A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PISMO BEACH, CALIFORNIA AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT #3 TO THE AGREEMENT WITH BUREAU VERITAS NORTH AMERICA INC. IN THE AMOUNT OF $70,000 IN FISCAL YEAR 2025 FOR PROFESSIONAL BUILDING
DIVISION SERVICES
WHEREAS, since 2007, Bureau Veritas has been providing personnel with a high level of skill and experience for construction plan check and inspection services to the City of Pismo Beach, and has extensive experience providing Building Division services specifically tailored to the City and its needs; and
WHEREAS the City’s current contract with Bureau Veritas was approved by the City Council December 6, 2022, Amendment #1 to extend the term of the contract was executed under the City Manager’s authority on June 28, 2023, and Amendment 2 was approved by the City Council on February 6, 2024; and
WHEREAS, Building Division staffing levels are designed to support the basic need for services, to be supplemented by contract services when needed; and WHEREAS, the City expects the demand for building permit plan reviews and required building inspections to remain at the high level experienced in recent fiscal years, exceeding the capacity of current Building Division staffing level; and WHEREAS, the Council-approved fee structure supports the City’s full cost to provide development review services, which are reflected in the General Fund budget; and WHEREAS, the Fiscal Year (FY) 2025 General Fund Community Development Department professional services account has sufficient funds to support these services; and
WHEREAS, amendment of the current contract with Bureau Veritas to allocate additional funding to the contract will allow Bureau Veritas to provide the City with the level of contract services needed to support current and anticipated Building Division activity levels.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pismo Beach hereby authorizes the City Manager to execute Amendment #3 (Exhibit A) to the agreement with Bureau Veritas North America Inc. for building permit plan check review, building inspection, and Permit Technician services in an amount of $70,000 in FY 2025, for a resulting contract total of $310,000.

UPON MOTION OF Council Member Newton, seconded by Council Member Guthrie, the foregoing resolution was adopted by the City Council of the City of Pismo Beach this 16th day of July 2024, by the following vote:

AMENDMENT # 3
to the
December 15, 2022 AGREEMENT BETWEEN THE CITY OF PISMO BEACH AND BUREAU VERITAS NORTH AMERICA INC.
Pursuant to the December 15, 2022 Agreement for Professional Services between the City of Pismo Beach, hereinafter referred to as “City,” and Bureau Veritas North America Inc., hereinafter referred to as “Vendor,” City and Vendor hereby agree as follows:
1.Services shall be performed as set forth in the proposal dated December 15, 2022.
2.Compensation for and timing of the additional services shall be as set forth in the referenced proposal. Compensation for the additional services shall not exceed the amount of seventy thousand dollars ($70,000.00), without prior written approval of the City.
3.The revised fee under the December 15, 2022 contract, plus this amendment, is three hundred ten thousand dollars ($310,000.00).
4.The term end date of the agreement is hereby revised to June 30, 2025.
5.All other provisions of the December 15, 2022 Agreement for Professional Services between the City and Vendor shall remain in full force and effect.
