1. General: This program is for providing Placentia Police Department – generated tows for the firm that have been qualified to provide such services for the City. The participating firm must agree to abide by the terms and conditions of an agreement (the “Agreement”) in the form provided by the City and further agree to pay the City an administrative cost recovery fee (Franchise Fee) in consideration for being selected as an Official Tow Service of the City and to reimburse the City for actual and reasonable costs incurred in connection with the towing program. (California Vehicle Code, Div. 5, Chap. 9, § 12110(b).
2. Services: The services to be provided include as-needed non-consensual towing and vehicle storage services as directed by the City. All services shall be provided in accordance with any and all applicable federal, state and local ordinances, rules and regulations. Specific services include but are not limited to: towing and storing vehicles involved in accidents or disabled for other causes (when alternate towing is either not appropriate or is not requested by the owner or operator of the vehicle); and towing and/or storing of vehicles which for other reasons are within the jurisdiction of the Placentia Police Department, including towing of improperly parked vehicles, vehicles that obstruct or impede the flow of traffic, emergency lanes or walkways, and/or handicapped parking spaces, impounded/forfeited vehicles, and/or vehicles seized as evidence. Each Official Tow Service shall be able to properly conduct a lien sale as outlined in Division 11, Chapter 10, Article 2, beginning with § 22851 of the California Vehicle Code.
3. Special Services: The Operator participating in the tow program will be required to provide As-Needed towing and related services for City vehicles free of charge. This includes, but it not limited to: flat tire, battery jump, and towing of any Police Department or City vehicle, regardless if it is located outside of Placentia’s jurisdiction.
4. Rates and Charges for Service:
A. Maximum rates for towing, storage, and other services will be set by the City Council. It is anticipated and, historically, the City Council has set the tow and storage fee schedule by using the average towing and storage fees charged by area tow companies and/or allowed by the California Highway Patrol, Santa Ana Bureau. All charges for towing, impound, storage, and other services required to be performed by the Official Tow Service shall not exceed the schedule of rates approved by the Placentia City Council.
B. All rates and charges shall be conspicuously posted in the Official Tow Service’s office and in all tow vehicles, and shall be available for review by City personnel and/or persons for whom tow service is provided. It will be the Official Tow Service’s responsibility to collect payment for services it renders from the vehicle owners, and the City shall not be responsible in any way whatsoever for payment of these charges.
C. Routine clean-up, which includes removing all debris from the accident scene, including but not limited to clean-up and removal of all vehicle fluids in the street with absorbent material, as directed by Placentia Police Department officers and § 27700 of the California Vehicle Code, is included in the basic tow charge.
D. The Official Tow Service shall accept a valid bank credit card or cash for payment of towing and storage by the registered owner, legal owner, or agent of the owner claiming the vehicle.
E. In the event that unforeseen changes in the tow service industry seriously affect the Official Tow Services’ ability to continue to provide the towing, impound, and storage services required under this Agreement, an Official Tow Service may petition the City for a re- 347
evaluation of the agreed upon charges and rates in accordance with Placentia Municipal Code § 6.76.060.

B. Payment of the administrative cost recovery fee shall not be made contingent on any payments due or paid to the Official Tow Services for the actual tow and/or storage of any vehicles. When an Official Tow Service fails, neglects, or refuses to pay or remit the administrative cost recovery fee, or otherwise pays the fee but later cancels or stops payment on it, and in either situation that fee’s payment or remittance is lawfully due or owing, the entire amount of the unpaid or non-remitted administrative cost recovery fee constitutes a debt to the City by the Official Tow Service, from whom the City may recover in a civil action. The failure to timely pay the administrative cost recovery fee shall also be deemed a material breach of the Agreement for which the City may terminate the Agreement.

Scenes are simulated to give drivers real-life scenarios with which to perfect their technique. Developing a quality dispatch core is an important key to our overall success. We realize this and have spent countless hours and many resources doing just that, developing and training dispatchers. We implement a combination of tools such as The Art of Dispatch and Customer Service Training Manuals. Our customer service manual is 18 pages covering a vast array of topics that all of our employees receive.
Employee feedback is welcomed and often this feedback leads to the development of additional process-improvement policies. Planning can limit but not eliminate turnover. We continually accept employee applications and advertise open positions. We conduct interviews with all qualified applicants throughout the year.
We employ driver trainers and other senior personnel to conduct our internal training. P&H Enterprises, Inc. is an equal opportunity company under rules and regulations set forth by the State of California and the US Government.

Our founder, Harry Saehlenou was a well-recognized icon on the industry. Harry was a dedicated member and supporter of both the California Tow Truck Association and Friends of Towing. Harry was one of the founders of the CTTA and served as chapter president. Harry Saehlenou was an advocate in the California Tow Truck association (CTTA), Towing and Recovery Association of America (TRAA), Friends of Towing Museum (FOT) and International Towing and Recovery Hall of Fame and Museum. Harry Saehlenou played a key role and took the lead in converting a tandem axle furniture van into a traveling Friends of Towing Museum that was towed by members, from one tow show to another. Indeed, the first introduction to the society for many was a visit to this traveling museum that also displayed the photos of the Hall of Fame members. Harry, Patricia, many towers and other industry personal and firms donated considerable time and money toward the development, movement and display of this traveling museum, which found a home. Eventually, FOT was reorganized as today’s International Towing and Recovery Hall of Fame and Museum Inc. located in Chattanooga, Tenn., the undisputed birthplace of the wrecker industry. Harry Saehlenou was inducted into the Florida-based Friends of Towing Hall of Fame in 1988, recognizing his years of service and effort to advance professionalism in the towing industry.

Mark has assumed every responsibility at the company from pushing a broom in the shop as a kid to President of the corporation. Mark learned from two of the most respected people in the industry, his parents, Patricia Saehlenou and Harry Saehlenou. The 370

company’s success has always been based off on three main beliefs, and they are:
professionalism, reliability and safety. Mark’s commitment has always been to change everyone’s perception of the business in an industry that has provided inconsistent service, unethical practices and has been poorly perceived by the public. Mark has raised the bar by delivering good service and operating in an ethical manner. While this may sound simple enough, it’s a rare commodity in this industry.
Having been fortunate enough to grow up in an industry that he loves, Mark learned the ins and outs of the industry through hands on experience. Just like his parents, Mark has always given back to various local charitable organizations but the two dearest to him are the Boys and Girls Clubs and the Make-A-Wish Foundation.

He started towing full time for a AAA contract station in Fountain Valley. He later went to work for Country City Towing, which is where he was determined to advance into Heavy Duty Towing. He operated different equipment at Country City Towing, from light to heavy duty and also gained experience operating their four car carriers, auto transporter, landoll trailers and Tru-Hitch unit. He operated all heavy-duty tow trucks and landoll trailers. He took the initiative and volunteered for rotator operation and recovery on his own. He was very open and willing to train and tackle any new challenges. He learned his heavy duty towing and recovery experience from one of the very best in the industry, 37-year veteran Mark “Hoagie” Hangsleben.

There are pre-employment drug testing requirements for all new hires and all drivers are enrolled in random drug and alcohol testing pools. We also perform a federal background inquiry per DOT/FMCSA requirements from previous employers going back 3 years. Under Federal DOT/FMCSA, all carriers are to implement a query plan by January 6, 2020.
The Clearinghouse is a secure online database that will give employers, the Federal Motor Carrier Safety Administration (FMCSA), State Driver Licensing Agencies (SDLAs), and State law enforcement personnel real-time information about commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders’ drug and alcohol program violations. The Clearinghouse will contain records of violations of drug and alcohol prohibitions in 49 CFR Part 382, Subpart B, including positive drug or alcohol test results and test refusals. When a driver completes the return-to-duty (RTD) process and follow-up testing plan, this information will also be recorded in the Clearinghouse. A drug free workplace policy is in effect. Refer to Exhibit #5: Drug policy information.

C.5 This multi-million dollar company has been in business for over 65 years and is held under the Saehlenou Family Trust. P&H Enterprises, Inc. is the sole legal owner of the property and all equipment including vehicles. We bank at Banc of California, formerly Pacific Western Bank located at, 2400 E Katella, Suite 125, Anaheim, CA 92806. Cindi Misak is the branch Vice President and may be contacted for reference (714) 845-4227. Our Dun and Bradstreet number is 829395193. Company Accountant is Mr. Kenneth Blake, CPA, EA, CTC., 440 S. Brea Blvd., Suite B, Brea, CA, 92821, Phone: (714) 529-1040. The Company is financially sound. There is no known condition that would impede our ability to complete the agreement. Refer to Exhibit #6
C.6 Since 2007, the company has purchased more than $5 million in new equipment.
Most of the equipment had been purchased outright up to that point. After 2007 we began financing equipment with TCF Equipment Finance. In the past 3 years, the company has financed over $1.5 million in equipment, with more equipment on order. We had been working with TCF Equipment Financing dating back to 2002 and had a long-standing relationship up until 2021 when the lender was acquired by Huntington Bank and the lender steered away from our industry. We initially started working with Mr. Peter Thorpe at TCF Equipment Finance dating back to 2002. Pete retired in 2019, and Ryan Whitehead became our new rep with TCF, along with Jeffry Vint, Vice President Sales Manager at TCF Capital Solutions. Ryan Whitehead left Huntington to work for AP Equipment Financing after the acquisition and a few years later we found out that Pete Thorpe came back as the Vice President of Verdant Commercial Capital so having a history with both has its advantages of having lenders compete for our business. We’ve had a personal relationship with Pete going back 35 years in the industry.
Our process of financing equipment is quite simple. Any equipment financed under $250K just requires us to submit a signed bill of sale from the dealer and instantly approved. Loans in excess of $250K just require updated financials.
We also work with Cameron Jones at Ashwill Associates. Cameron has assisted us in securing our last few locations and understands our needs and our industry requirements. Personal and staffing can obtained as needed, most come from referrals from within our company.
C.7 Included are three letters, one from Pete Thorpe at Verdant Commercial Capital, one from Ryan Whitehead at AP Equipment Financing and one from Cameron Jones at Ashwill Associates, in case they need to be reached for questions or inquiries regarding our ability to secure funding or commercial property. Refer to Exhibit #7
C.8 The Company has an on-going replacement policy for vehicles and equipment and abide under C.A.R.B. (California Air Resources Board) truck replacement 373

regulations. Our fleet is reported under California’s Clean Truck Check and TRUCS, a C.A.R.B. reporting website and elected the phase-in truck replacement option.
We are in good standing and compliant. Since 2007, the company has cycled through and retired or sold 26 units. The company has invested more than $5 million in equipment and will continue to cycle through to meet regulatory compliance. We currently have 15 power units and 3 trailers. We’re also in the market for a class C heavy wrecker and tractor and replacing our one tine wrecker.
The average truck tenure of a light duty truck is 5 years and medium-heavy is 10 years. Our fleet consists of primarily Peterbilt trucks which is considered the marquee truck manufacturer in the medium and heavy-duty truck market. They are known for higher quality, durability, performance and best resell value. Our replacement policy is in line with California Air Resources Board Compliance Regulation and have complied since the program was implemented. The fleet is and will continue to comply with C.A.R.B.-A.Q.M.D. requirements for diesel engine vehicles.
C.9 Records of each Law Enforcement Agency under Contract/Agreement, are separated. Files will be maintained for the City of Placentia by computer and backed up hard copies in filing cabinets and locked up in a fire proof safe. Any request made by the City of Placentia for towed/stored vehicles and or lien sale information will be available immediately during normal business hours.
We utilize Towbook dispatching and inventory software which is the most trusted towing software available and the leader for cloud-based towing software. Capable of real-time date access, streamlined dispatching, manage vehicle inventory, GPS integration and revenue and income reports for any specific period of time and/or per account. We can easily manage our Dispatching, Invoicing, Vehicle Inventory/Impounds, Liens, Auctions and more, all through our use web based system.
In after-hours emergency cases, the request shall be completed through the company’s on-site dispatcher at 714-533-4575. Refer to Exhibit #8: Samples of towing, storage, reports and lien sale documents.
C.10 Refer to Exhibit #9: Certificates of Liability Insurance and Workers Compensation Insurance for the City of Placentia.

D. Successful Completion of Similar Service Arrangements
D.1 Rotation Towing and Storage Contracts / Agreements are current with the City of Fullerton since the late 1950s. We were on rotation with CHP since the early 1960’s, until our last service agreement in June 2016. We remain on rotation since 2021 with the California Highway Patrol after a five year break. We have been providing similar services to Cal-State Fullerton Police since the late 1980s. We also have an agreement with the City of Buena Park that started in January 2023 but started providing services as an emergency contractor due to their service providers closing in February 2022. Prior to that we had already been providing heavy duty tow services for the city on an on-call basis. Our current agreement with Placentia started in 2009. We also provide towing and storage services to the cities of Brea, La Habra, Orange, Santa Ana on an as needed basis. In addition, we provide services to OCATT, DEA, IRS, California State Parks, Railroad Police and Bureau of Land Management upon request. We also provide services to all surrounding cities and agencies by request.
D.2 We provide towing services, salvage and recovery services and storage services that include, but are not limited to towing of vehicles involved in collisions or disabled for other causes; removal of vehicles that impede the flow of traffic; impounding of vehicles for evidence; removal and storage of vehicles abandoned in public places or on private property; and for any other reason within the jurisdiction of the city and law enforcement agencies. We also provide towing and storage services to the cities of Brea, La Habra, Orange, and Santa Ana on an as needed basis. In addition, we provide services to OCATT, DEA, IRS, California State Parks, BNSF Police, and Bureau of Land Management upon request. We currently have or completed similar contracts with the same scope of work:
City of Anaheim, Anaheim Police Department, services started in the early 60’s until December 2023. The tow officer for the Anaheim Police Department is Sgt. Ryan Blackburn, (714) 765-1834.
City of Buena Park, Buena Park Police Department, services started in February 2022, on an emergency contract. Our tow officer is Sgt. Connor Lee, (714) 562-3943.
City of Fullerton, Fullerton Police Department, services started in the late 50’s. The tow officer is Cpl. Austin Grogan, (714) 738-6811. You can also speak with Sgt.
Jeffrey Beaty (714) 738-2984.
City of Placentia, Placentia Police Department, services started in 2009. The tow officer for the Placentia Police Department is Sgt. Frank Garza, (714) 676-8556.
Cal State Fullerton Police Department, services started in the late 80’s. The tow officer for Cal State Fullerton PD is Lt. Robert Mullaney (657) 278-3144. 375
PROPOSAL FORMAT AND CONTENT RFP FEB 27, 2025
California Highway Patrol, Westminster (670 area), services started in the late 60’s till 2016. We removed ourselves from the CHP TSA program for 5 years, the re- enrolled in 2021. Our tow officer is Ofc. Patrick Goddard, (714) 892-4426.
D.3 In the past 2 years we’ve received 2 violation complaints with the City of Fullerton.
The first violation occurred August 30, 2023 for delayed response time of more than 20 minutes on a request to tow a vehicle out of a parking structure. Our driver arrived on scene 20 minutes past the allotted time, total of 40 minutes with a truck to enter the parking structure.
Our second violation occurred May 5th, 2024. The violation was pertaining to violating Fullerton’s Tow Guidelines and Requirements, section tow truck drivers assigned to respond shall be courteous to all persons contacted at any time during call for services. While our driver was sweeping and cleaning up the scene of an accident our driver began verbally engaging and screaming profanities at a motorist who he said almost hit him. Regardless, the matter should have been reported to the officers on scene.
We have not received violations from other cities or agencies we contract with. All equipment violations and inspection citations are included in our FMSCA report attached to Section E.2 of this RFP.
D.4 The Company has never been suspended from a towing and storage Contract / Agreement by any agency for any reason. In December of 2023, the City of Anaheim ended our towing agreement due to the City of Anaheim not granting us our Conditional Use Permit after we relocated. We were in almost a 2-year process of trying to obtain it.

E. Safety Record
E.1 Safety training is a priority at the company. All tow drivers are certified through the California Tow Truck Association (CTTA) and Emergency Road Service Coalition of America (ERSCA). All our operators have also all completed a Federal Highway Administration course, Traffic Incident Management (TIMs Training). Operator training courses consist of Essentials of Standard Duty Towing & Recovery (16 Hour courses), Essentials of Heavy Duty Towing & Recovery (24 Hour Course), Advanced Winch & Rigging Safety for Heavy Duty (16 Hour Course), and Hybrid/Electric Vehicle Operations (8 Hour Course). We follow all rules and regulation set forth through the Tow Service Agreement (TSA) and local law enforcement agency requirements, including Live-Scan background through D.O.J./F.B.I. and ongoing updates conducted in-house, such as cargo securement, air-brake inspections and adjustments, hazmat training. We also utilize tow specific material provided by tow publications such as Tow Times and American Towman. Topics are industry specific and we utilize them as part of our training and monthly safety meetings. All training is in compliance with all Federal, State and Local rules and regulations.
All trucks are GPS equipped with vehicle telematics and to the second real-time visibility tracking. All trucks have in-can A/I dual facing cameras to monitor driving events and passenger safety. The cameras have safety features that include distracted driving, tailgating, rolling stops, harsh driving, no seatbelt alerts, helping drivers practice safe driving habits. We have also mounted auxiliary rear view cameras to view the rear of the trucks for ensuring the safety of the vehicles as well as monitoring wrecker operations. We do have live view options to view any camera in real time. Our truck cameras also take snapshots of hot functions as well as video segments of any bad habits or unsafe driving practices. Our drivers scan themselves into the truck they are driving, and the cameras monitor the driver’s behavioral events as well as keeping an overall score of each driver. The top three drivers are rewarded monthly. Exhibit #10: Training Tools
E.2 In the past 3 years, the company has had two trucks placed out of service for mechanical violations. During DOT inspections in 2023, one truck was placed out of service for a brake hose chafing, and in 2024 a small crack was found on the drive shaft yoke. Both violations were repaired onsite by our mobile fleet service vendor.
Other DOT inspections have produced minor violations, (defective light, fire extinguisher mount, safety triangles). Since May 19, 1994 P&H Enterprises Inc. dba:
Anaheim Fullerton Towing has been awarded Certificate of Achievement by the California Highway Patrol for six (6) Consecutive Satisfactory Ratings and four (4) Administrative Reviews for motor carrier safety and compliance through the Biennial Inspection of Terminals (BIT) program. The most recent BIT terminal inspection was January 14, 2021. Any and all violations from inspections have all been minimal and immediately corrected. Our fleet is maintained by LA Truck and 377
PROPOSAL FORMAT AND CONTENT RFP FEB 27, 2025
Trailer Repair, an outside vendor that performs 90-day BIT and annual inspections, as well as PM services and truck and trailer repairs. We also utilize P&M Diesel for any major repairs. The warranty repairs are carried out through the truck dealers or wrecker manufacturer dealers. Our California Air Resources Board emissions testing is performed by Diesel Exhaust & Emissions out of Sante Fe Springs, CA.
They have been keeping our fleet in compliance since CARB enacted the clean air requirements.
Anaheim Fullerton Towing will remain in compliance with all motor carrier regulations, tow equipment requirements and standards. The Company has never been suspended from a towing and storage Contract / Agreement by any agency for any reason. Refer to Exhibit #11: FMCSA Safety Measure System.
F. Rates for Service
F.1 The Company is approved to operate on rotation with the Buena Park Police Department, Fullerton Police Department, California Highway Patrol, Cal-State Fullerton Police Department and Placentia Police Department. We provide services on an as needed basis for the CHP Santa Ana and Santa Fe Springs areas. Refer to Exhibit #12: Copy of municipality rates and CHP approved area tow rates attached.
G. Additional Information
G.1 At the scene or the drop off point, the driver collects the fee in cash or sends the customer a payment link via text message or email so that the customer can pay by credit or with debit card. At the tow yard, fees are collected via credit card, debit card, Apple Pay, Google Pay, Insurance salvage checks or cash when the owner or agent picks up the vehicle. Abandoned vehicles are sold at public auction and all fees are applied towards the balance due. We also try to work with vehicles that cannot afford to pick up their vehicles and want to turn in their titles. Any vehicle not sold at auction will be taken to the salvage yard for scrap metal’ The proceeds collected are then applied to the fees owed. The balance of non-payment is turned over to the company’s collection agency, AAA Credit Service Collection Agency, 520 N. Brookhurst Suite # 204, Anaheim, CA 92801 (714) 956 – 1100.
G.2 Storage Fees Policy and Application complies with the rules and regulations stated in the storing agency’s Contract / Agreement and/or the CA Vehicle Code. Storage fees are applied to all vehicles that are impounded or stored. The initial 24 hours is charged as one (1) day, after the initial 24 hours storage is tabulated per calendar day. The exception is vehicles stored under evidence. Our system will have the vehicle stored at the daily rate for inside or outside storage, but the fees are 378
PROPOSAL FORMAT AND CONTENT RFP FEB 27, 2025
adjusted once the vehicle is removed from evidence or taken off of the investigation hold, following the waiting period the vehicle storage rates will commence.

All assigned drivers on this agreement have experience in working with law enforcement agencies in removing multiple vehicles such as, from DUI checkpoints, no parking construction zones and illegally parked or traffic hazards being removed through a law enforcement agency. When requested, we are able dispatch the following: one (1 vehicle) wheel lift, six (2 vehicle) car carriers and one (3 vehicle) car carrier to remove 16 vehicles at a time. Drug and Alcohol Policy
_______________________________________________ __________________ Signature of applicant/employee Date
_______________________________________________ __________________ Signature of witness Date Drug Free Workplace Policy
Drug Free Workplace – It is the purpose of this policy to articulate the position of Anaheim Fullerton Towing with respect to the use of drugs or alcohol by company employees while on company time, in vehicles owned, leased or rented by the company, on company property or in company facilities. It is the policy of Anaheim Fullerton Towing to maintain a safe, healthful, lawful and productive workplace. The owners and principals of this company are committed to discouraging alcohol and/or drug abuse, and to achieving a work force free from the influence of drugs and alcohol.
It is the intent of this policy to defer the misuse or abuse of legal or illegal substances which create a threat to the safety and health of any employee, customer or member of the public. We are concerned with those situations where the use of alcohol and/or drugs interfere with any employee or affects the safety of the public.
All driver and/or dispatch applicants are subject to pre-employment drug testing prior to hire. In the case of a job offer, an employer cannot force you to take a drug test. However, refusing to take the test may result in a rescinded offer of employment.
Anaheim Fullerton Towing also has a “drug-free” policy and requires all employees to submit to Random drug testing:
Employees may be selected at random for drug testing at any time. These tests are unannounced and unexpected by employees. Reasonable suspicion testing: Also known as for cause drug testing, is performed when supervisors have evidence or reasonable cause to suspect an employee of drug use. Evidence is based upon direct observation, either by a supervisor or another employee. Post-Accident Drug Test: Any employee involved in an on-the-job accident or injury may be tested for drug and/or alcohol use. These accidents can include driver negligence, a workplace injury with medical treatment on or away from the scene, disabling damage, or car removal.
The use, possession or sale of illegal drugs is unlawful, dangerous and prohibited. The use of alcohol in the workplace or prior to coming to work, so that the employee’s performance is impaired is prohibited. The abuse of all drugs, including being impaired due to alcohol consumption, by any employee will not be tolerated. Drug and alcohol impairment can negatively affect health, safety, security, productivity, company liability and consumer confidence and trust.
Violation of this policy may be grounds for disciplinary action up to and including immediate termination from employment with Anaheim Fullerton Towing. If an employee fails a random drug and/or alcohol test or refuses to test, immediate termination may be enforced.
Employees who experience drug and/or alcohol problems are encouraged to seek assistance through their insurance provider. It is the responsibility of each employee to seek assistance before alcohol and/or drug problems lead to work- related performance problems. All testing is to be completed by certified collectors and laboratories. Your program administrators are Mark Saehlenou and Oscar Chavira. Please direct all questions to either one of them.
Policy Acknowledgement: I, _____________________________________ acknowledge that I have read the company policy and I fully understand that violation of this policy will be grounds for disciplinary actions up to and including termination.
