IMPACT: EXPENSE: $107,250 TOTAL CONSTRUCTION CONTRACT AMOUNT $ 97,500 CONSTRUCTION CONTRACT AMOUNT
$ 9,750 CONSTRUCTION CONTINGENCY AMOUNT
AVAILABLE
BUDGET: $108,273.56 FISCAL YEAR 2022-23 CIP BUDGET (791302-6740) SUMMARY:
The proposed Public Works Agreement with Grigolla & Sons Construction Co. Inc., (Grigolla) is for the 2022-2023 Concrete Repair Project to address damaged sidewalks and curbs and gutters in neighborhoods that are not scheduled for paving or slurry seal improvements until later in the City's pavement rehabilitation and maintenance schedule. Currently, the Public Works Department has identified a number of locations where these repairs are needed and plans to utilize this contract to address that work as part of an ongoing annual concrete repair program.
The City recently issued a notice inviting bids for this project and bids were received on April 17, 2023, from nine (9) contractors. Grigolla was deemed the lowest responsive and responsible bidder for this project. Staff recommends that the City Council award a construction contract to Grigolla, in the amount of $97,500. In addition to the construction cost, a ten percent (10%) construction contingency amount of $9,750 is provided to cover any unforeseen conditions found during construction. The total construction contract cost including contingency amount is $107,250. Sufficient funds were budgeted in the Fiscal Year (FY) 2022-23 CIP Budget to cover this cost.
RECOMMENDATION:
It is recommended that the City Council take the following actions:
1. Approve Plans & Specifications prepared by the City Engineer and approve a Public Works Agreement with Grigolla & Sons Construction Co. Inc., for the 2022-2023 Concrete Repair Project in the amount of $97,500; and

STRATEGIC PLANNING STATEMENT:
There is no specific strategic planning goal or objective associated with this agenda item.
DISCUSSION:
As part of the City's current pavement rehabilitation and maintenance program, a 360 -degree design philosophy was adopted to maintain, repair, and improve streets, sidewalks, and pedestrian and traffic related improvements within the public right-of-way. The City is currently in the sixth year of a multi-year pavement maintenance program. The purpose of this contract is to address broken and damaged sidewalks, curbs and gutters that are not within the immediate pavement maintenance cycle. As we receive complaints from the public, and due to potential liability associated with broken sidewalks and curbs and gutters, Staff recommends that damaged sidewalks and curbs and gutters be repaired, sooner rather than later. Currently, the Public Works Department has identified a number of locations where these repairs are needed and plans to utilize this contract to address sidewalk and curbs and gutter repairs for neighborhoods not within the next fiscal year's project scope. This project will replace approximately 4,000 square feet of concrete sidewalks, 320 linear feet of curb and gutter, and remove associated trees at various locations.
On April 17, 2023, the City received nine (9) bids from contractors to construct the project. The following table provides the total bid amounts received from each contractor:
Contractor Bid Amount
National Pools Inc. $88,680.00
Grigolla & Sons Construction Co. Inc $97,500.00
Aneen Construction, Inc. $103,000.00
Cheloletty Engineering $104,484.00
TVR Construction Eng. LLC $125,900.00
Onyx Paving Company, Inc $142,000.00

After reviewing the bid proposals received, it was determined that Grigolla submitted the lowest responsible bid. Staff reviewed and analyzed their bid proposal, and it was found to be responsive and valid. The initial low bidder, National Pools Inc., has been found to be non-responsive due to missing bid documents submitted with their proposal and for using an altered bid form. Based upon Grigolla's reference check and submitted bid, Staff recommends awarding a construction contract to Grigolla & Sons Construction Co. Inc., for the 2022-2023 Concrete Repair Project.
FISCAL IMPACT:
The total cost for this project amounts to $107,250. This cost consists of the bid amount submitted by Grigolla & Sons Construction Co. Inc. in the amount of $97,500, and a construction contingency in the amount of $9,750. A total of $107,273.56 is available in the FY 2022-23 Capital Improvement Program for this project. As such, sufficient funds exist for the recommended actions.
