AMENDMENT NO. 2 TO AGREEMENT 12-830
This Amendment No. 2 (AMENDMENT) to Agreement 12-830 (AGREEMENT), executed on and effective from June 20. 2023 , is between the State of California, acting through its Department of Transportation, referred to as CALTRANS, and:
City of Placentia, a body politic and municipal corporation or chartered city of the State of California, referred to hereinafter as CITY.
RECITALS
1. CALTRANS and CITY collectively referred to as PARTIES, entered into AGREEMENT on September 23, 2022, defining the terms and conditions for CALTRANS intends to provide funding to the CITY, and CITY agrees to procure artist(s), administer artist contracts, provide and install the Gateway Monument that includes and/or incorporates Transportation Art at post mile 16 on State Route 57, near the intersection of Orangethorpe Avenue and Crowther Avenue referred to as PROJECT.
2. The AGREEMENT established $50,000 in Clean Ca funds.
3. PARTIES amended to add to the PROJECT FUNDS $600,000.
4. PARTIES now seek to amend to add to the PROJECT FUNDS $840,000.

IT IS THEREFORE MUTUALLY AGREED:
1. Article 8 in the AGREEMENT is replaced in its entirety to read as follows:
CALTRANS will pay CITY an amount not to exceed $1,440,000 from FUNDS required for PROJECT.
2. Article 16 in the AGREEMENT is replaced in its entirety to read as follows:
CALTRANS and CITY agree that the total amount of FUNDS paid out to CITY will not exceed $1,440,000.
3. All other terms and conditions of the AGREEMENT shall remain in full force and effect.
4. This AMENDMENT is deemed to be included and made a part of the AGREEMENT. 2 Agreement No. 12-830 A2

PARTIES are authorized to enter into this AMENDMENT and have delegated to the undersigned the authority to execute this AMENDMENT on behalf of the respective agencies and hereby covenants to have followed all the necessary legal requirements to validly execute this AMENDMENT.
