PISMO BEACH CITY COUNCIL STAF REPOR
Agenda Item #12.B
Meetin Date: Ma 5, 2026
TITLE:
Annual Military Equipment Report Per California Assembly Bill 481
RECOMMENDATION:
1. Receive the Annual Report on the City’s Military Equipment Use Policy;
2. Adopt a Resolution renewing the City’s Military Equipment Use Policy and Ordinance pursuant to Government Code §§7070–7075.
DISCUSSION:
Assembly Bill 481 (AB 481), codified at Government Code sections 7070 through 7075, requires a law enforcement agency (LEA) to obtain approval from the applicable governing body, via adoption of a “military equipment” use policy by ordinance, prior to the LEA funding, acquiring, or using military equipment as defined by the bill.
On April 5, 2022, the Council adopted Ordinance O-2022-003 (Military Equipment Use Policy Ordinance), codified as Pismo Beach Municipal Code Chapter 9.26, in accordance with the requirements of AB 481. The bill requires that staff return to the Council annually to provide a report on the City’s Military Equipment Policy and identify any necessary updates to the Policy (Attachment 2). The bill also requires staff to report any complaint(s) or concern(s) regarding the use of the equipment, results of any internal audits on the use of the equipment, the annual costs for the equipment, the quantity possessed by the agency, and the intention to purchase additional equipment in the following year.
Staff reviewed department records and determined there were no complaints or concerns regarding the use of military equipment in 2025. An internal audit (Attachment 3) was completed for calendar year 2025 documenting equipment use, annual costs, and inventory. The audit confirmed there were no violations of the City’s Military Equipment Policy.
Use of Equipment in 2025
Purposes of Deployment
The use of military equipment during the reporting period was limited. The Department’s Mobile Command Vehicle was deployed seven times. Two deployments were for command and control functions at pre-planned large-scale community events, specifically the Fourth of July celebration and the Just Cruzin’ Classic Car Show. One deployment supported the South County Regional SWAT Team by providing supplemental command and control during an operation in Paso Robles. The remaining four deployments were for community-oriented events, including Pizza on the Pier, Holiday Harmony, the Easter Eggstravaganza, and the Central Coast Chapter of Cops and Kids Field Day.
Council Agenda 5-5-2026 12.B-1
The Department’s Unmanned Aircraft System (UAS) (drone) was deployed twice during the reporting period. One deployment supported environmental protection and fire mitigation efforts in open space areas that are difficult to access by conventional means.
The second deployment assisted in the search for a missing juvenile.
Patrol rifles, 40mm launchers, and PepperBall systems were deployed solely for training and qualification purposes. There were no other uses of military equipment during the reporting period.
Policy Compliance
All deployments were consistent with approved uses outlined in Department policy and were conducted for public safety, operational coordination, and community engagement purposes.
Cost
The total annual cost for the Department’s military equipment program for calendar year 2025 was minimal. No acquisition costs were incurred during this reporting period.
Personnel costs were limited to on-duty staff and did not result in additional staffing or overtime expenditures. Training was conducted in-house by certified instructors and did not require additional staffing or overtime. Fuel costs for the Mobile Command Vehicle were estimated by its use.
Funding for the military equipment program will continue to be provided through the Department’s existing operating budget.
Future Purchases
Staff does not intend to purchase additional military equipment in the upcoming year.
Community Outreach
The Annual Military Equipment Report was posted on the Police Department’s page of the City’s website on April 16, 2026, and will remain available for public review for as long as the equipment covered by the Policy is in use. The Department conducted a well- publicized community engagement meeting on April 24, 2026, in the City Council Chamber. The meeting was publicized in advance through the City’s website, the Department’s social media platforms, and the public notice board located outside City Hall. Members of the public were provided with an opportunity to ask questions and offer comments regarding the Department’s use of military equipment. No public comments or questions were received.
Conclusion and Recommendation
Staff recommends Council receive this report and adopt a resolution (Attachment 1) authorizing the renewal of Ordinance O-2022-003.
FISCAL IMPACT:
There is no direct fiscal impact from accepting the Annual Military Equipment Report.
