Dear Councilmember, 9-3-2024
We have lived in Shell Beach for 52+years whereby my wife is native to the central coast.
Regarding the sewer easement, this is the 5" or 6"go-around regarding this easement fiasco since we built our home on Terrace in 1990....34 years ago. We have lived in the Terrace/Shoreline neighborhood longer than any others.
Before purchasing our lot in 1987 we asked then Planning Commissioner Carolyn Johnson about an apparent sewer easement that encroached on our lot. We also asked Chief Building Inspector Nick Andrade. Both told us that it was NOT for public use NOR a public way or access.
I have a signed document for your perusal verifying this, signed and certified by City Engineer Don Burr.
It was recorded by County Recorder William Aimarik by deputy recorder Joseph Machado.
At the bottom of this document it specifically states that this sewer easement is NOT A PUBLIC WAY.
We thus purchased the lot, designed our home to take advantage of the the view over the existing 2 story home on Ocean Blvd. The SW design of our house is 90%windows.
The first time the public use of the sewer easement came up was when the mayor was John Brown...and guess where Mayor Brown lived??? On Shoreline of course. He subsequently bowed out of any discussion because of a conflict of interest. We offered to let him and his wife use our walkway which they did on several occasions.
It seems that every few years a house or two will go on the market and the realtors invade with their clients, and this easement BS arises again. There are currently 2 homes for sale on Shoreline and a couple that sold within the last year or two. However, the real reason Shoreline residents want this easement is that it greatly increases their property values at the expense of ours.
You recently spent millions of dollars on the beautiful Shell Beach streetscape project and plan on extending the pathway along the freeway all the way to Spyglass and perhaps beyond. That public way does not impede nor affect any residents. This so called easement does. It deprives us of both our property rights and rights to privacy. If the folks on Shoreline want to go to the beach then perhaps one of the good Shoreline neighbors should open up their Cliffside yard and share the magnificent views. And maybe, just maybe they will enjoy the splendor of upwards of 50 a-bikes daily flying up and down the street. We don't want any part of it.
Attached herewith is a copy of the letter I provided to council members last year when we were again harassed regarding our privacy and property rights.

We are very distressed after recently reading the agenda for the March 7, 2023 meeting concerning Item 3A as it DIRECTLY IMPACTS our immediate neighborhood regarding safety and property values. And, it is especially disturbing that this item is being discussed in a "closed session" void of any representation by the aforementioned neighbors.
You recently spent millions of dollars on the beautiful Shell Beach Streetscape project designed to slow traffic to 15MPH and enhance pedestrian and bicyclists to better patronize local business, etc.
Why on earth would you want to divert people off of Shell Beach Road onto a 5' path between residential properties, an unsupervised alley onto Vista Del Mar...the most unsafe street in Shell Beach having no sidewalks and speeding vehicles? The whole concept is absurd and reeks of no forethought or concern for the very residents whom this fiasco directly impacts. Think about this for a minute...would you condone such a project if it directly encroached on your privacy, safety and home value? We didn't think so.
Years ago, Mr.Art Davis owned the former Hindler property. He erected a fence across the vacant lot located at the bottom of Terrace Avenue. He did this because people passing through would vandalize his (and our) property. Garage doors and block walls were subjected to graffiti. People used the alley, although privately owned as a toilet for their dogs. I witnessed on several occasions teenage boys urinating as well. During this time, I contacted our esteemed police department about a particular person who brought her dog to my gate two times a day to defecate. I had photographs and the officer citied the lady and required her to pick up what amounted to a 32 gallon trash can full of feces. She was typical of many people who traversed from Terrace to Vista Del Mar.
Again, before the chain link fence was put up by Mr. Davis, motorcycles would often go speeding across the vacant lot at all hours of the day and night. Additionally, Terrace neighbors up the alleyway had several items stolen including kayaks, bicycles and even a small row boat. The alley was littered with trash, cigarette butts and even a couple of discarded old sleeping bags left by transients. Needless-to-say, neighbors were grateful for the fence as all such incidents were curtailed once it was erected....and although somewhat rusted, it is thankfully still there.
Now you want to subject us to this behavior again? There is a lot more that we could share with you if we were not locked out of this meeting. It is unethical and simply unfair to railroad this project through without our input.
Safety, compassion and common sense should be your number one concern. Thank you.
Sincerely,
Barry and Sandra Erlich (Shell Beach residents since 1972) 325 Terrace
