February 14, 2023.
Amendment #6 – completion of environmental monitoring services in support of the geotechnical exploration for the Central Coast Blue project. Executed under the City Manager’s authority on March 21, 2023.
Amendment #7 – At staff’s request, attendance at a public meeting during the public review period for the Draft Addendum to the Final EIR. Executed under the City Manager’s authority on April 26, 2023.

Amendment #8 – additional tasks including a preliminary hydrogeologic analysis in support of the EIR Addendum and the provision of accessibility compliance for NEPA documentation. Approved by the City Council on July 18, 2023.
The proposed contract Amendment #9 (Attachment 1.A) will cover three out-of-scope tasks – additional monarch butterfly surveys as required by the United States Bureau of Reclamation as part of the NEPA compliance process, completion of the Water Infrastructure for the Nation Act (WIFIA) Programmatic Environmental Assessment (PEA) Questionnaire for the project; and additional coastal development permitting support.
Conclusion and Recommendation
Staff recommends the Council adopt a Resolution (Attachment 1) authorizing the City Manager to execute Amendment #9 (Attachment 1.A) to the existing Rincon contract to allow Rincon to move forward with the environmental permitting process for Central Coast Blue.
FISCAL IMPACT:
The fiscal impact of approving the attached Resolution is $2,966.92 in the City of Pismo Beach’s Water Enterprise Fund and $6,023.75 in the City’s Wastewater Enterprise Fund for a total of $8,990.67 across both funds.
On March 1, 2022 the City Council approved a Cost Sharing Agreement with the Cities of Arroyo Grande and Grover Beach for costs related to Central Coast Blue. The agreement was approved by the Arroyo Grande City Council on January 25, 2022 and by the Grover Beach City Council on February 15, 2022. Under the agreement, costs for Central Coast Blue will be split between the agencies as follows:
Pismo Beach 39%
Grover Beach 36%
Arroyo Grande 25%
Under this cost sharing agreement, the cities would be responsible for the proposed Amendment #1 as follows:
Pismo Beach $8,990.67
Grover Beach $8,299.08
Arroyo Grande $5,763.25
Of Pismo Beach’s portion, 33%, or $2,966.92 is allocated to the Water Enterprise Fund and 67%, or $6,023.75 , is allocated to the Wastewater Enterprise Fund.

1. Do not approve Amendment #9; provide staff with direction on how to proceed.

to the
JUNE 20, 2017 AGREEMENT BETWEEN THE CITY OF PISMO BEACH AND RINCON CONSULTANTS, INC.
Pursuant to the June 20, 2017 Agreement for Professional Services between the City of Pismo Beach, hereinafter referred to as “City,” and Rincon Consultants, Inc., hereinafter referred to as “Vendor,” City and Vendor hereby agree as follows:
1.Additional services shall be performed as set forth in the proposal dated November 20, 2023, which is attached hereto and by this reference made a part hereof.
2.Compensation for and timing of the additional services shall be as set forth in the referenced proposal. Compensation for the additional services shall not exceed the amount of twenty- three thousand fifty-three dollars ($23,053), without prior written approval of the City.
3.The revised fee under the June 20, 2017 contract, plus addenda 1-9, is four hundred eighty-three thousand five hundred eighty one dollars and ninety cents ($483,581.90).
4.All other provisions of the Preparation of Environmental Documents agreement between City and Vendor shall remain in full force and effect.
