SUMMARY:
On February 7, 2023, the City Council awarded a construction contract to Aneen Construction, Inc., in the amount of $602,304.00 for the Main Street and Crowther Avenue parking Tots improvements. Contract Change Order No. 1 in the amount of $42,783.69 was approved by the City Administrator, which was under his authority limit to cover additional unforeseen construction work. The scope of the change order work included: adjusting the existing catch basin to grade, upgrading the fence material, additional base material and slurry seal of the entire alley between Santa Fe Ave and Main Street.
The Project has been completed to the satisfaction of the City. This action concludes the Project and authorizes filing a Notice of Completion with the Orange County Clerk -Recorder's Office in the amount of $645,087.69.
RECOMMENDATION:
It is recommended that City Council take the following actions:
1. Accept the work performed by Aneen Construction, Inc., for improvements of the Main Street and Crowther Avenue parking lots, City Project No. 5211 & 2204 for a grand total amount of $645,087.69; and

2. Authorize the City Administrator to file a Notice of Completion with the Orange County Clerk -Recorder's Office for the Project; and
3. Authorize the City Administrator to release retention funds in accordance with the terms of the contract.
STRATEGIC PLAN STATEMENT:
There is no specific City Council Strategic Goal or objective associated with this agenda item.
DISCUSSION:
On February 7, 2023, the City Council awarded a construction contract to Aneen Construction, Inc., in the amount of $602,304 for the Main Street and Crowther Avenue parking lots improvements. The work included removal of the existing concrete and AC slabs, minor grading, new fencing, a new gate, concrete curbs, slurry seal, new ADA curb ramp, 18 parking lights, parking wheel stops, trashcans, electrical pull boxes, striping, a new water lateral connection and irrigation.
As with most projects that require underground work, several unforeseen conditions were encountered during construction. These conditions were not known at the time the bid package and the design were prepared. These conditions included: nonstandard catch basin and additional base material to ensure adequate drainage. To extend the service life of the adjacent alley between Santa Fe Ave and Main Street, additional slurry seal, crack seal and striping quantities were added to the project. Staff has inspected and accepted the project and recommends approval.
FISCAL IMPACT:
The final construction cost amounts to $645,087.69. This cost consists of the bid amount submitted by Aneen Construction, Inc. in the amount of $602,304.00 and an additional $42,783.69 in approved contract change orders. Sufficient funds are budgeted and available in the Fiscal Year 2022-23 Capital Improvement Budget to cover this expense. As such, sufficient funds exist for the recommended actions.
