RESOLUTION NO. -22
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANT HILL
TO APPROVE AND RECORD PARCEL MAP AND AUTHORIZE THE CITY MANAGER
TO EXECUTE A SUBDIVISION IMPROVEMENT AGREEMENT WITH CHARLES
GONSALVES, CRAIG GONSALVES, KIMBERLY GONSALVES, DAVID GONSALVES AND CHARLENE GONSALVES FOR SUBDIVISION MS 22-227 (2161 PLEASANT HILL ROAD)
WHEREAS, Charles Gonsalves, Craig Gonsalves, Kimberly Gonsalves, David Gonsalves and Charlene Gonsalves, propose to subdivide an existing 0.90-acre site to create a minor Subdivision MS 22-227 with 3 new residential parcels for the development of new single-family homes; and WHEREAS, on September 14, 2021, by Resolution No. 17-21, the Planning Commission approved Tentative Parcel Map (Minor Subdivision), PLN 21-0150, for the Gonsalves Minor Subdivision at 2161 Pleasant Hill Road; and
WHEREAS, Charles Gonsalves, Craig Gonsalves, Kimberly Gonsalves, David Gonsalves and Charlene Gonsalves, have fulfilled the requirements of the Tentative Map including preparation of Improvement Plans, as required prior to recordation of the Parcel Map for Subdivision MS 22-227; and
WHEREAS, Charles Gonsalves, Craig Gonsalves, Kimberly Gonsalves, David Gonsalves and Charlene Gonsalves, are required to enter into a Subdivision Improvement Agreement with the City of Pleasant Hill and provide improvement bonds to guarantee construction of site improvements related to Subdivision MS 22-227, as approved by the City.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pleasant Hill:
1. Finds that approval of the parcel map is a ministerial action and is exempt from the requirements of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guideline Section 15268(b)(3).
2. Approves the Subdivision Agreement between Charles Gonsalves, Craig Gonsalves, Kimberly Gonsalves, David Gonsalves, Charlene Gonsalves, and the City of Pleasant Hill for Subdivision MS 22-227, and authorizes the City Manager to sign on the City’s behalf.
3. Finds that Charles Gonsalves, Craig Gonsalves, Kimberly Gonsalves, David Gonsalves and Charlene Gonsalves, have substantially complied with all necessary mitigation measures and Conditions of Approval for the Tentative Map, as required prior to recordation of the Parcel Map for Subdivision MS 22-227, and therefore approves the Parcel Map for Subdivision MS 22-227.
4. Authorizes the City Engineer to record the Parcel Map and Subdivision Improvement Agreement for Subdivision MS 22-227.
