PISMO BEACH CITY COUNCIL STAF REPOR
Agenda Item #9.F
Meetin Date: March 17, 2026

TITLE:

Award of Construction Management Contract for the Federally Funded Cliff Avenue/Ocean Boulevard Storm Drain Repair and Bluff Face Stabilization Project RECOMMENDATION:

Adopt a Resolution authorizing the City Manager to enter into a Professional Services Agreement with Cannon Corporation in an amount not to exceed $948,430.61 for Construction Management, Resident Engineer, Inspection, Materials Testing and Environmental Monitoring Services for the Cliff Avenue/Ocean Boulevard Storm Drain Repair and Bluff Face Stabilization Project.

DISCUSSION:

Storm events during January 2017 caused saturation of the bluff face along Ocean Boulevard and Cliff Avenue, resulting in extensive erosion and damage to the existing roadway and stormwater facilities. Funding for repairs was approved through the Federal Emergency Relief Program, administered by the Federal Highway Administration (FHWA) and Caltrans Local Assistance (LA). The project includes the stabilization of a section of bluff along Ocean Boulevard and Cliff Avenue as well as reconstruction of the storm drain outfall, sidewalk, vehicular guardrail, and other surface improvements.

On November 18, 2025, the City Council rejected all bids for construction of the project, which were significantly higher than the Engineer’s Estimate. Staff entered into an agreement with Cannon Corporation (Cannon) for a not-to-exceed amount of $21,000 to perform a constructability review of the construction plans. The construability review resulted in recommended changes that should improve bidder participation and reduce cost. The design consultant is currently addressing comments on the plans and staff plans to re-advertise the project for construction bids. Once bids are received, staff will return to the Council to award the construction contract in Summer 2026.

On September 19, 2025, staff issued a formal Request for Proposals (RFP) for Construction Management, Resident Engineer, Inspection, Materials Testing and Environmental Monitoring for the construction of the Cliff Avenue/Ocean Boulevard Storm Drain Repair and Bluff Face Stabilization Project. On October 30, 2025, two proposals were received and evaluated by a review panel. Cannon was determined to be the most qualified and has been selected to perform the work. The agreement includes required federal contract provisions and has been reviewed and approved by the City Attorney and Caltrans LA. No work will be performed under this agreement pending award of a construction contract and until a written Notice to Proceed is issued to Cannon.

Conclusion and Recommendation
Staff recommends that the Council adopt a resolution (Attachment 1) authorizing the City Manager to enter into a Professional Services Agreement (Attachment 2) with Cannon in an amount not to exceed $948,430.61 for Construction Management, Resident Council Agenda 3-17-2026 9.F-1

In the event of any dispute between CONSULTANT and CITY, as to whether liability arises from the active negligence, sole negligence or willful misconduct of CITY or its officers, employees, or agents, CONSULTANT will be obligated to pay for CITY’s defense until such time as a final judgment has been entered adjudicating CITY as having been actively negligent, solely negligent or as having engaged in willful misconduct. Except as otherwise required by Civil Code Section 2782.8, CONSULTANT will not be entitled in the absence of such a determination to any reimbursement of defense costs including but not limited to attorney’s fees, expert fees and costs of litigation. The provisions of this Article XXIV shall survive completion of CONSULTANT’s services or the termination of this AGREEMENT.

XXV. NON-LIABILITY OF CITY OFFICERS AND EMPLOYEES
No elected official, officer, employee, or agent of CITY will be personally liable to CONSULTANT, in the event of any default or breach by CITY or for any amount that may become due to CONSULTANT.

Without limiting CONSULTANT’s indemnification of CITY, and prior to commencement of the Scope of Services, CONSULTANT shall obtain, provide and maintain at its own expense during the term of this AGREEMENT, policies of insurance of the type and amounts described below and in a form that is satisfactory to CITY.

The policy must include contractual liability that has not been amended. Any endorsement restricting standard ISO “insured contract” language will not be accepted.

2. Automobile liability insurance. If CONSULTANT owns vehicles used in performing the Scope of Services in any manner, CONSULTANT shall maintain automobile insurance at least as broad as Insurance Services Office (ISO) form CA 00 01 covering bodily injury and property damage for all activities of CONSULTANT arising out of or in connection with any work to be performed under this AGREEMENT, including coverage for any owned, hired, non-owned or rented vehicles, in an amount not less than $1,000,000 combined single limit for each accident.

CONSULTANT shall also procure and pay for appropriate tail coverage for a minimum of three years following completion of the Scope of Services to cover any errors or omissions occurring during the Term. In the alternative, CONSULTANT may elect to obtain equivalent coverage on an occurrence basis.

CITY’s Risk Manager or City Attorney may waive the requirement of professional liability insurance if he/she determines that such a policy is not commercially available to CONSULTANT. If such a policy is commercially available, additional cost to CONSULTANT in obtaining such a policy shall not be a basis upon which the insurance requirement will be waived.

Insurance certificates and endorsements must be approved by CITY’s Risk Manager prior to commencement of performance.

3. Primary/noncontributing. Coverage provided by CONSULTANT shall be primary and any insurance or self-insurance procured or maintained by CITY shall not be required to contribute with it. The limits of insurance required herein may be satisfied by a combination of primary and umbrella or excess insurance. Any umbrella or excess insurance shall contain or be endorsed to contain a provision that such coverage shall also apply on a primary and non-contributory basis for the benefit of CITY before CITY’s own insurance or self-insurance shall be called upon to protect it as a named insured.

All insurance coverage maintained or procured pursuant to this AGREEMENT shall be endorsed to waive subrogation against CITY, its elected or appointed officials, agents, officers, employees, and volunteers or shall specifically allow CONSULTANT or others providing insurance evidence in compliance with these specifications to waive their right of recovery prior to a loss. CONSULTANT hereby waives its own right of recovery against CITY, and shall require similar written express waivers and insurance clauses from each of its subconsultants.

6. Enforcement of contract provisions (non-estoppel). CONSULTANT acknowledges and agrees that any actual or alleged failure on the part of CITY to inform CONSULTANT of non-compliance with any requirement imposes no additional obligations on CITY nor does it waive any rights hereunder.

7. Requirements not limiting. Requirements of specific coverage features or limits contained in this Section are not intended as a limitation on coverage, limits or other requirements, or a waiver of any coverage normally provided by any insurance.

Specific reference to a given coverage feature is for purposes of clarification only as it pertains to a given issue and is not intended by any party or insured to be all inclusive, or to the exclusion of other coverage, or a waiver of any type. If CONSULTANT maintains higher limits than the minimums shown above, CITY requires and shall be entitled to coverage for the higher limits maintained by CONSULTANT. NOTES:

1. This is not the only way to estimate salary increases. Other methods will be accepted if they clearly indicate the % increase, the # of years of the contract, and a breakdown of the labor to be performed each year.

2. An estimation that is based on direct labor multiplied by salary increase % multiplied by the # of years is not acceptable. (i.e. $250,000 x 2% x 5 yrs = $25,000 is not an acceptable methodology)

3. This assumes that one year will be worked at the rate on the cost proposal before salary increases are granted.

4. Calculations for anticipated salary escalation must be provided.
