This item is consistent with the City Council approved 5 -Year Strategic Goal to:

Promote Community and Economic Development, as Objective Number 3.10 is to initiate the implementation of Housing Element strategies. Also, this item will serve to enhance Community Development efforts in general as it will address the area formerly known as "Hamer Island", establishing development standards and General Plan goals for this area, promoting unified and orderly development in the community.

BACKGROUND:

On February 15, 2022, the City Council considered and approved a Resolution to annex unincorporated 76 -acre Hamer Island into the City of Placentia. The County Island was not within the corporate boundaries of the City of Placentia, it was under the jurisdiction of the County of Orange. The annexation proceedings were finalized in July 2022 and the area is now a part of the

incorporated City of Placentia. Now that the area formerly known as Hamer Island is part of the City, a Zoning Code Amendment/Zone Change is necessary to assign a Zoning designation for this area and to establish development standards within the Placentia Municipal Code (PMC) Chapter 23 for the newly annexed Hamer Island. Project Area 1 also includes a General Plan Amendment to establish a land use designation for the newly annexed Hamer Island and to recognize said area as an incorporated portion of the City of Placentia in the Land Use Element of the General Plan.

Project Area No. 2 is citywide, and includes a Zoning Code Amendment (ZCA) to amend the Placentia Municipal Code (PMC) Chapter 23.21, changing the allowable density of the R-3 Zone.

Project Area 2 also includes a General Plan Amendment (GPA) to amend the allowable density of the corresponding High -Density Residential land use designation within the Land Use Element.

The citywide ZCA and GPA will further the direction of City Council. On March 15, 2022, the City Council adopted General Plan Amendment (GPA 2021-02) updating the Housing Element of the General Plan, which included direction to amend the allowable density in the R-3 Zone and the corresponding High -Density Residential land use designation citywide.

DISCUSSION:

For Project Area No.1, the City proposes a ZCA and GPA to assign a Zoning designation and General Plan land use designation for the newly incorporated Hamer Island. As part of the ZCA, staff recommends designating the area as R -1 -HMR, single-family residential with a HMR (for Hamer) Overlay. The Overlay designation will allow (former) Hamer Island residents to maintain the same RV parking standards that existed under the jurisdiction of the County of Orange, as directed by City Council. Other than RV parking on private property, the development standards of the former Island will be exactly the same as all other R-1 properties citywide. The General Plan Amendment will designate the entire former Island as low-density residential, consistent with R-1 Zoning. The GPA will also amend the text and maps of the Land Use Element, recognizing Hamer Island as part of the City of Placentia, designated as low-density residential in the Land Use Element.

For Project Area No.2 (citywide), the City proposes a ZCA to amend the Placentia Municipal Code (PMC) Chapter 23.21, changing the allowable density of the R-3 Zone, increasing the allowable density from 25 to 30 units per acre. Project Area 2 also includes a General Plan Amendment (GPA) to amend the allowable density of the High -Density Residential land use designation within the Land Use Element, increasing the allowable density from 25 to 30 units per acre. As previously mentioned, the citywide ZCA and GPA will further the direction of City Council, as the City Council updated the Housing Element of the General Plan in March 2022, which included direction to amend the allowable density in the R-3 Zone and the corresponding High -Density Residential land use designation citywide to help encourage the production of housing.

General Plan Land Use Element and Land Use Map Amendment In accordance with Government Code Section 65350, a city may amend their respective General Plans from time to time. Such amendments should be done pursuant to Government Code Section 65860 when making a zoning designation of property(ies) consistent with the General Plan. Project Area 1 includes a General Plan General Plan Amendment to designate the entire former Hamer Island as low-density residential, consistent with the recommended R-1 Zoning.

The GPA will also amend the Land Use map within the Land Use Element of the General Plan, recognizing Hamer Island as part of the incorporated City of Placentia, designated as low-density residential in the Land Use Element and on corresponding Land Use maps.

Project Area 2 also includes a corresponding General Plan Amendment (GPA) to amend the allowable density of the High -Density Residential land use designation within the Land Use Element, increasing the allowable density from 25 to 30 units per acre. This General Plan land use Element change will be consistent with the recommended R-3 changes, increasing the allowable density from 25 to 30 units per acre in the Land Use Element as well as in the Zoning Code.

Zoning Code Amendment/Zone Change
Per Government Code Section 65860, a city shall bring its zoning ordinance and zoning map into consistency with its General Plan. Project Area 1 includes a Zoning Code Amendment component to create the R -1 -HMR Zone, which is single-family residential with a HMR (for Hamer) Overlay.

The Zone Change component will designate the former Hamer Island area as R -1 -HMR to include RV parking standards that existed under the jurisdiction of the County of Orange, as previously directed by City Council. As stated, the recommended Zoning actions will be consistent with the recommended General Plan land use designations recommended for Project Area 1.

Project Area 2 includes a Zoning Code Amendment component to amend the Placentia Municipal Code (PMC) Chapter 23.21, changing the allowable density of the R-3 Zone, increasing the allowable density from 25 units per acre to 30 units per acre. This Zoning Code Amendment will be consistent with the aforementioned General Plan Land Use Element change.

CEQA:

Regarding Project Area Nos. 1 and 2 identified in this report, in accordance with the California Environmental Quality Act (CEQA) and State and local Environmental Guidelines, Staff and the City of Placentia Planning Commission recommend that City Council adopt a Common Sense Exemption pursuant to Section 15061 (b)(3) of the State CEQA Guidelines in that the proposed project (both Project Area Nos. 1 and 2) will not result in changes to the existing physical environment, and the physical environment will not be modified as a result of its adoption. Upon City Council adoption of a finding of a Common Sense exemption, a Notice of Exemption will be filed. Exemption memos are attached to this staff report for further explanation.
