RESOLUTION NO. R-2026-019
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PISMO BEACH,
CALIFORNIA AUTHORIZING THE MAYOR AND CITY MANAGER TO ENTER INTO
A FREEWAY MAINTENANCE AGREEMENT WITH THE STATE OF CALIFORNIA,
DEPARTMENT OF TRANSPORTATION (CALTRANS)
WHEREAS, the City of Pismo Beach and the State of California, Department of Transportation (Caltrans) have previously executed Freeway Agreements detailing ownership of rights-of-way, as well as Freeway Maintenance Agreements establishing the division of maintenance responsibilities; and
WHEREAS, when local streets are constructed within state right-of-way to allow public access to the freeway system, a Freeway Maintenance Agreement establishes and clarifies the limits of maintenance responsibility between Caltrans and the local jurisdiction; and
WHEREAS, staff and Caltrans have prepared an updated Freeway Maintenance Agreement to further clarify and define maintenance responsibilities for facilities within freeway limits; and
WHEREAS, in addition to clarifying maintenance responsibilities for local streets adjacent to Highway 101, the agreement will also formalize the City’s responsibility for the future maintenance of Highway 1 within City limits upon completion of the Highway 1 relinquishment process.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pismo Beach hereby authorizes the Mayor and City Manager to enter into a Freeway Maintenance Agreement, in substantially the form attached to staff’s report dated April 7, 2026, with the State of California, Department of Transportation.
UPON MOTION OF Council Member Newton, seconded by Council Member Guthrie, the foregoing resolution was adopted by the City Council of the City of Pismo Beach this 7th day of April 2026, by the following vote:
AYES: 4 Newton, Guthrie, Reiss, Waage
