Hi Erica:
Please have this read into the record at the meeting this evening and please forward to all City Council members. Thank you.
Let’s call this transaction what it really is- a sale without enforcing the requirement that the City be reimbursed for its costs. Even more glaring is the 25 year term; the City took 13 years to conclude that their vision wasn’t viable, how much longer do we, the tax payers, have to wait. As to transferring the insurance proceeds, you are just funding the maintenance, etc, unless there will be a requirement that those funds must be used for the intended purpose. If not, the City should use those funds as partial reimbursement.
Why did the City not take advantage of the Local Historical Resource designation if it’s truly an option and a benefit?
Have any other individuals or entities with the ability to comply with the Distribution Agreement expressed interest in this property?
I trust the CUP, complete Distribution Agreement, inventory lists referenced and any other referenced documents will be attached to this Agreement.
I agree the City should sell this property. I can appreciate the benefit to the City and to the neighborhood iF the City enforces all the rules I do not believe this transaction, as offered, follows the Distribution Agreement provisions as noted and in other ways.
Thank you for your attention to my concerns.
Sincerely,
Diane Farley
