TITLE:
Amendment #1 to City Manager Employment Agreement
RECOMMENDATION:
Adopt a Resolution authorizing the mayor to execute Amendment #1 to the employment agreement between the City of Pismo Beach and City Manager Jorge E. Garcia and approving revised combined salary schedules.
DISCUSSION:
Following the City Manager’s successful performance evaluation during a publicly noticed Closed Session of the City Council on March 13, 2026, the Council and Mr. Garcia expressed mutual desire to amend terms of Mr. Garcia’s existing employment agreement dated October 3, 2023.
Staff has prepared an amendment to the employment agreement to change the salary schedule to increase salary 5%, amend the contribution for deferred compensation to be set at 7% of employee salary as an employer-provided contribution, modifying the termination provisions, and to change the terms of the severance to add one additional month of severance for every year served as City Manager up to 12 months total, from the current 6 months that is provided. The proposed amendment to the employment agreement is provided as Attachment 2 for the Council’s consideration, and revised combined salary schedules are provided as Attachment 2. A resolution allowing the Council to Authorize the Mayor to sign the Amendment is provided as Attachment 1.
Conclusion and Recommendation
Staff recommends that the City Council adopt a resolution (Attachment 1) approving Amendment Number 1 to the Employment Agreement between the City of Pismo Beach and City Manager Jorge E. Garcia and authorizing the Mayor to execute the Amendment.
FISCAL IMPACT:
The fiscal impact of adopting the subject Resolution with an effective date of March 9, 2026 is an additional $5,225 in fiscal year (FY) 2026 and $18,000 in FY 2027 of salary and benefit expenditures in the General Fund City Manager’s Office Division, as shown in Table 1. Staff recommends that Council appropriate the following amounts by fiscal year:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PISMO BEACH, CALIFORNIA AUTHORIZING THE MAYOR TO EXECUTE AMENDMENT #1 TO THE
EMPLOYMENT AGREEMENT BETWEEN THE CITY OF PISMO BEACH AND CITY MANAGER JORGE E. GARCIA AND APPROVING REVISED COMBINED SALARY
SCHEDULES
WHEREAS, the City Council recently concluded a performance evaluation for the City Manager during a publicly noticed Closed Session on March 13, 2026; and WHEREAS, following the performance evaluation, the City Manager proposed an amendment to the City Manager’s existing Employment Agreement dated October 3, 2023; and
WHEREAS, the proposed amendment to the City Manager employment agreement will increase the salary paid to the City Manager by five percent retroactively to March 9, 2026; increase the deferred compensation amount contributed annually by the City on behalf of the City Manager into a 401(a) account; and modify termination and severance provisions under the agreement.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pismo Beach hereby authorizes the Mayor to execute Amendment #1 to the Employment Agreement between the City of Pismo Beach and Jorge E. Garcia, in substantially the form attached to staff’s report dated April 7, 2026.
BE IT FURTHER RESOLVED that the City Council of the City of Pismo Beach hereby approves revised combined salary schedules, in substantially the form attached to staff’s report dated April 7, 2026.
BE IT FINALLY RESOLVED that the City Council of the City of Pismo Beach hereby appropriates $4,263 in salaries and $962 in deferred compensation in FY 2026 and $14,269 in salaries and $3,731 in deferred compensation in FY 2027 in the General Fund City Manager's Office Division accounts to support this amendment.

FIRST AMENDMENT TO EMPLOYMENT AGREEMENT BETWEEN
THE CITY OF PISMO BEACH AND JORGE E. GARCIA
This First Amendment to the employment agreement Between the City of Pismo Beach and Jorge E. Garcia is made and entered into on the 9th day of March 2026, by and between the City of Pismo Beach, a municipal corporation (“Employer”), and Jorge E. Garcia (“Employee”).
R E C I T A L S
WHEREAS, the City of Pismo Beach entered into an employment agreement with Jorge E. Garcia for the position of City Manager with an effective date of October 3, 2023 (the “City Manager Contract”); and
WHEREAS, the Pismo Beach City Council (“City Council”) conducted a performance evaluation of the City Manager on March 13, 2026; and
WHEREAS, the City Council now desires to amend the City Manager Contract.
NOW, THEREFORE, in consideration of the mutual covenants and conditions set forth herein, Employer and Employee agree as follows:
1.Section 3.A of the City Manager Contract is amended to read:
A.Base Salary: Employer agrees to pay Employee an annual base salary of two hundred seventy-three thousand six hundred sixty-five and 60/100 dollars ($273,665.60) which, effective as of March 9, 2026, shall be increased by the amount of 5%, payable in installments at the time that department heads of the employees of the Employer are paid. As additional compensation, Employer will pay seven (7) percent of Employee’s salary per year into an account for Employee in Employer’s 401(a) plan, payable with each payroll period.
2.Section 3.C of the City Manager Contract is deleted.
3.Section 9.A of the City Manager Contract is amended to read:
A.For the purpose of this agreement, termination shall occur when four (4) out of five (5) members of the City Council vote to terminate Employee at a duly authorized public meeting, when Employee is otherwise ready, willing, and able to perform the duties of the City Manager position. Pursuant to Pismo Beach Municipal Code Section 2.08.030, at any meeting where the question of retention or removal of Employee is considered, Employee shall have the right to present such evidence on Employee’s own behalf as Employee may desire; but the City Council shall use its uncontrolled discretion in making the decision, and its action shall be final and shall not depend on any particular showing or degree of proof.
4.Section 10.A of the City Manager Contract is amended to read:
A.Except as set forth in subsection C. and under Government Code Section 53260, if Employee is terminated under Section 9, and if Employee signs, delivers to Employer, and does not revoke, a general release agreement approved by the City Attorney, Employer shall provide a severance payment equal to six (6) months’ salary, plus an Council Agenda 4-7-2026 12.A-5

additional month of severance payment for every year Employee has been City Manager, up to a maximum severance compensation of twelve (12) months, at the current rate of pay plus the cost of the equivalent of six (6) months’ Consolidated Omnibus Budget Reconciliation Act of 1985 (COBRA) health insurance payments at the level of benefits for Employee and Employee’s dependents as of the date of termination. The severance shall be paid in a lump sum. Notwithstanding anything to the contrary in this subsection, pursuant to Government Code Section 53243.2, regardless of the term of this City Manager Contract, if the City Manager Contract is terminated, any cash settlement related to the termination that Employee may receive from Employer shall be fully reimbursed to Employer if Employee is convicted of a crime involving an abuse of Employer’s office or position.
4. The City Manager Contract, together with this First Amendment and all Exhibits attached thereto, if any, constitutes the entire Agreement between Employer and Employee and supersedes all prior negotiations, arrangements, representations, and understandings, if any, made by or between Employer and Employee with respect to the subject matter hereof. No amendment or other modification of the City Manager Contract, as modified by this First Amendment shall be binding unless executed in writing by both Employee and Employee.
