CITY COUNCIL STAFF REPORT
Meeting Date: July 11, 2022
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
SUBJECT: ADOPT RESOLUTION NO. ___-22 AUTHORIZING THE MAYOR AND

THE CITY MANAGER TO EXECUTE A SUCCESSOR MEMORANDUM

OF UNDERSTANDING BETWEEN THE CITY OF PLEASANT HILL

AND THE PLEASANT HILL POLICE ASSOCIATION

SYNOPSIS
Adoption of the proposed resolution would authorize the Mayor and City Manager to execute the successor Memorandum of Understanding (MOU) between the City of Pleasant Hill and the Pleasant Hill Police Association (PHPA).

DISCUSSION
Background
A bargaining team comprised of IEDA Consultant Greg Ramirez and the City’s Human Resources Manager and Finance Manager negotiated with representatives of PHPA in good faith to reach agreement on a successor MOU. The parties began meeting on March 16, 2022, prior to the current MOU covering the PHPA contract expiration date of June 30, 2022. After six productive negotiations sessions the parties successfully reached a tentative agreement on June 28, 2022. The PHPA membership held a ratification meeting on July 8, 2022 and the tentative agreement was approved by the membership at that time.

Analysis
The City has negotiated in compliance with the Meyers-Milias-Brown Act (MMBA) and all other applicable requirements to reach agreement with the PHPA unit on a new MOU that meets the interests of both parties. The following are the noteworthy changes in the proposed MOU relative to its predecessor:
 Change in term to July 1, 2022 through June 30, 2023.  Annual cost of living adjustment (COLA) of 3% effective July 1, 2022, reflected in the PHPA Salary Sheet.
 One-time, non-pensionable, lump sum payment of five thousand dollars ($5,000)

FISCAL IMPACT
The adoption of the proposed resolution authorizing the execution of the MOU between the City and PHPA will increase the City’s costs by approximately $232,000 in salaries and benefits for the life of the contract. An additional $245,000 will be used from the remaining American Rescue Plan Act (ARPA) funds to replace lost revenue that would otherwise have been available to provide employees with competitive benefits necessary to ensure adequate retention of staff to continue providing sufficient services; the approved Fiscal Year 22-23 budget will be adjusted accordingly.

PUBLIC CONTACT
Public contact was made through posting of the City Council agenda on the City’s official notice bulletin board, at the Pleasant Hill Senior Center, and at the Pleasant Hill Police Department.

The agenda and staff report are posted on the City’s web page.

RECOMMENDED CITY COUNCIL ACTION
Staff recommends approving the proposed resolution.

ALTERNATIVES TO RECOMMENDED ACTION
Council can redirect staff to continue to negotiate with PHPA.
