AGENDA REPORT
TO: CITY COUNCIL
VIA: CITY ADMINISTRATOR
FROM: DEPUTY CITY ADMINISTRATOR / PUBLIC SERVICES & INFRASTRUCTURE DATE: SEPTEMBER 20, 2022
SUBJECT: AMENDMENT TO SOLID WASTE HANDLING SERVICES AGREEMENT FOR

FORMER UNINCORPORATED HAMER ISLAND
FISCAL
IMPACT: NONE
SUMMARY:

On February 15, 2022, the City Council approved Resolution No. R-2022-13 to annex the formerly unincorporated area of the County of Orange ("County"), known as "Hamer Island," into the City of Placentia. On April 4, 2022, the City officially filed an application with Orange County Local Agency Formation Commission ("OC LAFCO") to annex Hamer Island into its jurisdictional boundary and assume responsibility for most services to the residents of the island. On April 26, 2022, the County approved the pre -annexation agreement with City. On June 8, 2022, OC LAFCO adopted Resolution No. IA 22-02 approving the annexation of Hamer Island into the City. On July 8, 2022, Hamer Island was formally annexed into the City of Placentia.

As part of this annexation process, the City Council directed Staff to work with Republic Services and the County to re -assign or transfer the existing waste hauling agreement between the County and Republic Services servicing Hamer Island under the same terms, conditions, and rates to the benefit of Hamer Island residents. This action recommends that the City Council approve the attached addendum to the Agreement with Republic Waste Services of Southern California, LLC ("Republic Services") to provide the residents within Hamer Island a continuation of waste and recycling hauling services and rates under the same terms and conditions provided by Republic Services under the former County contract.

RECOMMENDATION:

It is recommended that the City Council take the following actions:

1. Approve the Hamer Island Addendum to the Amended, Revised and Restated Agreement for Solid Waste Handling Services between the City of Placentia and Republic Waste Services of Southern California, LLC; and

2. Authorize the City Administrator to execute all the necessary documents, in a form approved by the City Attorney.

DISCUSSION:

On February 15, 2022, the City Council approved Resolution No. R-2022-13 to annex the County unincorporated Hamer Island into the City of Placentia. On April 4, 2022, the City officially filed an application with OC LAFCO to annex Hamer Island to its jurisdictional boundary and assume responsibility for most services to the residents within Hamer Island. On April 26, 2022, the County of Orange approved the pre -annexation agreement with City. On June 8, 2022, OC LAFCO adopted Resolution No. IA 22-02 approving the annexation of Hamer Island to the City. On July 8, 2022, Hamer Island was formally annexed into the City of Placentia.

As part of the annexation process of Hamer Island, the City Council directed Staff to work with Republic Services and the County to re -assign or transfer the existing waste hauling agreement between the County and Republic Services servicing Hamer Island under the same terms, conditions, and rates to the benefit of Hamer Island residents. Although, the City has an existing Franchise Agreement ("Agreement") with the Republic Services, this agreement is only for the provision of solid waste collection services within the City's existing boundaries and excludes the formerly unincorporated area of Hamer Island.

Staff met with Republic Services and the County and an agreement was reached to allow continued services to Hamer Island residents under the same terms and provisions of the franchise agreement between the County and Republic Services. The terms and the provisions in the City's and County's agreements with Republic Services contained significant differences including rates that required the City to add an addendum to the existing Agreement with Republic Services to continue to provide waste and recycling hauling services and rates under the same terms and conditions under the former County contract to the residents within the Hamer Island neighborhood.

The City Attorney's Office prepared the attached addendum (Attachment 1) to the Agreement with Republic Services to formally add the terms and conditions of the County contract for the provisions of solid waste collection services for the residents of Hamer Island. This agreement addendum has been reviewed and approved by Republic Services. Staff is recommending the City Council approve an addendum to the Agreement with Republic Services.

FISCAL IMPACT:

There is no General Fund fiscal impact associated with the requested action. The cost for providing solid waste services to the City's residents and businesses is covered by the customer rates established by the City's franchised hauler and paid by those receiving said services.
