PISMO BEACH CITY COUNCIL STAFF REPORT
Agenda Item #9.F
Meeting Date: August 5, 2025
TITLE:

Memorandum of Understanding with the California Joint Powers Insurance Authority for ADA Assistance Program
RECOMMENDATION:

Adopt a Resolution authorizing the City Manager to enter into a Memorandum of Understanding (MOU) with the California Joint Powers Insurance Authority (CJPIA) for the CJPIA’s ADA Assistance Program.

DISCUSSION:

In July of 2014, the City Council authorized an agreement with Disability Access Consultants (DAC) for a comprehensive inspection and evaluation of City facilities, programs, services, and activities for compliance with the Americans with Disabilities Act (ADA). This effort resulted in the development of an ADA Transition Plan, which identified construction-related accessibility barriers as well as programmatic and service-level barriers.

The plan was incorporated into DAC’s web-based software, DACTrak, which is used to manage and update the transition plan, project costs and document progress in addressing identified barriers. Since the plan was completed in 2014, the City has made significant improvements to City facilities including the Pier Plaza and Shell Beach Streetscape Projects as well as the 2022 Paving Project. These extensive updates necessitate a re-evaluation of the City’s ADA compliance to ensure the Transition Plan remains current and meets the requirements of Title II of the ADA. Title II mandates that public entities maintain up-to-date Self-Evaluations and Transition Plans to identify and address accessibility barriers.

To assist in completing the update, staff contacted the California Joint Powers Insurance Authority (CJPIA) to participate in its ADA Assistance Program. This program provides member agencies with access to discounted consulting services for ADA compliance efforts, including self-evaluations, facility inspections, and plan updates. As part of the program, DAC through an existing agreement with CJPIA has provided a proposal to complete the Self-Evaluation and Transition Plan Update for $156,100. The scope of work includes inspections of all City facilities, review of programs and services, and updates to the City’s DACTrak database to reflect current conditions.

To participate in this program, the City must enter into an MOU with CJPIA (Attachment 2). Under the terms of the MOU, DAC’s costs will be billed directly to CJPIA. CJPIA will then invoice the City for the total project cost, minus a $23,500 contribution from CJPIA’s ADA Assistance Program funds, resulting in a net cost to the City of $132,600.

Once complete, the Self-Evaluation and Transition Plan will be maintained by staff in the DACTrak software.

Council Agenda 8-5-2025 9.F-1

Conclusion and Recommendation
Staff recommends the City Council adopt a Resolution (Attachment 1) authorizing the City Manager to enter into a MOU with the CJPIA for the CPJIA’s ADA Assistance Program.

FISCAL IMPACT:

The fiscal impact of adopting the subject Resolution includes $23,500 of program funding revenues and $156,100 of expenditures for the completion of the ADA Transition Plan Update for a net fiscal impact of $132,600. The Fiscal Year 2026 General Fund Public Works Department ADA Transition Plan Update project budget already includes $156,100 for the project, supported by $132,600 from the Transaction Sales Tax Fund and $23,500 from grant revenues.
