PISMO BEACH CITY COUNCIL STAFF REPORT
Agenda Item #9.0
Meeting Date: September 17, 2024
TITLE:

Update on January 9, 2023 and January 12, 2017 Emergency Proclamations RECOMMENDATION:

No action recommended; for information only.

DISCUSSION:

Chapter 2.32 of the Pismo Beach Municipal Code empowers the City Manager, acting as the Director of Emergency Services, to proclaim the existence of a local emergency when the City is affected by an emergency and the City Council is not in session. An emergency exists when conditions are beyond the control of the services, personnel, equipment, facilities, and existing laws of the City. The declaration is an acknowledgement of the need for additional resources and expedited procedures to deal with the emergency. The Director of Emergency Services' declaration is subject to City Council ratification within seven days.

As required by the Emergency Declarations ratified by Resolution R-2023-001 on January 11, 2023, relating to winter storm damage, and by Resolution R-2017-012 on January 17, 2017, relating to winter storm damage, the following status report is provided for information purposes.

January 11, 2023 Proclamation: Winter Storms
The City Council declared a state of emergency on January 11, 2023, via Resolution R- 2023-001, ratifying the Emergency Services Director's proclamation of a local emergency in response to the January 2023 winter storms. On January 9, 2023, the County of San Luis Obispo declared an emergency which was followed by a declaration by Governor Newsom for the region. On January 14, 2023 President Biden approved a major disaster declaration for the January storms, making federal disaster aid available. The storms, which began the first week of January, took a toll on the community, causing conditions of peril to the safety of persons and property due to flooding, bluff erosion, strong winds and other storm related damages.

Summary of Current Events
The City has received reimbursement for emergency protective measures in the amount of $26,977.76 from FEMA through the California Governor's Office of Emergency Services (CalOES). Of the five sites listed above, four have been deemed ineligible by FEMA for various reasons. The Pier Avenue Storm Drain Outfall site is currently in final review with FEMA for a permanent repair project to replace the outfall pipe that was washed away during the storm. Once funds have been obligated staff will begin to solicit a consultant to prepare a construction bid package. Construction is anticipated to take place in Fiscal Year 2026.

January 12, 2017 Proclamation: Winter Storms
The Pismo Beach City Council declared a state of emergency on January 12, 2017, via Resolution R-2017-0121, in response to the January 2017 winter storms. Shortly after the Council's declaration, the County of San Luis Obispo declared an emergency which was followed by a declaration by Governor Jerry Brown for the region. On February 14, 2017 and March 16, 2017 President Donald Trump declared a major disaster for the early and late January storms, making federal disaster aid available. The storms, which began the first week of January, took a toll on the community, culminating with a Caltrans storm drain failure on Highway 101, which caused flooding of two hotels on Price Street, blockage of the City's Franklin storm drain outfall and debris scattered along Highway 101, Price Street and sidewalk, on Franklin Drive and various private parcels on January 20, 2017.

Summary of Current Events
Right-of-way authorization for the Cliff Avenue and Ocean Boulevard site is anticipated by mid-September. Staff is preparing the request for authorization for construction funding in anticipation of the ROW authorization approval. Staff has also submitted a request for a time extension in the event the ROW authorization is delayed and the request for construction authorization is not submitted before the end of September 2024.

FISCAL IMPACT:

There is no direct fiscal impact from this report.

January 2023 Winter Storms
The cost of damage from the January 2023 storms is estimated to be about $26 million.

January 2017 Winter Storms
The cost of damage from the January 2017 storms is approximately $12 million.

UB'S=PAgenda Item #12.A
Meeting Date: September 3, 2024
TITLE:

Introduction (First Reading) of an Ordinance Amending Municipal Code Section

10.12.030 Relating to Weight Limits for Commercial Vehicles on City Streets RECOMMENDATION:

Introduce an Ordinance amending Section 10.12.030 relating to weight limits for commercial vehicles on City streets.

DISCUSSION:

Section 10.12.030 of the Pismo Beach Municipal Code currently governs the weight limits of commercial vehicles on city streets. Maintaining appropriate weight restrictions for commercial vehicles is important to protect the investment the City has made in its streets, as well as ensuring compliance with state laws. California Vehicle Code Sections 35701 et seq. allow cities to place limitations on commercial vehicle weights with certain limited exceptions.

Section 10.12.030 currently does not contain references to the types of commercial vehicles that are exempt from the City's weight restrictions. The proposed ordinance amendment cures that issue by making explicit reference to the types of commercial vehicles listed in the Vehicle Code that are permitted to use City streets notwithstanding the weight of the vehicle. For example, under the Vehicle Code, vehicles operated by public utilities such as PG&E are authorized to use City streets when necessary to construct, install or repair public utilities. The proposed ordinance includes this provision.

In addition, the Vehicle Code allows pickups and deliveries of goods by overweight commercial vehicles to buildings or structures located on the restricted streets. Section

10.12.030 currently allows for such deliveries, but the code section is ambiguous as to whether the restrictions applies to properties outside the City limits over which the City has no jurisdiction when access can be made through a property within the City limits.

The proposed ordinance makes it clear that for the Vehicle Code exemption to apply, the delivery must be made to a property within the City limits, or to a property for which the City has issued a building permit. Under the proposed ordinance, overweight commercial vehicles will not be permitted to use City streets to make deliveries to properties outside the City limits, or to deliver building materials to properties for which the City does not have building permitting authority. Operators of vehicles found in violation of the proposed ordinance would be subject to citation.

Alternatives
The Council could elect to not introduce the ordinance, in which case staff would continue to enforce Section 10.12.030 as it is currently worded. This option is not recommended, as the current ordinance does not provide for certain statutory exemptions as required by the Vehicle Code.

This report provides a summary of the Pismo Beach Police Department's activities and trends for the first half of 2024. It covers crime statistics, traffic incidents, staffing levels, accreditation updates, and advancements in police technology.

Semi-Annual Department Update
In the first half of 2024, crime trends in Pismo Beach showed some changes across various categories. The number of crimes against persons, classified as Group A offenses, remained stable with 57 incidents reported in both 2023 and 2024. However, there was a 9% decrease in crimes against property within the same category, with incidents dropping from 254 in 2023 to 231 in 2024. Conversely, crimes against society, also categorized under Group A, increased significantly by 27%, from 140 incidents in 2023 to 178 in 2024. Group B offenses, which cover less severe crimes, showed a slight increase from 432 incidents in 2023 to 435 in 2024. Additionally, other case reports saw a modest rise of 3%, increasing from 454 in 2023 to 467 in 2024. Overall, the department recorded a 3% increase in incident reports.

Traffic-related incidents in Pismo Beach showed mixed trends. Traffic collisions increased by 7%, rising from 90 in 2023 to 96 in 2024. On the enforcement side, the number of traffic stops increased by 16%, totaling 2,885 stops, while traffic citations saw a 19% increase, reflecting heightened enforcement efforts.

The Pismo Beach Police Department has successfully maintained its accreditation with the Commission on Accreditation for Law Enforcement Agencies (CALEA) since 2007, demonstrating its commitment to excellence in law enforcement practices. The benefits of this accreditation are multifaceted, including improved agency accountability, stronger legal defense capabilities, increased government support, and enhanced community advocacy.

The Pismo Beach Police Department continues to advance its technological capabilities to improve operational efficiency and public safety. The implementation of the Citizens RIMS system has been expanded to include new crime and activity maps, providing the community with greater transparency and access to important information. Additionally, the department is working on an electronic citation (E-Citations) system to streamline the process of issuing traffic citations, allowing officers to capture driver and vehicle information more efficiently and accurately. The department will also expand its network Council Agenda 9-17-2024 12.A-1

of License Plate Readers (LPR), with new installations at strategic locations throughout the city to enhance monitoring and enforcement capabilities.

As the department looks ahead, participation in the upcoming CALEA Annual Conference will be a key focus, along with continued preparation for accreditation assessments. PISMO BEACH CITY COUNCIL STAFF REPORT
'O-syoBEPc Agenda Item #12.13
Meeting Date: September 17, 2024
TITLE:

Potential Boundary Street End Closure List
RECOMMENDATION:

Provide staff with direction for potential boundary street end closures.

DISCUSSION:

In November 2014, the voters of the City of Pismo Beach adopted Measure H-2014, which amended the City's General Plan in several regards, specifically with reference to development in Planning Area R. Planning Area R consists of a number of parcels, which are outside of the city limits, but within the City's sphere of influence. Measure H-2014 placed a limit on the size of parcels within Planning Area R, and it further limited the types of land uses allowed within Planning Area R, should those properties ever be annexed into the City in the future.

Measure H-2014 also removed references in the City's Land Use and Circulation elements of the General Plan to an "inland arterial" road running from Price Canyon Road to Oak Park Boulevard, as well as references to the extension of Highland Drive and Ventana Road to the inland arterial. Since the inland arterial and connections to the inland were no longer included as part of the City's General Plan, several roads that previously dead-ended at the city limit (Rancho Pismo Drive, Highland Drive, Ventana Drive, and Morgan Drive) were no longer needed for vehicular traffic into Planning Area R, and the City closed these roads via Resolution R-2018-093 on November 27, 2018. The full staff report from that meeting is available for download from the Access Pismo' public records portal.

On August 6, 2024, staff presented the City Council with options for closing Ridge Road at the city boundary. At that meeting, the City Council directed staff to return with a list of all streets in the city that have a similar configuration of dead-ending into undeveloped properties within the county. Staff prepared a list, moving from the northern end of the city to the south, which is shown below:
• Bluff Drive • Stratford Street
• Mattie Road • Fresno Street
• Westpoint Drive • Bakersfield Street
• Baxter Lane • Tulare Street
• Hanford Street • Longview Avenue
• Wadsworth Street • Panorama Drive

Bluff Drive
Bluff Drive is a private street owned and maintained by the Bluffs Homeowners' Association; it has gate-controlled access to ensure that public passage is controlled by the homeowners within the HOA. Bluff Drive ends at Cave Landing Road, an emergency access road that lies immediately outside the city limits and connects to Avila Beach.

There are seven parcels, all located outside city limits, that front Cave Landing Road.

Bluff Drive, Cave Landing Road and the seven parcels are shown in Figure 1.
