On May 2, 2023, the City Council awarded a construction contract to Legion Contractors, Inc, in the amount of $2,286,378.76 for the renovation of Parque Del Arroyo Verde. In general, the work consisted of rehabilitation of the parking lot, a new ADA ramp, new concrete pedestrian and vehicular paths, new playground equipment, amenities, irrigation, lighting, shade structure and landscaping. The project was completed with the addition of two change orders with a final credit amount of $4,103.50, or less than one percent of the construction contract amount. The Project has been completed to the satisfaction of the City. This action concludes the Project and authorizes filing a Notice of Completion with the Orange County Clerk -Recorder's Office in the amount of $2,282,275.26.
RECOMMENDATION:
It is recommended that the City Council take the following actions:
1. Accept the work performed by Legion Contractors, Inc. for construction of the Parque Del Arroyo Verde Renovation Project, City Project No. 7902 for a grand total amount of $2,282,275.26; and
2. Authorize the City Administrator to file a Notice of Completion with the Orange County Clerk -Recorder's Office for the Project; and
3. Authorize the City Administrator to release retention funds in accordance with the terms of the contract.

STRATEGIC PLAN STATEMENT:
This item is consistent with the City Council approved 5 -Year Strategic Goal to Implement Public Infrastructure to Meet Community Needs, under Objective #5.2, which is working to complete the Placentia Parks Initiative Plan.
DISCUSSION:
The scope of this project entailed a complete renovation of the more than three (3) -acre Parque Del Arroyo Verde. In general, the work consisted of the rehabilitation of the parking lot, a new ADA ramp, new concrete pedestrian and vehicular paths, new playground equipment, new shade structure, new amenities, new irrigation system, new lighting system, new landscaping and minor restroom improvements.
The City Council authorized contract change orders up to ten percent (10%) of the contract amount, or $228,637.88. Two (2) contract change orders totaling a credit amount of $4,103.50, or less than one percent of the construction contract amount, were executed during this contract.
On November 2, 2021, the City Council approved the appropriation of $338,650.00 for the purchase and installation of the playground equipment by Pacific Play Systems Inc. The equipment was purchased in July of 2022 and the installation was coordinated with Legion Contractors Inc. during construction of the park improvements. There was an additional cost of $1,191.00 associated with the installation by Pacific Play Systems.
Funding for this project utilized several sources which included Park and Recreation Impact Fees, Measure U and City Quimby In -Lieu Fees. Approval of the Notice of Completion is the final step in this project and, if approved by the City Council, will be recorded with the Orange County Clerk - Recorder's Office starting the 35 -day window to file any construction claims against the Contractor. At the conclusion of the 35 -day window, if no claims have been filed with the City against the Contractor, the City can release the retention funds which amount to five percent (5%) of the total construction cost.
FISCAL IMPACT:
The final construction cost plus the two change orders amount to $2,806,956.26. This cost consists of the bid amount submitted by Legion Contractors, Inc. in the amount of $2,286,378.76 and the credit of $4,103.50 for Contract Change Orders No. 1 and 2. The final contract amount with Pacific Play Systems Inc consists of the original appropriation amount of $338,650.00 and the additional charge of $1,191.00 for the purchase and installation of the playground equipment.
The final contract amount with Fountainhead Consulting Corporation (formerly PPM Group Inc) for Construction Management/Inspection services amounts to $184,840.00. A total amount of $3,017,577.04 was available and budgeted within the Fiscal Year (FY) 2023-24 Capital Improvement Program Budget for this project. As such, sufficient funds exist for the recommended actions.
