CITY COUNCIL STAFF REPORT
Meeting Date: August 01, 2022
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
SUBJECT: ADOPT RESOLUTION NO. ___-22 APPROVING AND AUTHORIZING
THE CITY ENGINEER TO RECORD FINAL MAP AND AUTHORIZE
THE CITY MANAGER TO EXECUTE A SUBDIVISION AGREEMENT
WITH CDP PH HOLDING LLC FOR SUBDIVISION 9520 (401 TAYLOR
BOULEVARD)
SYNOPSIS
The CDP PH Holding LLC has satisfied the tentative map conditions of approval for Subdivision 9520 and is requesting approval of the Final Map. The Final Map proposes to subdivide the property and allow for the development of 31 new single-family homes. A Subdivision Agreement is required from the property owner to construct private and public site improvements deemed necessary for the subdivision. Staff recommends the City Council approve the Final Map, authorize the City Manager to execute a Subdivision Agreement, and authorize the City Engineer to record the Final Map for Subdivision 9520.
DISCUSSION
Background
On August 16, 2021, the City Council adopted Resolution No. 57-21, approving a General Plan Amendment, Development Plan, Major Subdivision and Architectural Review Permit (PLN 21- 0028) for the 401 Taylor Boulevard II small-lot, single-family homes project at 401 Taylor Boulevard. The Major Subdivision created 31 new residential parcels, ranging in size from 3,105 to 5,830 square feet, with an average lot size of 3,745 square feet within the 4.86-acre project site and open space. Six of the 31 homes included a secondary dwelling unit.
Analysis
Section 17.30.070 of the City’s Municipal Code and Government Code Section 66442 of the Subdivision Map Act authorize the City Engineer to make the determination that the Final Map is in conformance with the approved Tentative Map and recommend approval to the City Council.
The code sections require approval of a Final Map if all development conditions of the approved Tentative Map are satisfied.
The developer has substantially complied with all necessary conditions of approval of the Tentative Map and mitigation measures required by the City Council (Resolution No. 57-21), and is in conformance with applicable Public Works and Community Development standards. All Engineering Division conditions, except for construction of the necessary site improvements, have been met. Under the Subdivision Map Act, execution of a Subdivision Agreement (including improvement bonds) will allow approval of the Final Map prior to construction of site improvements.
The Subdivision Agreement outlines specific requirements and timelines to construct the on-site and off-site improvements necessary to support the development project. For this project, site improvements required include: site grading, drainage improvements, private roadway improvements, on- and off-site utilities, stormwater treatment facilities, and landscaping. The Agreement also guarantees the following:
Installation and completion of the work and improvements deemed necessary by the City Engineer, as shown on the Grading and Improvement Plans of the Subdivision. Compliance with City Council Resolution No. 57-21 and City Council Conditions of Approval.
Submittal of bonds as security that improvements necessary to serve the development will be built in accordance with the approved plans.
The City Surveyor has reviewed the Final Map and determined that it is technically correct, and the City Engineer has reviewed the Final Map and has determined that it is in substantial conformance with the Tentative Map and that all development conditions have been met. The City Engineer, therefore, recommends approval of the Final Map for Subdivision 9520 (401 Taylor Boulevard).
Once the Subdivision Agreement is executed, the Final Map for the Subdivision can be recorded at the County Recorder.
FISCAL IMPACT
The requested action has no direct impacts to the City’s General Fund. Approving the Final Map will allow the City to collect revenue in the form of developer and cost recovery fees (i.e. Traffic Mitigation, Stormwater, permits, etc.). There will be an increase in property tax revenue because of the higher value of the development as compared to the previous land use conditions. The constructed private improvements (street and sidewalks) will be maintained in the future by the abutting property owners or homeowners association.
PUBLIC CONTACT
Public contact was made through posting of the City Council agenda on the City’s official notice bulletin board, at the Pleasant Hill Senior Center and at the Pleasant Hill Police Department. The agenda and staff report are posted on the City’s web page.
RECOMMENDED CITY COUNCIL ACTION
Staff recommends the City Council adopt the attached resolution:
1. Approving the Final Map for Subdivision 9520,
2. Authorizing the City Manager to execute a Subdivision Agreement with CDP PH Holding LLC,
3. Authorizing approval of the Final Map for Subdivision 9520; and Authorizing the City Engineer to record the Final Map and Subdivision Agreement for Subdivision 9520.
ALTERNATIVES TO RECOMMENDED ACTION
None recommended. The City is required to approve the Final Map once the applicant complies with the terms of the tentative map conditions of approval. Execution of the Subdivision Agreement and bonds ensure that the improvements necessary to serve the development will be built in accordance with the approved plans.
