AGENDA REPORT

CITY COUNCIL

CITY ADMINISTRATOR

DEPUTY CITY ADMINISTRATOR / PUBLIC SERVICES & INFRASTRUCTURE NOVEMBER 15, 2022
SUBJECT: AMENDMENT NO. 1 TO CONSTRUCTION CONTRACT WITH KANA PIPELINE INC., FOR CONSTRUCTION OF THE TOD CROWTHER SEWER PIPELINE

REPLACEMENT PROJECT
FISCAL
IMPACT: EXPENSE: There is no fiscal impact associated with the recommended action SUMMARY:

On November 16, 2021, the City Council approved a contract with Kana Pipeline Inc., (Kana) to provide construction services on the TOD Crowther Sewer Pipeline Replacement project. Since the start of construction in January of this year, the project encountered numerous delays due to various unforeseen conditions. The initial delay was caused by a conflict with other construction activities in the City of Fullerton, where the contractor could not start the construction work at the point of connection to the Orange County Sanitation (OCSD) trunkline.

The original completion date for the Kana to complete the project was November 16, 2022, which necessitates the term of the agreement be extended. Staff continues to work with Kana to overcome and resolve many of these challenging conflicts and recommends a time extension to be approved. Staff recommends that Kana's contract be extended by two years to November 16, 2024, to provide sufficient time to complete the project and include the standard one-year warranty period. No other aspects of the agreement are proposed to be changed.

RECOMMENDATION:

It is recommended that the City Council take the following actions:

1. Approve Amendment No. 1 to Kana Pipeline Inc. to extend the term of the agreement to November 16, 2024; and

2. Authorize the City Administrator and/or his designee to execute all the necessary documents, in a form approved by the City Attorney.

DISCUSSION:

The existing sewer line serving the Transit -Oriented Development (TOD) District requires upgrading to provide adequate capacity for the new developments along Crowther Avenue. On November 16, 2021, City Council approved a contract with Kana Pipeline Inc. for the construction of the TOD Crowther Sewer Project. Kana was given a notice to proceed to start the project in January of this year. However, the City of Fullerton did not allow them to start construction at the point of connection to the existing Sanitation District trunk line located in State College Boulevard as was originally planned. As a result, Kana Pipeline had to revise their original construction plan to start at upstream of the original connection point. This shift created a major delay to the project schedule and changed the phasing of the construction entirely. In addition, several other unforeseen field conditions were encountered that contributed to project delays. These included abandoned utilities that had to be removed in addition to other utilities in the same vicinity of the new sewer line. The original completion date for the project was November 16, 2022, which must now be extended for Kana to continue construction of the pipeline. Staff recommends the term of the agreement be extended for a period of two years to November 16, 2024, to provide sufficient time to complete the project and include the standard one-year warranty period.

FISCAL IMPACT:

There is no fiscal impact associated with this recommended action.
