OFFICE OF THE CITY MANAGER/EXECUTIVE DIRECTOR
65 Civic Avenue
Pittsburg, CA 94565
TO: Chair and Governing Board Members
FROM: Garrett Evans, Executive Director
SUBJECT: Adoption of a Housing Authority Resolution Amending the Fiscal Year 2021-22 Budget Based on Year-End Revenue and Expenditure Projections.

MEETING DATE: April 18, 2022

EXECUTIVE SUMMARY
Staff has completed a Mid-Year Review of the Fiscal Year 2021-22 budget and has determined that budget adjustments are needed to meet year-end projections.

FISCAL IMPACT
The proposed amendments to the Housing Authority of the City of Pittsburg (Housing Authority) Budget for Fiscal Year 2021-22 includes a decrease of $346,854 in revenue appropriations and a decrease of $450,212 in expenditure appropriations.

RECOMMENDATION
The Governing Board of the Housing Authority adopt this Resolution amending the Fiscal Year 2021-22 Budget based on year-end revenue and expenditure projections.

BACKGROUND
The Fiscal Year 2021-22 Budget was approved by the Housing Authority Board on June 21, 2021. The Budget was developed based upon information available at that time regarding anticipated revenue and expenditures for the period from July 1, 2021, through June 30, 2022. Upon completion of the first six months during the fiscal year, staff reviewed the initial Housing Authority budget to identify any adjustments needed to revenue and expenditure projections.

SUBCOMMITTEE FINDINGS
The proposed amendments to the Housing Authority Budget were not discussed in a subcommittee.
10 STAFF ANALYSIS
The table below provides an overview of projected Housing Authority revenue and expenditures for the 2021-22 fiscal year.

Revenue
The projected revenue for Fiscal Year 2021-22 is $21,568,750. As of February 28, 2022, $13,926,491 or 65% of the annual projected revenues had been received. Staff has projected that revenue for this fiscal year will be $346,854 under the budgeted amount of $21,915,604. This decrease is due to netting factors, associated with the Housing Authority absorbing Port-In tenant vouchers, resulting in additional revenue received from Department of Housing and Urban Development (HUD) and a significant reduction in Port-In revenue received from other Housing Authorities.

Expenditures
The projected expenditure for Fiscal Year 2021-22 is $21,568,089. As of February 28, 2022, $14,370,403 or 67% of the projected expenditure had been expended. Staff has projected those expenditures for this fiscal year will be $450,212 under the budgeted amount of $22,018,301. This decrease is mainly due to netting factors, associated with Housing Authority absorbing Port-In tenant vouchers, resulting in increased Housing Assistance Payments expenditure, which simultaneously correlates with a significant reduction in Port- 11 In expenditures. Veterans Affairs Supportive Housing Assistance (VASH) Payment’s expense also decreased, which is due to other housing authorities absorbing our Housing Authority’s Port-Out tenants, many of whom also qualified as VASH vouchers.

Fund Balance
The adopted budget assumed an operating shortfall (expenditures exceeding revenue) of $102,697. The proposed budget adjustments will create a projected operating surplus of $661.

17 OFFICE OF THE CITY MANAGER/EXECUTIVE DIRECTOR
65 Civic Avenue
Pittsburg, CA 94565
TO: Mayor and Council Members
FROM: Garrett Evans, City Manager
SUBJECT: Introduction and Waive First Reading of an Ordinance Adopting a Military Equipment Use Policy Per Assembly Bill 481
MEETING DATE: April 18, 2022

EXECUTIVE SUMMARY
Assembly Bill 481 was approved by Governor Gavin Newsom in 2021, which adds section 7070 through 7075 of the Government Code. Effective January 1, 2022, Assembly Bill (AB) 481 requires law enforcement agencies to obtain approval of the applicable governing body (City Council), by adoption of a military equipment use policy prior to continuing use of and taking certain actions relating to the funding, acquisition, or use of military equipment, as defined.

FISCAL IMPACT
The cost of the current equipment is presently funded and included in the Fiscal Year 2022/2023 budget. No new equipment that is applicable to Assembly Bill 481 is slated for purchase during the listed timeframe.

RECOMMENDATION
City Council move to introduce and waive the first reading of the attached Ordinance establishing a Military Equipment Use Policy for the Pittsburg Police Department: Policy 706.

BACKGROUND
On September 30, 2021, Governor Newsom signed into law seven major peace officer reform bills, including Assembly Bill 481. AB 481 was authored by Assembly Member David Chiu (D-San Francisco) to address the funding, acquisition, and use of items lawmakers deemed to be considered “military equipment.”
18 This bill requires law enforcement agencies, including the Pittsburg Police Department, to obtain approval of the applicable governing body, by adoption of a military equipment use policy, as specified, by ordinance at a regular meeting held pursuant to specified open meeting laws, prior to taking certain actions relating to the funding, acquisition, or use of military equipment, as defined.

Furthermore, AB 481 requires similar approval for the continued use of “military equipment” acquired by the Pittsburg Police Department prior to January 1, 2022, and allows the governing body to approve the funding, acquisition, or use of military equipment within its jurisdiction only if it determines that the military equipment meets specified standards.

SUBCOMMITTEE FINDINGS
This item was presented to the Public Safety Sub-Committee on March 1, 2022.

STAFF ANALYSIS
The term “military equipment”, as used in AB 481, does not necessarily indicate equipment used by the military. Items deemed to be “military equipment” include, but are not limited to, unmanned aerial or ground vehicles, armored vehicles, command and control vehicles, less lethal 40mm kinetic energy launchers, chemical munitions, and diversionary devices.

The list of items considered “military equipment” by AB 481 are employed by many law enforcement agencies across the country as best practices to enhance citizen and officer safety. The Pittsburg Police Department utilizes equipment that falls within the definitions listed in AB 481 and this equipment is detailed on the PPD Draft Equipment List.

SUBJECT: Adoption of City Council Resolution Declaring that Certain City-Owned Real Property as Exempt Surplus Land Under California Government Code Section 54234(a)(1) and Authorizing Filing of a Notice of Exemption
MEETING DATE: April 18, 2022

EXECUTIVE SUMMARY
This item includes consideration by the City Council of a resolution declaring real property at the southern terminus of John Henry Johnson Parkway currently subject to an exclusive negotiating rights agreement exempt from certain requirements of the Surplus Lands Act.

Adoption of the resolution and declaration of the subject property as exempt surplus lands will not entitle any development within the City, nor would it constitute a commitment by the City to approve any California Environmental Quality Act (CEQA) documentation, entitlements, or other agreements.

FISCAL IMPACT
There is no fiscal impact related to the adoption of the resolution and declaration of the subject properties as exempt surplus lands.

RECOMMENDATION
Staff recommends the City Council adopt the attached resolution declaring certain City- owned real property as exempt surplus land under California Government Code Section 54234(a)(1) and authorizing the filing of a notice of exemption.

BACKGROUND
The City of Pittsburg currently owns vacant and underutilized land at the southern terminus of John Henry Johnson Parkway, generally comprised of undeveloped open space with hiking trails, as well as a small model airplane field and an approximately 0.5-acre facility for firearms training and non-firearms training of public safety officers. 36 On December 15, 2008, the City Council adopted Resolution No. 08-11133, approving an Exclusive Negotiating Rights Agreement (ENRA) between the City and Discovery Builders, Inc. in an effort to determine the suitability of residential development on the property. The ENRA was amended three times prior to 2019, and amended a fourth time on December 16, 2019, to extend the duration in order to allow both parties the additional time needed to study the development potential of the property.

SUBCOMMITTEE FINDINGS
This item was not presented to a subcommittee.

STAFF ANALYSIS
Pursuant to the Surplus Land Act at Government Code Section 54234(a)(1), and the California Department of Housing and Community Development’s Surplus Land Act Guidelines, if a local agency, as of September 30, 2019, has entered into a legally binding agreement to dispose of property, and the disposition of the property is completed by December 31, 2022, the local agency is exempt from the amendments to Article 8 set forth in AB 1486 of 2019 and Sections 201-300 of the Surplus Land Act Guidelines. As described above, the Property was subject to a legally binding agreement for its disposal prior to this date.

Adoption of the proposed resolution and declaration of the subject property as exempt surplus lands will not entitle any development within the City, nor would it constitute a commitment by the City to approve any California Environmental Quality Act (CEQA) documentation, entitlements, or other agreements. Staff would file a notice of exemption specifically regarding the declaration of the property as exempt surplus land, and would provide a copy of the adopted resolution to HCD.

Filing of a Notice of Exemption )
WHEREAS, the City of Pittsburg (“City”) wishes to further development of quality residential opportunities throughout the city to meet its housing demands; and

WHEREAS, the City is the owner of a significant portion of undeveloped land around Stoneman Park, specifically at the southern terminus of John Henry Johnson Parkway; and
WHEREAS, on December 15, 2008, the City Council adopted Resolution No. 08- 11133, approving an Exclusive Negotiating Rights Agreement (ENRA) between the City and Discovery Builders, Inc. (“Developer”), in an effort to determine the suitability of residential development; and
WHEREAS, the City and the Developer determined that as a result of the time, effort, and due diligence required for such a significant residential project, and the desire to develop quality residential opportunities for the existing and future residents of Pittsburg, the project would be best served by amending the ENRA to extend the negotiating period to December 15, 2023, in order to allow both parties the additional time needed to study the development potential of the property; and WHEREAS, in 2017, the Developer submitted an initial application regarding development of the site for residential use, and has subsequently filed formal entitlement applications, and the City has commenced environmental review with respect to the applicability of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) (“CEQA”); and
WHEREAS, pursuant to Section 54234(a)(1) of the Surplus Land Act, and the California Department of Housing and Community Development’s Surplus Land Act Guidelines, if a local agency, as of September 30, 2019, has entered into a legally binding agreement to dispose of property, and the disposition of the property is completed by December 31, 2022, the local agency is exempt from Articles II and III of the Surplus Land Act Guidelines; and
WHEREAS, the Property was subject to a legally binding agreement for its disposal prior to September 30, 2019, and the City desires to complete the disposition of the Property to Developer prior to December 31, 2022.
38 Resolution No. 22- Page 1 of 2 April 18, 2022 NOW THEREFORE BE IT RESOLVED that the City Council hereby finds that the Property was subject to a legally binding Option Agreement for the disposal of the Property effective December 15, 2008, and the disposition of the Property will be completed prior to December 31, 2022. Based on the foregoing, the City Council hereby declares the Property exempt surplus land pursuant to Government Code Section 54234(a)(1).

BE IT FURTHER RESOVED that this Resolution has been reviewed with respect to the applicability of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) (“CEQA”). The City Council has determined that the designation of this property as surplus does not have the potential for creating a significant effect on the environment and is therefore exempt from further review under CEQA pursuant to State CEQA Guidelines Section 15060(c)(3) because it is not a project as defined by the CEQA Guidelines Section 15378. Adoption of the Resolution does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. If and when the Property is sold to a purchaser and that purchaser proposes a use for the Property that requires a discretionary permit and CEQA review, that future use and project will be analyzed at the appropriate time in accordance with CEQA.

BE IT FURTHER RESOLVED that City Staff is hereby directed to file a copy of this Resolution with the California Department of Housing and Community Development, as required by the Surplus Land Act Guidelines.

SUBJECT: Adoption of a City Council Resolution to Authorize an Application for Grant Funds from the California Department of Water Resources for an Aquatic Adventure Camp
MEETING DATE: April 18, 2022

EXECUTIVE SUMMARY
If approved, the resolution would authorize staff to submit an application to the California Department of Water Resources for a $10,500 grant to support an Aquatic Adventure Camp recreation program to use between Fiscal Year 2022/2023, Fiscal Year 2023/24, and Fiscal Year 2024/25

FISCAL IMPACT
This resolution will authorize staff to apply for a grant. If the grant is awarded, the Recreation Department will apply the $3,500 in additional revenues to its Fiscal Year 22/23 and $3,500 in additional revenues to its Fiscal Year 23/24 and 24/25 Recreation Department grant budget under Fund 299-42191 (Miscellaneous Grants – Recreation). No additional expenditure from the General Fund is required for the receipt of the grants since no matching funds are required.

RECOMMENDATION
City Council adopt the attached resolution authorizing staff to submit an application for the Aquatic Adventure Camp grant from the State of California Department of Water Resources.

BACKGROUND
The Aquatic Adventure Camp program will be run primarily at Buchanan Swim Center, and will allow the City’s lifeguards to partner with the California Department of Water Resources to teach water safety to children that live near State Water Project reservoirs. This program would be offered at no cost to approximately 50 children each year that would otherwise be unable to afford water safety classes.
40 SUBCOMMITTEE FINDINGS
This item was not brought before a subcommittee.

STAFF ANALYSIS
If the grant from the State Department of Water Resources is approved, two one-week camps will be held for children ages 9 to 12 from Pittsburg. The first four days of the program will be spent at Buchanan Swim Center and will cover water safety skills, swimming skills and lifejacket awareness. The final day of the program will take place at Del Valle Regional Park in Livermore, the nearest state water project reservoir. Instruction at the reservoir will cover kayak and boat safety as well as water safety at open water facilities.

If approved, grant funding will cover lifeguard wages associated with running the program.

Any additional expenses, which are expected to be minimal, will be covered by the department’s Fiscal Year 2022/23, Fiscal Year 2023/24 and Fiscal Year 2024/25 operating budget.

SUBJECT: Adoption of a City Council Resolution to Amend the Master Pay Schedule as Required by California Public Employees’ Retirement System
MEETING DATE: April 18, 2022

EXECUTIVE SUMMARY
To comply with CalPERS’ interpretation of the requirements of California Code of Regulations, Title 2, Section 570.5 by amending the single master pay schedule already on the City’s website representing all previously approved actions on the individual classifications of the pay schedule. The single master pay schedule will be submitted to the City Council for approval each time any single MOU or compensation plan is brought to the City Council for approval.

FISCAL IMPACT
The amendment of previously approved separate pay schedules as a single master pay schedule has no fiscal impact to the City for preparation or distribution, as the actions already occurred.

RECOMMENDATION
The City Council adopt a resolution to amend the City of Pittsburg’s master pay schedule for all employee classifications, so the City is in compliance with the requirements of the California Code of Regulations, Title 2, Section 570.5 and the California Public Employees’ Retirement System (CalPERS) relating to publicly available pay schedules for purposes of determining the amount of “compensation earnable” pursuant to Government Code Sections 20630, 20636, and 20636.1.

BACKGROUND
CalPERS, pursuant to their interpretation of California Code of Regulations, Title 2, Section 570.5, recommends all CalPERS employers to maintain their compensation levels in one publicly available document, approved and adopted by the governing body, which must meet all of the following requirements:
50 • Has been duly approved and adopted by the employer's governing body in accordance with requirements of applicable public meetings laws;
• Identifies the position title for every employee position; • Shows the pay rate for each identified position, which may be stated as a single amount or as multiple amounts within a range;
• Indicates the time base, including, but not limited to, whether the time base is hourly, daily, bi-weekly, monthly, bi-monthly, or annually;
• Is posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer's internet website;
• Indicates an effective date and date of any revisions; • Is retained by the employer and available for public inspection for not less than five years; and
• Does not reference another document in lieu of disclosing the pay rate.

SUBCOMMITTEE FINDINGS
This item was not reviewed by a subcommittee.

STAFF ANALYSIS
The updates to master pay schedule reflect salary adjustments approved by the City Council on December 20, 2021 for members of Teamsters Local 856, the Police Managers’ Group on February 22, 2022 and City Manager on March 21, 2022.

The adoption of the resolution will comply with CalPERS’ interpretation of the requirements of Code of Regulations section 570.5 by amending the single master pay schedule already on the City’s website representing all previously approved actions on the individual classifications of the pay schedule.
