Dear Pismo Beach City Council,
Our construction company has been working in the city of Pismo Beach for over 30 years. In that time we have seen many changes as the city grows and matures. Most of the changes have been beneficial.

However, the sidewalk ordinance is onerous. It has caused great hardship for a number of our clients.

1. It is unfair to force a property owner to make improvements for the public benefit.

2. It is especially unfair to force a property owner to make improvements that will never be utilized by the public due to the topography which limits future access for neighboring parcels to be able to connect to the improvements.

3. I can see how some streets could functionally benefit from these improvements, but others, i.e. 139 El Portal, will never be able to be utilized by the public or tied into with future improvements.

4. It is also not fitting to force a property owner to make improvements to a neighboring parcel. Such was the case at 139 El Portal where, due to the fact that they have a common driveway with the neighbor, the improvements had to be made on the neighbors parcel against their wishes.

5. We really need to focus our efforts toward supporting private property rights and minimizing the capital outlays burdened on owners simply because the city can do so. In other circumstances, this would be considered extortion.

Thank you for hearing my concerns.

Best regards,
Erich Schaefer
