• NOTICE OF PUBLIC MEETING AND PUBLIC HEARING CONCERNING THE RENEWAL

OF THE PLEASANT HILL TOURISM IMPROVEMENT DISTRICT (PHTID) AND LEVY

OF AN ASSESSMENT ON CERTAIN LODGING BUSINESSES WITHIN THE PHTID NOTICE IS HEREBY GIVEN that on December 6, 2021, the City Council (the "Council") of the City of Pleasant Hill (the "City") adopted a Resolution of Intention to Pleasant Hill Tourism Improvement District (the "PHTID") and to levy an assessment on certain lodging businesses within the PHTID as set forth in the Resolution of Intention.

NOTICE IS HEREBY FURTHER GIVEN that at 7:00 PM on December 20, 2021, the City of Pleasant Hill City Council shall hold a public meeting pursuant to Government Code section 54954.6 to allow public testimony regarding the renewal of the PHTID and the levy of assessments therein as set forth in the Resolution of Intention and pursuant to Government Code section 54954.6. The meeting will be held via teleconference, and the agenda with information on how to participate will be available at least 72 hours in advance at www.PleasantHillCA.org/agendas.

NOTICE IS HEREBY FURTHER GIVEN that at 7:00 PM on January 24, 2022, the City of Pleasant Hill City Council has set as the time and place for a public hearing at which time the Council proposes to renew the PHIID and to levy the proposed assessment as set forth in the Resolution of Intention. The agenda with information on how to participate will be available at least 72 hours in advance at www.PleasantHillCA.org/agendas.

Location: The PHTID includes all lodging businesses, existing and in the future, available for public occupancy located within the boundaries of the City of Pleasant Hill, as shown on the map in the Management District Plan ("Plan").

Services: The PHTID is designed to provide specific benefits directly to payors by increasing awareness and demand for room night sales. Sales, marketing, and communications programs will increase demand for overnight tourism and market payors as tourist, meeting, and event destinations, thereby increasing demand for room night sales.

Budget: The total PHTID annual assessment budget for the initial year of its five (5) year operation is anticipated to be approximately $710,000. A similar budget is expected to apply to subsequent years, but this budget is expected to fluctuate as room sales do and if the assessment rate is increased pursuant to the Plan.

Management: Stay Pleasant Hill is proposed to serve as the PHTID's Owners' Association. The Owners' Association would be charged with managing funds and implementing programs in accordance with the Plan and must provide annual reports to the City Council.

Cost: The initial annual assessment rate is three percent (3) of gross short-term room rental revenue. Based on the benefit received, assessments will not be collected on: stays of more than twenty-nine (29) consecutive days; a person as to whom, or an occupancy as to which, it is beyond the power of the city to impose the assessment; and by any state officer or employee of the federal government or a foreign government who is exempt by reason of express provision of federal law or international treaty.

In years 2024 through 2026, the assessment rate may be subject to an annual increase during the five (5) year term. At the discretion of the Stay Pleasant Hill Board, the assessment rate may be increased to a maximum rate of five percent (5%) of gross short- term room rental revenue for assessed lodging businesses. However, the increase in any ... year shall not exceed one percent (1%) of gross short-term room rental revenue. The assessment rate may also be decreased by the Stay Pleasant Hill Board by up to a maximum of one percent (1%) per year, but shall not drop below the initial assessment rate of three percent (3%) of gross short-term room rental revenue. Any increase or decrease authorized by the Stay Pleasant Hill Board shall be included in the Annual Report described in the Plan.

Collection: The City shall continue to be responsible for collecting the assessment on a quarterly basis (including any delinquencies, penalties, and interest) from each lodging business located within the boundaries of the PHTID. The City shall take all reasonable efforts to collect the assessments from each lodging business.

Duration: The PHTID will have a five (5) year life, beginning April 1, 2022, or as soon as possible thereafter and end five (5) years from its start date. Once per year, beginning on the anniversary of PHTID renewal, there is a thirty (30) day period in which owners paying fifty percent (50%) or more of the assessment may protest and initiate a City Council hearing on PHTID termination.

Protest: Any owner of an assessed business within the proposed PHTID that will be subject to the assessment may protest the renewal of the PHTID. If written protests are received from the owners of businesses in the proposed PHTID who represent fifty percent (50%) or more of the estimated annual assessments to be levied, the PHTID shall not be renewed and the assessment shall not be imposed.

You may mail a written protest to:
