PISMO BEACH CITY COUNCIL STAFF REPORT
Agenda Item #9.I
Meeting Date: June 17, 2025
TITLE:
Reduction to Fine for Expired Parking Meter or Kiosk Receipt RECOMMENDATION:
Adopt a Resolution reducing the Expired Meter or Kiosk Receipt Fine from $80 to $20, effective July 3, 2025.
DISCUSSION:
On May 20, 2025, the City Council introduced an ordinance amending Section 10.10.050 of the Pismo Beach Municipal Code, to allow for a reduced fine for individuals who have paid for parking but whose time has expired. At that meeting, the Council gave staff direction to return at a future meeting with an agenda item to set a reduced fine amount to accompany the amendments to Section 10.10.050 of the Municipal Code, with tentative direction to set the fine amount at $20 per hour.
On June 3, 2025, the Council adopted the ordinance (O-2025-003). Municipal Code Section 10.10.110 states that fines for each violation of the subject parking regulations be established by resolution of the City Council, and may be modified from time to time in the judgement of the City Council. As such, staff recommends that the Council adopt a Resolution (Attachment 1) reducing the Expired Meter or Kiosk Receipt Fine from $80 to $20 for each subsequent one-hour period where the vehicle remains unlawfully parked.
Each one-hour period of illegal parking after the initial violation shall constitute a separate offense.
As the Ordinance amending the Section 10.10.050 of the Pismo Beach Municipal Code will be effective on July 3, 2025, staff recommends that the effective date of the reduced fee be July 3, 2025 as well.
Conclusion and Recommendation
Staff recommends that the City Council adopt a resolution reducing the Expired Meter or Kiosk Receipt Fine from $80 to $20, effective July 3, 2025.
FISCAL IMPACT:
The fiscal impact of adopting the subject resolution will be a reduction in parking fine revenues to the Parking Enterprise Fund, with the exact amount varying depending on the number of citations issued.
