SUBJECT: ACCEPTANCE OF CONSTRUCTION WORK AND NOTICE OF COMPLETION FOR DEMOLITION WORK AT 207 WEST CHAPMAN AVENUE

SUMMARY:
On July 25, 2023, the City Council approved an award of construction contract to Unlimited Environmental, Inc. for the asbestos, PCB abatement and demolition and removal of fire damaged building at 207 West Chapman Avenue (APN: 339-033-21), (the "Property"). The Property located on the northerly side of Chapman Avenue, backs to a public alley and is located immediately south of Kraemer Memorial Park. The Property is within the C1 (Neighborhood Commercial) zone district of the City.
The Property suffered extensive fire damage on November 16, 2022. On April 4, 2023 the City Council approved Resolution No. 2023-18 and a Purchase and Sale Agreement for the Property.
The City closed escrow on Monday, June 12, 2023, and the City solicited competitive bids for the demolition and removal of the remaining structure. On July 25, 2023, the City Council approved an award of construction contract to Unlimited Environmental, Inc. for the asbestos abatement and demolition of the Property. The asbestos, PCB abatement and demolition and removal of the Property has been completed to the satisfaction of the City. This recommended action concludes the work and authorizes filing a Notice of Completion with the Orange County Clerk -Recorder's Office in the amount of $60,000.
RECOMMENDATION:
It is recommended that City Council take the following actions:
1. Accept the work performed by Unlimited Environmental, Inc., for the asbestos abatement and demolition of 207 Chapman Avenue, for a grand total amount of $60,000; and

2. Authorize the City Administrator to file a Notice of Completion with the Orange County Clerk -Recorder's Office for the Project; and
3. Authorize the City Administrator to release retention funds in accordance with the terms of the contract.
STRATEGIC PLAN STATEMENT:
There is no specific Strategic Planning Statement or Goal associated with the recommended actions.
DISCUSSION:
The property located at 207 West Chapman Avenue (APN: 339-033-21), (the "Property") is located on the northerly side of Chapman Avenue, which backs to a public alley and is located immediately south of Kraemer Memorial Park. The subject property contains 11,000 gross square feet of land area. The Property is within the 01 (Neighborhood Commercial) zone district of the City and previously held a 1,698 square foot commercial building. The Property suffered extensive fire damage on November 16, 2022, and on April 4, 2023, the City Council approved Resolution No. 2023-18 for the purchase of the Property.
On July 25, 2023, the City Council approved an award of construction contract to Unlimited Environmental, Inc. for the asbestos, PCB abatement and demolition of the Property. The asbestos, PCB abatement and demolition of the Property has been completed to the satisfaction of the City. This recommended action concludes the Project and authorizes filing a Notice of Completion with the Orange County Clerk -Recorder's Office in the amount of $60,000 and starts the 30 -day window to file claims against the contractor's retention payment.
FISCAL IMPACT:
The final construction cost amounts to $60,000. This cost consists of the bid amount submitted by Unlimited Environment, Inc., in the amount of $60,000. The Affordable Housing Development Impact Fee account has sufficient funds to cover this expense.
