AGENDA REPORT
TO: CITY COUNCIL
VIA: CITY ADMINISTRATOR
FROM: DIRECTOR OF HUMAN RESOURCES
DATE: NOVEMBER 15, 2022
SUBJECT: RESOLUTION REQUESTING COUNCIL AUTHORIZATION FOR ANNUAL

DESTRUCTION OF SPECIFIED RECORDS
FISCAL
IMPACT: NONE
SUMMARY:

The City maintains a large volume of records. From time to time, it becomes necessary to destroy some of these records when it is determined that the records no longer have sufficient historical, legal, fiscal or reference value. Government Code Section 34090 states that "with the approval of the legislative body by Resolution and the written consent of the City Attorney, the head of a City department may destroy any City record, document, instrument, book or paper, under his/her charge, without making a copy thereof, after the same is no longer needed." This action will adopt a Resolution authorizing the routine destruction of specific City records identified in Exhibit A.

RECOMMENDATION:

It is recommended that the City Council adopt Resolution No. R-2022-71, authorizing and directing the destruction of certain City records and documents pursuant to California Government Code 34090.

STRATEGIC PLAN STATEMENT:

There is no specific strategic planning goal or objective associated with this agenda item.

DISCUSSION:

On a routine basis, the City finds it necessary to destroy certain City records that no longer have sufficient historical, legal, fiscal or reference value to retain in original form. These records include a variety of different documents such as job recruitment folders.

The attached Resolution designates those records Staff has requested authority to destroy. The destruction schedule follows established City records retention schedules and is consistent with Section 34090 of Government Code of the State of California. This section of the Government Code does not authorize the destruction of (a) records affecting the title of real property or liens thereon, (b) court records, (c) records required to be kept by statute, (d) records less than two
