DISCUSSION:
On October 4, 2022, the City Council conducted a study session regarding the recently completed public art call for projects the City and Arts Orange County had recently completed for a new gateway monument sculpture and new murals to be placed on Caltrans property for the public's benefit. Caltrans has set aside an initial amount of $600,000 to fabricate and install a new gateway monument on the Orangethorpe on/off ramps at the 57 Freeway as well as to paint new murals on the paved freeway bridge deck slopes beneath the freeway along Crowther Avenue. The call for artists yielded several submissions and a panel of art experts reviewed the proposals and recommended the pieces submitted by Cliff Garten and Alejandro Poli. The City Council accepted the panelist's recommendations at the October 4, 2022 City Council meeting.
The proposed artist agreements are presented to the City Council for its consideration and approval as the City is taking the lead on contracting with the artists directly with Caltrans reimbursing the City for all costs associated with the art projects. There is no matching contribution required from the City. The agreements have been reviewed by the City Attorney's Office and approved as to form.
In addition to the artist agreements, two amendments to existing agreements between the City and Caltrans are also presented for Council consideration. The City has an existing landscape maintenance agreement with Caltrans for the freeway slopes along the 57 Freeway between Placentia Avenue and Orangethorpe Avenue. The slopes have been undergoing renovations paid for and led by Caltrans with the City agreeing to maintain the landscaped improvements. An amendment to the landscape maintenance agreement is requested to include the new landscape improvements that will be installed with the new art pieces as part of the City's maintenance responsibilities once completed. The amendment to the transportation art cooperative agreement is needed to increase the not -to -exceed amount of funding that Caltrans will reimburse the City for the art projects. The amount is being increased by $600,000 to include the cost of the art pieces and any surrounding infrastructure improvements needed to support the pieces. As noted previously there is no cost share required of the City.

FISCAL IMPACT:
The total cost of both art agreements amounts to $575,000 and a total of $650,000 has been budgeted in the FY 2022-23 Capital Improvement Program Budget to cover the cost of these projects. As such, sufficient funds exist for the recommended actions.
