SUBJECT: RESOLUTION AUTHORIZING TEMPORARY SUSPENSION OF REGULATORY ORDINANCE SECTION 10.28.010 TO FACILITATE THE PLACENTIA

SUMMARY:
The Placentia Founders Society ("Founders") is a local 501(C)3 nonprofit organization that supports the preservation and promotion of the historic Bradford House. Periodically, the Founders host "members only" events at the Bradford House to raise funds towards maintaining the facility and to thank the members for their contributions throughout the year. To facilitate this event, a certain regulatory ordinance section must be temporarily suspended pursuant to Section
1.14.020 of the Placentia Municipal Code. This action approves a resolution which temporarily suspends §10.28.010 of the Placentia Municipal Code (PMC) to facilitate the Founders' Holiday Special Event on Sunday, December 3, from 5:00 p.m. to 9:00 p.m.
RECOMMENDATION:
It is recommended that the City Council take the following action:
1. Adopt Resolution No. 2023-83, A Resolution of the City Council of the City of Placentia, California, authorizing the temporary suspension of regulatory Ordinance Section
10.28.010 of the Placentia Municipal Code to facilitate the Placentia Founders Society's Holiday special event scheduled for Sunday, December 3, 2023 from 5:00 p.m. to 9:00 p.m.; and b) granting authority to the City Administrator or his/her designee to authorize the temporary suspension of the regulatory ordinance Section 10.28.010 of the Placentia Municipal Code for the operation of the Founders' Society Holiday Special Event held annually in December for the next five (5) years through 2028 STRATEGIC PLAN STATEMENT:

DISCUSSION:
The Founders host events periodically at the historic Bradford House located at 136 E. Palm Drive, Placentia. The Founders typically request a waiver of the "No Alcohol" policy from the City Council prior to each event. This request includes the Holiday event to be held in December 2023.
The Founders plan to serve wine and food at the Holiday event. This request is for the special event scheduled for Sunday, December 3, 2023 from 5:00 p.m. to 9:00 p.m. The December 3rd event is the annual Holiday Mixer and will feature food and beer and wine. In order to serve alcohol at the event, Section 10.28.010 of the PMC, which prohibits the consumption of alcohol on public property, will need to be temporarily suspended by the City Council during the Holiday event.
In addition, as this is an event which has been occurring for many years under similar terms and conditions, in order to maximize efficiency for this annual event, Staff is requesting the City Council grant authority to the City Administrator or his/her designee to authorize the temporary suspension of the regulatory ordinance Section 10.28.010 of the Placentia Municipal Code for the operation of the Founder's Society Holiday Special Event held annually in December for the next five (5) years through 2028. This authority has been incorporated in the proposed resolution.
FISCAL IMPACT:
There is no fiscal impact related to the adoption of Resolution No. 2023-83 granting approval of the Founders Holiday event at the Bradford House.
