Meeting Date: January 24, 2022
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
SUBJECT: ADOPT RESOLUTION NO. ___-22 ACCEPTING AB 1600 REPORT ON DEVELOPMENT IMPACT FEES FOR FISCAL YEAR ENDED JUNE 30,
2021

SYNOPSIS
Staff requests that the City Council signify its review of a State-required annual report on the collection and expenditure of development impact fees through the adoption of a resolution.

DISCUSSION
Background
AB 1600 (Mitigation Fee Act, 1998), codified as Section 66000 et seq. of the California Government Code, regulates how public agencies collect, maintain, and expend impact fees imposed on developers for the purpose of defraying costs of public facilities. It includes requirements for annual accounting and reporting of the fees.

Section 66006(b)(1) includes the following specific reporting requirements:

For each separate account or fund established pursuant to subdivision (a), the local agency shall, within 180 days after the last day of each fiscal year, make available to the public the following information for the fiscal year:
(A) A brief description of the type of fee in the account or fund; (B) The amount of the fee;
(C) The beginning and ending balance of the account or fund; (D) The amount of fees collected and interest earned;
(E) An identification of each public improvement on which fees were expended and the amount of the expenditure on each, including the percentage of the cost of the public improvement that was funded with fees;
(F) A description of each interfund transfer or loan made from the account or fund, including the public improvement on which the transferred or loaned fees will be expended, and, in the case of an interfund loan, the date on which the loan will be repaid, and the rate of interest that the account or fund will receive on the loan; and
(H) The amount of refunds made pursuant to subdivision (e) of Section 66001 and any allocations pursuant to subdivision (f) of Section 66001.

Further, Section 66006(b)(2) requires that the local agency governing board review the information made available to the public pursuant to Section 66006(b)(1).

Traffic mitigation fees are the only development impact fees collected by the City, and have been identified as fees subject to Government Code Section 66000 requirements.

Historically in the City of Pleasant Hill, the required governing board review of the annual report of the impact fee has been achieved through the City Council’s acceptance of a report containing the required information and adoption of a resolution confirming acceptance of the report.
