APPEAL OF THE PLANNING COMMISSION DECISION

NOTICE IS HEREBY GIVEN, by the City of Pleasant Hill, that the City Council will hold a public hearing to consider an appeal, by the applicant, of the Planning Commission decision to deny a zoning permit (PLN 21-0497) for a Reasonable Accommodation to allow an existing structure, with non-conforming setbacks, to remain related to a disability, and for a fence with a height above three feet, in the front yard, to be permitted. This item was originally scheduled for the June 6, 2022 City Council hearing date, but was continued without any discussion to August 1, 2022. The subject site is approximately 0.37 acres, zoned R10 – Single Family Residential, at 406 Kahrs Avenue. Assessor Parcel Numbers: 149-032-038-7 and 149-032-037-9.
Pursuant to Sections 15301, 15304, and 15305 of the California Environmental Quality Act (CEQA) of 1970, as amended, this project is determined to be, Categorically Exempt (Classes 1, 4, and 5) – Existing Facilities, Minor Alterations to Land, and Minor Alterations in Land Use Limitations, since the project scope would not have a significant effect on the environment.
THE CONTINUED PUBLIC HEARING will be held by the City Council starting at 7:00 P.M. on Monday, August 1, 2022. Please check the City’s website or posted agenda for information regarding whether the hearing will be held virtually and/or at City Hall at 100 Gregory Lane, Pleasant Hill, CA. More information on how to participate, including providing live comments during the meeting, will be provided on the posted City Council meeting agenda.
NOTICE IS ALSO GIVEN pursuant to Government Code Section 65009(b) that, if this matter is subsequently challenged in Court by you or others, you may be limited to raising only those issues you or someone else has raised at the Public Hearing described in this notice or in written correspondence delivered to the City of Pleasant Hill at, or prior to, the Public Hearing.
