A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PISMO BEACH, CALIFORNIA AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT #2 TO THE AGREEMENT WITH BUREAU VERITAS INC. IN THE AMOUNT OF $120,000 IN FISCAL YEAR 2024 FOR PROFESSIONAL BUILDING DIVISION SERVICES WHEREAS, since 2007, Bureau Veritas has been providing personnel with a high level of skill and experience for construction plan check and inspection services to the City of Pismo Beach, and has extensive experience providing Building Division services specifically tailored to the City and its needs; and
WHEREAS the City’s current contract with Bureau Veritas was approved by the City Council December 6, 2022, and Amendment #1 to extend the term of the contract was executed under the City Manager’s authority on June 28, 2023; and WHEREAS, Building Division staffing levels are designed to support the basic need for services, to be supplemented by contract services when needed; and WHEREAS, the City expects the demand for building permit plan reviews and required building inspections to remain at the high level experienced in recent fiscal years, exceeding the capacity of current Building Division staff levels; and WHEREAS, a vacancy in the position of Building Official will necessitate the use of contract Building Official services during the recruitment for a new Building Official; and WHEREAS, the Council-approved fee structure supports the City’s full cost to provide development review services, which are reflected in the General Fund budget; and WHEREAS, the Fiscal Year (FY) 2024 General Fund Community Development Department professional services account has sufficient funds to support these services; and
WHEREAS, amendment of the current contract with Bureau Veritas to allocate additional funding to the contract will allow Bureau Veritas to provide the City with the level of contract services needed to support required Building Division functions.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pismo Beach hereby authorizes the City Manager to execute Amendment #2 (Exhibit A) to the agreement with Bureau Veritas North America Inc. for building permit plan check review, building inspection, Permit Technician, and Building Official services in an amount of $120,000 in FY 2024, for a resulting contract total of $240,000.

UPON MOTION OF Council Member Guthrie, seconded by Council Member Newton, the foregoing resolution was adopted by the City Council of the City of Pismo Beach this 6th day of February 2024, by the following vote:

The proposed rates above are non-union/non-prevailing wages.All Employees classified as “non-exempt” by the U.S.
Department of Labor will be compensated at 1-1/2 times salary for overtime hours as per State and Federal wage and hour laws. No overtime will be charged without prior consent. Reimbursement for employee-owned vehicles used in connection with the work will be at the current IRS rate. Fees are subject to an annual increase in accordance with the CPI from Engineers News Record (ENR) and with the City of Pismo Beach’s approval.
