PISMO BEACH CITY COUNCIL STAFF REPORT
Agenda Item 9.C
Meeting Date: May 20, 2025
TITLE:

Amendment #1 to the Agreement with Jason Addison Smith Consulting Inc. (JAS Pacific) for Building Division Services
RECOMMENDATION:

Adopt a Resolution authorizing the City Manager to execute Amendment #1 to the agreement with JAS Pacific in the amount of $145,000 and extending the contract through Fiscal Year 2026 for professional Building Division services.

DISCUSSION:

The City originally entered into a contract in the amount of $100,000 with JAS Pacific for building plan check service on September 6, 2024, with a contract expiration date of June 30, 2025. Plan check expenses for fiscal year (FY) 2025 are expected to exceed the original $100,000 contract amount by approximately $45,000 and given the current contract expires at the end FY 2025, staff recommends extending the contract through FY 2026. The cost of extending the contract through FY 2026 is an additional $145,000 for a contract amendment amount of $145,000 and total overall contract amount of $245,000.

JAS Pacific has been in operation for thirty years and has extensive experience providing Building Division services to jurisdictions on the central coast and their staff is familiar with the City’s processes, procedures, and the local building code. The scope of the current contract covers a wide range of Building Division services, designed to be available to support any function of the Building Division when workload exceeds staff capacity. Services available under the scope of the current contract include plan check, inspection, and Permit Tech services.

Current Building Division staffing levels include one full-time Building Official, one full-time Permit Technician, one part-time Permit Technician, and one full-time Inspector, which under the current workload is insufficient to keep up with building permit plan check needs. The high volume of electronic submittals has created a need to augment plan check services through use of the JAS Pacific outside plan check service.

Staff expects the demand for building permit plan review services to remain at current levels for the remainder of FY 2025 and FY 2026. The Council-approved fee structure supports the City’s full cost to provide these services. The Building Division FY 2025 budget has sufficient funds to cover the additional $45,000 for the remainder of FY 2025 and the draft Building Division budget for FY 2026, if approved by Council, would have sufficient funds to cover the additional $100,000 for FY 2026. The contract is structured such that the contract amount is a “not-to-exceed” amount and the City only pays for those services requested and rendered, meaning the City is not obligated to pay the full contract amount if corresponding service are not requested The Building Division collects Council Agenda 5-20-2025 9.C-1
Packet Page 16

sufficient plan check fees to cover the cost of the proposed Amendment 1 to the JAS Pacific contract.

Conclusion and Recommendation
Due to current and anticipated volumes of submittals in the Building Division, the City is in need of additional contract Building Division plan check services to continue to provide a high level of service. Staff recommends that the Council adopt a Resolution (Attachment 1) authorizing the City Manager to execute Amendment #1 (Attachment 2) to the Agreement with JAS Pacific, which will allocate additional funding in the amount of $145,000 for these services through FY 2026.

FISCAL IMPACT:

The fiscal impact of adopting the Resolution approving Amendment #1 with JAS Pacific is $145,000. This amount is budgeted in the General Fund Community Development Department’s Building Division Professional Services account, with $45,000 in FY 2025 and $100,000 in FY 2026. This amendment increases the total contract amount from $100,000 to $245,000. This additional cost will be fully covered by building plan check fees already in the City’s Fee Schedule.

PISMO BEACH CITY COUNCIL STAFF REPORT
Agenda Item #9.D
Meeting Date: May 20, 2025
TITLE:

Approval of the Paving and Drainage Project for Proposed Fiscal Year 2026 Road Maintenance and Rehabilitation Account Funding (SB 1); Making a Determination of Exemption under the California Environmental Quality Act RECOMMENDATION:

Adopt a Resolution approving the Paving and Drainage project for proposed Senate Bill 1 Road Maintenance and Rehabilitation Account funding for Fiscal Year 2026 and making a Determination of Exemption under the California Environmental Quality Act.

DISCUSSION:

On April 28, 2017, the Governor signed Senate Bill (SB) 1, which is known as the Road Repair and Accountability Act of 2017. SB 1 increases fuel excise taxes, diesel fuel sales taxes, and vehicle registration fees to help address basic road maintenance, rehabilitation, and critical safety needs for state highway and local streets and roads.

Beginning November 1, 2017, the State Controller began depositing these revenues into local governments’ newly created Road Maintenance and Rehabilitation Account (RMRA).

So far, the City has received $1,043,431 of RMRA funds through fiscal year (FY) 2024, as shown in Table 1:

Table 1. RMRA Funds Received by Fiscal Year
Fiscal Year RMRA Funds Received
FY 2018 $48,324
FY 2019 150,978
FY 2020 142,698
FY 2021 150,885
FY 2022 163,247
FY 2023 179,611
FY 2024 207,687
Total $1,043,431
The City is projected to receive $203,357 in FY 2025 of RMRA funds. The City anticipates another $211,311 in FY 2026 per the CaliforniaCityFinance.com RMRA Estimates as of January 2025. These funds are deposited in the City’s Gas Tax Fund RMRA account to support a budgeted street maintenance project. The California Transportation Commission (CTC) requests that cities and counties submit a Council-approved project list identified for proposed RMRA funding no later than July 1, 2025 to receive these funds in FY 2026. This project list must include a description and the location of each proposed Council Agenda 5-20-2025 9.D-1
Packet Page 23

project, a proposed schedule for the project’s completion, and the estimated useful life of the improvement.

Maintenance of Effort
The amount that each City receives is based on a portion of the average of General Fund and Half-Cent Sales Tax Fund costs spent on street repairs and maintenance as reported to the State Controller’s Office for FY 2010, FY 2011, and FY 2012. For the City of Pismo Beach, this amount has been calculated to be $558,874. This level of funding is the City’s Maintenance of Effort, or required annual funding, from discretionary funds for street projects. Staff has reviewed the preliminary budgets for FY 2026 and project that the City will meet this requirement. The Paving and Drainage project is included in the City’s FY 2025 Budget.

Proposed Project for Road Maintenance and Rehabilitation Account Funding Staff has identified the Paving and Drainage project as a proposed project for RMRA funding. The Paving and Drainage project budget includes support from the RMRA funds.

This project meets the eligibility requirements as described in Streets and Highways Code Section 2030(b)(1).

The Paving and Drainage project (Project) is located in the Shell Beach area on Cliff Avenue and Ocean Boulevard. The Project includes maintenance and rehabilitation of existing roadways, accessibility improvements, striping reconfiguration, and improving pedestrian and bicyclist safety. Construction of the Project will begin on October 1, 2025 and is projected to be completed by November 30, 2026. And finally, the Project has a useful life ranging from 20 to 50 years.

Environmental
The proposed action is not a “project” as defined in the California Environmental Quality Act (CEQA), Public Resource Code Section 21065 and Section 15378 (b) (4) and (5) of the State CEQA Guidelines, because the proposed action is an organizational or administrative activity that will not result in direct or indirect physical change in the environment. Therefore, the attached resolution makes a determination of exemption under CEQA.

Conclusion and Recommendation
Staff recommends that the City Council adopt a resolution (Attachment 1) identifying the Paving and Drainage project for proposed RMRA funding.

FISCAL IMPACT:

The fiscal impact of adopting the attached resolution is the receipt of an additional $211,311 of funds to help offset cost of the Paving and Drainage project.

PISMO BEACH CITY COUNCIL STAFF REPORT
Agenda Item #9.F
Meeting Date: May 20, 2025
TITLE:

Hermosa Drive and Shell Beach Road Red Curb
RECOMMENDATION:

Adopt a Resolution authorizing the installation of red curb on Hermosa Drive at Shell Beach Road.

DISCUSSION:

At the September 16, 2024 Traffic Safety Committee (TSC) meeting, the committee reviewed a request from residents of Hermosa Drive to install red curb on both sides of the intersection of Hermosa Drive and Shell Beach Road. Due to the proximity of the nearby Palisades Sports Courts, Hermosa Drive is frequently used for cars to park when the parking lot at the courts is full, leading to vehicles sometimes parking within ten feet of the corner. The TSC reviewed the request and recommended a sight distance evaluation be performed. Staff contracted with Rick Engineering to prepare a sight distance assessment of the intersection. The assessment found the intersection to meet all sight distance requirements. However, vehicles driving too fast while making the right turn from southbound Shell Beach Road onto Hermosa Drive might not see a parked vehicle if it were parked too close to the corner. It was determined, and the Traffic Safety Committee concurred, that red curb should be placed on the north side of Hermosa Drive at Shell Beach Road, and the TSC left the length of the red curb to the discretion of the Public Works Director.

The Public Works Director (Director) met with the resident who initially requested the red curb on both sides of the street to walk the area, hear the resident’s concerns, and watch driver and cyclist behavior. The placement of a PG&E owned streetlight makes the placement of a STOP sign closer to the corner difficult because it would be hidden from view on approach by the light standard. The result is that a vehicle is able to park between the STOP sign and the corner, which can cause visibility issues when cyclists who rent e-bikes illegally cut the corner after riding on the sidewalk. The Director observed this behavior. For this reason, the Director requested that the City Engineer assess the situation and determine the length of red curb necessary to at minimum keep that space between the STOP sign and the light standard free of parked vehicles.

Staff will provide a follow-up report and discussion for the Traffic Safety Committee at its next meeting. While there are no sight distance issues for vehicles exiting Hermosa Drive onto Shell Beach Road, the other potential traffic safety issues outlined in this report should be addressed. The City Engineer has reviewed the location and recommends 30 feet of red curb be installed on both sides of the intersection starting at the ramp wing, as shown in Attachment 1.A. If approved, the Public Works Department will install the red curb as described. Staff will provide a follow-up report and discussion for the Traffic Safety Committee when they meet next.

PISMO BEACH CITY COUNCIL STAFF REPORT
Agenda Item #12.A
Meeting Date: May 20, 2025
TITLE:

Job Vacancy Report in Compliance with Assembly Bill 2561 RECOMMENDATION:

No action recommended; for information only.

DISCUSSION:

In response to Assembly Bill 2561 (AB 2561), signed into law by Governor Newsom on September 22, 2024, staff has prepared this report to meet new state requirements aimed at increasing transparency about staffing vacancies. AB 2561 requires public agencies to hold at least one public hearing each fiscal year before adopting their budgets to report on vacancy levels, review hiring and retention efforts, and give recognized bargaining groups an opportunity to participate.

The bill, which amended the Meyers-Milias-Brown Act (Government Code Section 3502.3), was introduced to help address staffing shortages in public agencies—issues that can impact service delivery, increase workload, and affect employee morale. To help mitigate these challenges, AB 2561 requires agencies to:
Report annually on vacancies, recruitment, and retention strategies; Identify policies or practices that may hinder hiring or retention; Provide a platform for bargaining groups to speak during the hearing; and Share additional data if any bargaining unit’s vacancy rate reaches 20% or more.

This report includes workforce data for the 2024 calendar year, as well as the most current staffing figures as of May 1, 2025. Recognized bargaining groups, including the Pismo Beach Police Officers Association (POA) and Service Employees International Union AFL-CIO Local 620 (SEIU), have been invited to participate in this public hearing, in line with AB 2561’s requirements. Pismo Beach also has two non-represented labor groups, including non-represented full-time employees and non-represented part-time employees.

Workforce Overview
This update highlights recent hires, current vacancies, and ongoing recruitment efforts by Pismo Beach, underscoring the City’s commitment to maintaining a fully staffed, high- performing workforce that supports top-tier service across all departments. For the purposes of this report, the City will be reporting on full-time positions only.

As of May 1, 2025, the City had 101 full-time budgeted positions (FTE). Of the 101 FTE,

68.31% are a part of represented bargaining groups. No bargaining group currently meets or exceeds the 20% vacancy threshold that would trigger enhanced reporting requirements under AB 2561. The City’s overall vacancy rate is currently 4.95%, a testament to the proactivity the City takes in response to filling vacancies promptly and Council Agenda 5-20-2025 12.A-1
Packet Page 35

retention of current employees. Vacancy rates are calculated as follows: Vacancy Rate (%) = (Number of Vacant Positions in Employee Group / Total Number of Authorized Positions) x 100. Table 1 following table summarizes the City’s vacancies by employee group as of May 12, 2025.

Table 1. Vacancies by Employee Group
Employee Group FTE Budgeted Vacancies Vacancy Rate
POA 30 3 10%
SEIU 39 2 5.12%
Non-Represented 32 0 0%
As of the date of this report, the POA currently reflects three vacancies; however, all three positions are in the process of being filled. Three Police Recruit candidates have been selected and are scheduled to begin the police academy in July 2025.

SEIU currently has two vacancies. One of these positions is in the final stages of the interview process, with background checks anticipated to commence soon.

Overall, the City is in a strong position, with all vacancies filled or in different phases of the recruitment process.

Vacancy, Recruitment, Retention
Vacancies occur for a variety of reasons, including newly budgeted positions, retirements, internal promotions, resignations, and terminations. Filling vacancies in a timely manner has long been a priority for the City, even prior to the requirements outlined in AB 2561.

Human Resources works closely with departments to ensure that vacant positions are filled as efficiently as possible to maintain continuity of services, support operational effectiveness, reduce overtime, and minimize disruptions to daily operations. Proactive recruitment and hiring efforts are essential to sustaining a strong workforce, meeting community needs, and upholding the City’s service standards. These efforts also create opportunities for both internal advancement and the recruitment of qualified external candidates.

Throughout 2024, the City experienced the departure of sixteen full-time employees. Of these, five retired, eight resigned to pursue other employment opportunities, and three were non-voluntary separations. While turnover is a natural part of any organization, these changes underscore the importance of maintaining a strong recruitment and retention strategy.

In 2024, Human Resources reviewed over 400 job applications for full-time positions, reflecting continued interest in employment with the City. To meet current staffing needs and support future growth, the City has taken a proactive approach to enhancing its recruitment strategies. This includes expanding job postings beyond traditional government platforms to more accessible online job boards, as well as industry-specific Council Agenda 5-20-2025 12.A-2
Packet Page 36

professional associations, broadening the reach to attract a more diverse and qualified applicant pool.

With support from the City Council, a hiring incentive program was also introduced to address hard-to-fill positions. This initiative proved successful in attracting and securing highly qualified candidates for critical roles, strengthening the overall capacity and expertise of the City's workforce.

In addition, staff has worked to streamline various aspects of the hiring process—from recruitment to an offer of employment—increasing overall efficiency while maintaining compliance with evolving regulations. These improvements have made the process more applicant-friendly and responsive to departmental needs. As a result, the average time from job posting to offer has been significantly reduced, helping the City remain competitive in today’s job market.

Together, these efforts reflect the City’s commitment to thoughtful workforce development and to building a high-performing team that delivers quality service to the community.

Employee retention is critical to maintaining organizational stability, preserving institutional knowledge, and ensuring high-quality service delivery. High retention rates contribute to a more experienced, engaged, and productive workforce, ultimately benefiting both the organization and the community it serves. The City remains committed to creating a positive, supportive work environment where employees feel valued, heard, and motivated to grow professionally. Through initiatives focused on employee development, recognition, wellness, and competitive benefits, the City is dedicated to fostering a workplace culture that encourages long-term career commitment and satisfaction. Initiatives efforts include:
Completion of a Compensation Study to ensure market-aligned wage adjustments.

Additionally, a Classification Study is currently in progress to ensure that job functions are accurately aligned with roles and responsibilities. Continuing to offer a comprehensive and competitive benefits package. Commitment to professional development through in-person and online training opportunities, as well as support for attendance at specialty-specific conferences. Implementation of employee recognition initiatives, including appreciation events, team-building activities, and holiday celebrations.
Promotion of staff wellness through innovative programs, such as providing electric bikes for use during the workday.

The City remains committed to continuously evaluating and refining its strategies for employee recruitment and retention to ensure they remain effective, equitable, and aligned with organizational goals. Through regular self-assessment, including analysis of workforce data, employee feedback, and emerging industry trends, the City will identify areas of improvement and implement targeted actions that support a stable, engaged, Council Agenda 5-20-2025 12.A-3
Packet Page 37

and high-performing workforce. This ongoing process will involve collaboration across departments, benchmarking with peer agencies, and a proactive approach to adapting policies and practices that foster long-term employee satisfaction and organizational resilience.

PISMO BEACH CITY COUNCIL STAFF REPORT
Agenda Item #12.B
Meeting Date: May 20, 2025

TITLE:

Introduction (First Reading) of an Ordinance Amending Section 10.10.050 of the Pismo Beach Municipal Code Relating to Fines for Paid Parking Time RECOMMENDATION:

1. Introduce an Ordinance amending Section 10.10.050 of the City of Pismo Beach Municipal Code, allowing for a reduced fine for individuals who have paid for parking but whose time has expired.

2. Consider and provide direction to staff regarding possible extension of the resident parking pass program to include Price Street.

DISCUSSION:

Ordinance Introduction
Currently, Pismo Beach Municipal Code Section 10.10.050 ("Leaving vehicle parked after receipt of parking meter violation citation") prohibits any vehicle from remaining in a metered space for more than one hour after the issuance of a parking violation citation.

Each additional one-hour period of violation is treated as a separate offense.

Following feedback from the community and review by the Parking Advisory Committee (PAC) on April 23, 2025, a revision to this section is recommended. The goal is to provide a more reasonable approach for individuals who have paid for parking but accidentally overstay their time limit, by allowing for a reduced penalty while still maintaining compliance with parking regulations.

Summary of Proposed Changes:

The existing ordinance language will be updated as follows:
The section title will change from "Leaving vehicle parked after receipt of parking meter violation citation" to "Exceeding Paid Parking Time" to more accurately reflect the nature of the violation.
The revised ordinance specifies that the violation occurs when a vehicle remains parked after the expiration of the paid time as indicated either by the parking meter or a pay-and-display station receipt.
While not explicitly stated in the ordinance text itself, the recommended changes allow for the administrative implementation of a reduced fine structure for first- time offenders who had paid for parking but overstayed their time limit.

Council Agenda 5-20-2025 12.B-1
Packet Page 39

Consistent with current policy, an additional citation may be issued for every subsequent one-hour period where the vehicle remains unlawfully parked after the first violation.

The new ordinance language is as follows:

10.10.050 Exceeding Paid Parking Time
No operator of any vehicle shall allow said vehicle to remain parked in a metered parking space or a space regulated by a pay-and-display station beyond the paid parking period. A violation of this section occurs when a vehicle remains parked after the expiration of the paid time as indicated by the meter or the pay-and- display receipt. If the violation continues, an additional citation may be issued for each subsequent one (1) hour period where the vehicle remains unlawfully parked. Each one (1) hour period of illegal parking after the initial violation shall constitute a separate offense.

Possible fine/citation amounts were discussed at the April 23, 2025 PAC meeting and the PAC requested that additional information be brought back including options for a fine structure. A special PAC meeting has been scheduled for May 19, 2025, where the fine information will be presented to the PAC for recommendation to Council. Staff will provide the PAC fine structure recommendation verbally to the Council at the meeting on May 20, 2025. It was not possible to schedule a special PAC meeting with enough lead time for the inclusion of the fine recommendation in this staff report.

Resident Parking Pass Consideration for Price Street
With the addition of paid parking on Price Street, Friday through Sunday, staff presented a concept to the PAC to extend the resident parking pass program to include this area.

This extension would apply exclusively to residents of Pismo Beach and would not include business owners or employees. The PAC was supportive of this change and recommended approval to the City Council for consideration.

If City Council chooses to proceed with this recommendation, staff will create a second resident parking pass in a different color for identification purposes. Existing pass holders will receive a mailer with information regarding the update and will be asked to exchange their current pass for the new resident-only pass at the Parking Office. Implementation of this change is expected to take approximately one month, which includes ordering the new passes and distributing the mailer to current pass holders.

Alternatives

1. The City Council may direct changes to the draft municipal code amendment language or Council may refer the ordinance back to staff for clarification.

2. The Council may choose not to extend the paid parking pass program to include Price Street or provide other direction as desired.

Conclusion and Recommendation

1. Staff recommends that the Council introduce an Ordinance (Attachment 1) amending Section 10.10.050 of the Pismo Beach Municipal Code allowing for a reduced fine for individuals who have paid for parking but whose time has expired.

If the Council acts to introduce the Ordinance as recommended, it will be returned for adoption at the next available meeting and will become effective by statute 30 days thereafter.

2. Staff recommends that the Council direct staff to extend the resident parking pass program to include Price Street.

FISCAL IMPACT:

1. The fiscal impact of introducing the attached ordinance is minimal. There may be a slight reduction in the amount of revenue received from citations with the reduction in the fine amount.

2. The fiscal impact of extending the resident parking pass program to Price Street would be dependent on the number and usage of the parking passes purchased.
