CITY COUNCIL STAFF REPORT
Meeting Date: October 03, 2022
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
SUBJECT: ADOPT RESOLUTION NO ___-22 TO APPROVE AND RECORD

PARCEL MAP AND AUTHORIZE THE CITY MANAGER TO EXECUTE

A SUBDIVISION IMPROVEMENT AGREEMENT WITH CHARLES

GONSALVES, CRAIG GONSALVES, KIMBERLY GONSALVES, DAVID

GONSALVES AND CHARLENE GONSALVES, FOR MINOR
SUBDIVISION MS 22-227 (2161 PLEASANT HILL ROAD)

SYNOPSIS
Charles Gonsalves, Craig Gonsalves, Kimberly Gonsalves, David Gonsalves and Charlene Gonsalves, have satisfied the tentative map conditions of approval for Minor Subdivision MS 22- 227 and are requesting approval of the Parcel Map. The Parcel Map proposes to subdivide the property and allow for the development of three new single family homes. A Subdivision Agreement is required from the property owner to construct private and public site improvements deemed necessary for the subdivision. Staff recommends the City Council approve the Parcel Map, authorize the City Manager to execute a Subdivision Agreement and authorize the City Engineer to record the Parcel Map for Minor Subdivision MS 22-227.

DISCUSSION
Background
On September 14, 2021, the Planning Commission adopted Resolution No. 17-21, approving a Tentative Parcel Map (Minor Subdivision), PLN 21-0150, for the Gonsalves Minor Subdivision at 2161 Pleasant Hill Rd. The Minor Subdivision created three new residential parcels measuring 13,396 square feet, 12,415 square feet, and 10,251 square feet, respectively, within the 0.90-acre project site.

Analysis
Pleasant Hill Municipal Code Section 17.30.070 and Government Code Section 66442 of the Subdivision Map Act authorize the City Engineer to make the determination that the Parcel Map is in conformance with the approved Tentative Map and recommend approval to the City Council.

The code sections require that a Parcel Map be approved if all development conditions of the approved Tentative Map are satisfied.

The developer has substantially complied with all necessary conditions of approval of the Tentative Map and mitigation measures required by the Planning Commission (Resolution No. 17- 21), and the project conforms to applicable Community Development Department standards. All Engineering Division conditions, except for construction of the necessary site improvements, have been met. Under the Subdivision Map Act, execution of a Subdivision Improvement Agreement (including improvement bonds) allows approval of the Parcel Map prior to construction of site improvements. Construction of the site improvements is not initiated until after the Parcel Map is approved by City Council.

The Subdivision Improvement Agreement outlines specific requirements and timelines to construct the on-site and off-site improvements necessary to support the development project. For this project, site improvements required include: site grading, drainage improvements, private roadway improvements, on- and off-site utilities, stormwater treatment facilities, and landscaping. The Agreement also guarantees the following:
 Installation and completion of the work and improvements deemed necessary by the City Engineer, as shown on the Grading and Improvement Plans of the Subdivision.
 Compliance with Planning Commission Resolution No. 17-21 and Planning Commission Conditions of Approval.
 Submittal of bonds as security that improvements necessary to serve the development will be built in accordance with the approved plans.

The City Surveyor has reviewed the Parcel Map and determined that it is technically correct. The City Engineer has reviewed the Parcel Map and found it in substantial conformance with the Tentative Map and has further determined that all development conditions have been met.

Accordingly, the City Engineer recommends approval of the Parcel Map for Minor Subdivision MS 22-227 (2161 Pleasant Hill Road). Once the Subdivision Improvement Agreement is executed, the Parcel Map for the Subdivision can be recorded at the County Recorder.

FISCAL IMPACT
The requested action has no direct impacts to the City’s General Fund. Approving the Parcel Map will allow the City to collect revenue in the form of developer and cost recovery fees (i.e. Traffic Mitigation, Stormwater, permits, etc.). There will be an increase in property tax revenue because of the higher value of the development, as compared to the previous land use conditions. The constructed private improvements (street and sidewalks) will be maintained in the future by the abutting property owners or homeowners association.

PUBLIC CONTACT
Public contact was made through posting of the City Council agenda on the City’s official notice bulletin board, at the Pleasant Hill Senior Center and at the Pleasant Hill Police Department. The agenda and staff report are posted on the City’s web page.

RECOMMENDED CITY COUNCIL ACTION
Staff recommends the City Council adopt the attached resolution:

1. Approving the Parcel Map for Minor Subdivision MS 22-227

2. Authorizing the City Manager to execute a Subdivision Improvement Agreement with Charles Gonsalves, Craig Gonsalves, Kimberly Gonsalves, David Gonsalves and Charlene Gonsalves

3. Authorizing approval of the Parcel Map for Minor Subdivision MS 22-227

4. Authorizing the City Engineer to record the Parcel Map and Subdivision Improvement Agreement for Minor Subdivision MS 22-227.

ALTERNATIVES TO RECOMMENDED ACTION
None recommended. Pursuant to the Subdivision Map Act, the City is required to approve the Parcel Map once the applicant complies with the terms of the tentative map conditions of approval.

Execution of the Subdivision Improvement Agreement and submittal of bonds ensure that the improvements necessary to serve the development will be built in accordance with the approved plans.
