AMENDMENT NO. 1 TO LANDSCAPE MAINTENANCE AGREEMENT
WITHIN STATE HIGHWAY RIGHT OF WAY ON SR -57 WITHIN THE CITY OF
PLACENTIA
This AMENDMENT NO. 1 to the Landscape Maintenance Agreement identified below as "AMENDMENT", is effective on , 20_, and is entered into by and between the State of California, acting by and through the Department of Transportation, hereinafter referred to as "STATE", and the City of Placentia, a municipal corporation, hereinafter referred to as "CITY", acting by and through its Mayor. CITY and STATE together are hereafter referred to as "PARTIES".
RECITALS:
1. PARTIES, entered into an agreement on September 15, 2021, entitled "LANDSCAPE MAINTENANCE AGREEMENT WITH THE CITY OF PLACENTIA" hereafter referred to as "AGREEMENT". AGREEMENT defined the terms and conditions applicable to CITY's LANDSCAPING duties at the various areas within STATE right of way, as shown in Exhibit "A" of AGREEMENT.
2. AGREEMENT by its terms provides that it may be modified or amended at any time upon mutual consent of the PARTIES.
3. The purpose of this AMENDMENT is to assign and expand the maintenance of the sculpture and mural artwork and surrounding landscaping hereinafter referred to as "Artwork".
4. Artwork has been installed or will be installed at the northwest intersection of Orangethorpe Avenue and the undercrossing slopes at Crowther Avenue within STATE right of way near State Route 57.
5. PARTIES desire to amend AGREEMENT as provided herein.
IT IS THEREFORE MUTUALLY AGREED:
6. EXHIBIT A, labeled "EXHIBIT A" is hereby amended to include EXHIBIT Al;
7. All other terms and conditions of AGREEMENT shall remain in full force and effect.
8. AMENDMENT is hereby deemed to be included and made a part of AGREEMENT. 1 IN WITNESS WHEREOF, PARTIES hereto have set their hands and seals the day and year first above written.
