City Clerk Department

My name is James Webb. This letter is addressed to City Council of Placerville for the August 08, 2023 council meeting.

I received a Notice to Correct regarding Occupancy Issues from the Code Enforcement Department on June 20, 2023 regarding my ADU within City limits.

I applied for a hearing on June 30, 2023. Our local laws identify my right to a timely hearing and require my hearing to be held within 30 days of my filing date. I want to bring to the attention of the City Council that the Code Enforcement department has failed to follow through with their 30-day timeline to hold my public hearing with a neutral mediator. I have since asked for my hearing and deposit fee to be refunded in a Demand letter and I have given City staff until August 11, 2023 to provide me with my refund for their failure to follow due process of my timely hearing. I was required to follow our local rules of law and file for my hearing timely, I hope your staff are held to the same timely expectations as the residents they serve.

Additionally, some of the specific occupancy issues that I have proposed and put as questions to the Code Enforcement Department have gone unanswered. Noteworthy, some of the issues that I have brought up to the Code Enforcement Department are being directly discussed in the proposed Agenda to not be allowable in Item #7.5 Ordinance and with penalties of a misdemeanor a $1000 fine and up to 6 months in jail. I am bringing this to the attention of the Council as the timeliness of this item to be approved with such severe consequences is something that I am taking very personally and I have considered that this is why staff has delayed their responses and provided me with no hearing. It is hard not to take this as intentional and I am feeling singled out and targeted consequently. I am interpreting that staff may have waited for this ordinance to be signed and approved to correct their position with the previous code enforcement questions that I have proposed to them.

I therefore ask that you please wait to approve the 7.5 Ordinance until after August 11, 2023 so the Code Enforcement Department has time to address the specific Demand letter that I have provided to them on August 1, 2023.

Thank you
James Webb
