CITY COUNCIL STAFF REPORT
Meeting Date: October 03, 2022
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
SUBJECT: ADOPT RESOLUTION NO.___-22 AUTHORIZING THE TRANSFER AND BUDGET OF MEASURE K FUNDS FOR THE 2022 STREET
RESURFACING PROJECT NO. PSC-01-22

SYNOPSIS
On September 12, 2022, at its regularly scheduled meeting, the City Council adopted Resolution No. 81-22, (attached) awarding a construction contract for the 2022 Street Resurfacing Project No. PSC-01-22 and authorizing the City Manager to award a construction contract with MCK Services, Inc. Additional available Measure K funds were approved for needed pedestrian and bicycle facility upgrades that were originally allocated to the NPDES/Stormwater Fund. This requires the City Council to approve the budget transfer from the NPDES/Stormwater Fund to the Gas Tax Fund where the City tracks Street Resurfacing Projects. Staff has updated the findings in the proposed resolution to reflect the necessary authorization for a budget transfer of the available Measure K funds into the Street Resurfacing Program budget.

DISCUSSION
Background
Measure K, a half-cent transactions and use tax (or sales tax), was approved by Pleasant Hill voters on November 8, 2016 to be used (in part) to fund Capital Improvement Projects, including street resurfacing, storm drain, and pedestrian and bicycle projects. The tax took effect April 1, 2017 for a 20-year period. In FY 22/23, Measure K is estimated to generate $5.4 million in revenues and provide $1.4 million in the approved FY2022/27 Capital Improvement Program (CIP) for use on these projects.

The 2022 Street Resurfacing Project No. PSC-01-22 consists of preparing the project streets, ADA curb ramp installation, monument preservation, utility adjustments and limited concrete curb and gutter repair. Once the street preparation is complete, all project streets will receive a final pavement resurface treatment and thermoplastic re-striping.

In an effort to obtain a quality contractor, economy-of-scale bid pricing, and to maximize City resources, needed pedestrian and bicycle facility upgrades on the project streets, per the City’s draft Bicycle and Pedestrian Master Plan, were included in the Street Resurfacing Project’s scope of work, and staff recommended utilizing available Measure K funds from the NPDES/Stormwater Fund to fund this additional work.

Analysis
On June 27, 2022, the City Council approved the City’s Biennial Budget for FY 22/23 – FY 23/24 which authorized an allocation of $450,000 to be transferred from Measure K Fund to the NPDES/Stormwater Fund. The Capital Improvement Program (CIP) then allocated funds to the Storm Drain Program on July 11, 2022. An Engineering review of this fiscal year’s project funding revealed that $205,000 of the NPDES/Stormwater Funds are available to be utilized for the desired pedestrian and bicycle upgrades identified in the Street Resurfacing Project.

On September 12, 2022, the City Council adopted Resolution No. 81-22, awarding a construction contract for the 2022 Street Resurfacing Project No. PSC-01-22 to MCK Services, Inc. Also, included in the contract was $205,000 of additional pedestrian and bicycle facility upgrades using available Measure K Funds from the NPDES/Stormwater Fund. These upgrades require a transfer from the NPDES/Storm Drain Fund to the Gas Tax Fund where the project will be accounted for.

FISCAL IMPACT
Authorize an appropriation to transfer $205,000 of Measure K Funds from the NPDES/Storm Drain Fund to the Gas Tax Fund and increase the 2022 Street Resurfacing Project budget for the upgraded pedestrian and bicycle facility improvements.
