Meeting Date: April 15, 2025
Submitted by: Jennifer Lampman
From: Finance
Subject:
Public Hearing and Adoption of Proposed Comprehensive Fee and Rate Schedule for FY 2025/26
Financial Impact:
Fiscal Impact:
The proposed fee changes as of July 1, 2025, are intended to recover the cost of providing existing services associated with those fee-related regulatory functions and other programs.
Summary:
The City of Placentia is responsible for providing a variety of services to its citizens. Services that support the general public, such as public safety services are supported by tax and other non-fee revenues, while services that are more elective in nature and have specific individual beneficiaries are typically supported by user fee charges. User fee-related services are provided by many City departments, but tend to be more heavily concentrated in Planning, Building, Engineering and Community Services. By law, user fees must not exceed the cost of the service provided. The City Council can choose to set fees that fully recover the cost of service or place said fees at lower levels that provide a level of subsidy, or alternatively, reduce costs by reducing the level of service provided.
Annually, the City reviews its fees and makes adjustments to ensure fees are consistent with industry best practices and city processes, account for inflation and may also add new fees resulting from new programs and/or changes in service delivery.
Recommendation:
Recommended Action: It is recommended that the City Council consider the following actions:

SUBJECT: PUBLIC HEARING: ADOPTION OF PROPOSED COMPREHENSIVE FEE AND
RATE SCHEDULE
FISCAL
IMPACT: The proposed fee changes as of July 1, 2025, are intended to recover the cost of providing existing services associated with fee-related regulatory functions and other programs.
By law, user fees must not exceed the City’s cost to provide the service.
This consistent review and adjustment of fees provides multiple benefits, including:
• Increasing the availability of General Fund revenues to be used for services and activities available to all residents and businesses, such as public safety services. • Keeping pace with general cost inflation.
• Avoiding fee spikes that are more likely to occur when municipalities leave fees unchanged for a multi-year period.
• Providing fee payers, City staff, and City policymakers with a pattern of consistency that provides information for forecasting and decision-making purposes. • Helping to meet fee-payer service level expectations by collecting fees to fund the existing level of services provided.
• Encouraging generational equity among fee payers by avoiding long-term stagnation of fees followed by significant fee increases.
AGENDA REPORT
8 City Council Agenda
April 15, 2025
The City engaged Clear Source Financial Consulting to conduct a comprehensive fee study in 2022. Prior to that, fee studies were completed in 2018, 2012 and 2007; Prior to 2007, the City’s fee schedule had not been updated since 1990.
Following Clear Sources’s recommendation to review and adjust fees annually, staff is proposing an adjustment of all fees by 3.1%, the CPI for All Urban Consumers (Los Angeles-Long Beach- Anaheim, CA) for February 2025.
RECOMMENDATION:
It is recommended that the City Council consider the following actions:
1. Open the Public Hearing to consider amending the Placentia Comprehensive Fee Schedule for certain fees, rates, and charges for various City user services; and
2. Receive the Staff report, consider all public testimony, and discuss the proposed fees; and
3. Close the public hearing; and
4. Adopt Resolution No. R-2025-13, a Resolution of the City Council of the City of Placentia, California, establishing and adopting certain City fees, rates, and charges for various City services with an effective date of July 1, 2025, for Fiscal Year 2025-26.
DISCUSSION:
The proposed fees are intended to comply with applicable federal, state, and local laws including providing confirmation that the proposed fees and charges are not a tax as defined in Article 13C of the California Constitution and that the proposed fees are no more than necessary to cover the reasonable costs of the City’s activities and services addressed in the fees. Additionally, the manner in which the costs are allocated to a payor bear a fair and reasonable relationship to the payor’s burdens on, or benefits received from the activities and services provided by the City.
Nearly every service for which a fee is imposed can be illustrated as follows, contrasting the components of the full cost of service, which is the maximum fee amount justified, against the local agency’s goals for cost recovery:
9 City Council Agenda
April 15, 2025
The City engaged Clear Source Financial Consulting to conduct a comprehensive fee study in 2022. Following their recommendation, staff is proposing an adjustment of all fees by 3.1%, the CPI for All Urban Consumers (Los Angeles-Long Beach-Anaheim, CA) for February 2025.
Other changes proposed to the fee schedule are outlined below.
Fire Prevention Fees
Fire staff is recommending the addition of a two new fees:
Occupancy before approval ($220)- recover costs associated with the Fire Marshal’s time to inspect the site and ensure safety compliance.
Work without a permit (actual cost or specified system inspection fee)- recover costs associated with the Fire Marshal’s time to inspect the site and ensure safety compliance.
The proposed changes will allow the City to recover a much higher percentage of its costs related to its fire operations.
Development Services
After reviewing current services provided at the development services counter, staff is recommending the addition of the following new fees.
10 City Council Agenda
April 15, 2025
Appeal of short-term rental permit revocation- The City established a short-term rental program in 2019 with 68 short term rentals currently operating within the City. Municipal Code section §6.45.160 allows for the revocation of short term residential rental permits when the operator is determined to be in violation of the requirements of the code. Included in this section is an outline of the process for appealing the decision of the Director of Development Services to revoke the permit including an appeal to the Planning Commission and subsequently to the City Council. Currently the City’s fee schedule only has one fee for the appeal of staff decisions to the Planning Commission and/or City Council, proposed to be $3,374 and $5,735 respectively.
Many short-term rental operators are small businesses who may not generate enough revenue to justify such a high fee, and there is considerably less staff time involved in processing these types of appeals compared to development projects. Staff is recommending establishing a new fee for the appeal of a revocation of a short-term residential rental permit to more accurately reflect the City’s cost in reviewing these types of appeals.
Misc. Building fees- to recover the cost of inspections of various types of construction, many which require multiple inspections, staff is recommending adding fees for projects such as seismic retrofit, T-bar ceiling, carports, fireplaces, covered porches, house fan implementation, electrical subpanels, and capping electrical work among others.
Technology fees
In 2009, the City Council approved resolution R-2009-105 to recover costs associated with digitizing and modernizing technology in the Development Services and Public Works Departments. Examples included in the study supporting these fees were implementation of a building permit database, geographic information systems (GIS), and the digitizing, storage and retrieval of past and future permits and plans related to all properties and public improvements in the City.
Some of these projects have been implemented and the City is now paying annual software subscription fees on them, however some projects identified in the 2009 study such as the online permitting system and digitization were just recently implemented or still need to be completed.
In addition, the increased use of technology citywide, not just within Development Services and Public Works, the need for additional information technology support, and many vendors transitioning to annual subscription-based service have increased the City’s software costs significantly.
Staff is recommending removing the restriction on the use of funds generated by the technology fee and allowing those funds to support technology enhancements and maintenance citywide.
11 City Council Agenda
April 15, 2025
Code Enforcement
Staff is proposing eliminating the “Massage Technician Permit” fee as staff does not do any additional background check or administrative work above the “Massage Establishment Permit” and cannot justify charging this additional fee.
Public Works
For FY25/26, staff is proposing the addition of an “Address Issuance” fee to recover the cost of staff time to research and issue addresses. Requests for addresses can vary in nature from simple requests such as utility pedestals or accessory dwelling units (ADUs), to more complex requests which take more time to research and process such as single-family residences and large development projects such as the Cenza. Different fees would be charged based on whether it’s a simple or complex request due to the differences in staff time needed to complete the request.
The proposed fee is $168 for simple and $504 for complex requests.
Finance
The City accepts credit cards for payment for a multitude of services such as business licenses and permits, and has been paying credit card processing fees from the General Fund. In FY23/24, the City paid approximately $71,000 in credit card processing fees, and is projected to pay a similar amount in the current fiscal year. The City anticipates an increased use of credit cards in future fiscal years as we fully implement the online permitting software in development services and public works as well as the public’s increasing use of credit cards or other forms of electronic payment such as apple pay for payment.
Credit card processing fees vary depending on the type of card used (Visa vs Mastercard) and even vary depending on the level of card (mileage or reward program) and range from 1.7%-4%.
To recover a portion of these costs and reduce the subsidy from the General Fund for the customer’s convenience, staff is proposing implementing a two- and one-half percent (2.5%) credit card processing fee for payments made by credit card. Customers will have the option to pay via check, and/ or electronic payments (ACH) without any additional fees, but would be charged the processing fee if they chose to pay by credit card.
Neighboring agencies such as County of Orange (2.29%), Orange County Fire Authority (2.45%), Cypress (2.9%), Tustin (1.7%), Stanton (2.6%), Newport Beach (2.85%), Huntington Beach (3%), and most recently Garden Grove (2.2%), charge credit card processing fees to recover the costs of processing these payments.
FISCAL IMPACT:
Additional revenues expected from the Proposed Master Fee Schedule are intended to offset the cost of providing existing services associated with those fee-related regulatory functions and other programs. Changes to fees are for cost recovery purposes only.
