A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANT HILL ACCEPTING THE NEW PLEASANT HILL LIBRARY PROJECT NO. 06-20 AS
COMPLETE, AND AUTHORIZING THE CITY ENGINEER TO ISSUE AND RECORD A
NOTICE OF COMPLETION
WHEREAS, the New Pleasant Hill Library Project is identified as a budgeted and approved project in the FY 2020-2025 Capital Improvement Plan (CIP), Project No. 06-20 (Project MK-4); and
WHEREAS, the New Pleasant Hill Library Project provides for the construction of a new Public Library and Site Improvements; and
WHEREAS, on August 3, 2020, the City Council awarded a contract to BHM Construction, Inc. to perform work described in the contract documents entitled New Pleasant Hill Library Project, Project No. 06-20; and
WHEREAS, the work has been performed to the satisfaction of the City and BHM Construction, Inc., and the project is complete except for:
Minor work valued at approximately $20,000, which will become warranty work and will be corrected promptly under the terms of the construction contract; Per Public Contract Code, 125% of the value of this minor work to be completed, or $25,000, will be withheld from the release of retention to BHM Construction, Inc., and will be released only upon completion of the minor work identified; and WHEREAS, the City has retained five percent (5%) of the total construction cost ($1,202,216.50) from BHM Construction, Inc. If there are no claims filed within 35 days of recording the notice, the City may release final payment of the retained amount to the contractor; and
WHEREAS, the California Public Contract Code requires the City to notify the public of acceptance of a project prior to making a final payment.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pleasant Hill finds that the work performed as the New Pleasant Hill Library Project, Project No. 06-20, is complete to the satisfaction of the City.
BE IT FURTHER RESOLVED, that the City Engineer is authorized to execute a Notice of Completion and record it with the Office of the Recorder of the County of Contra Costa, State of California, within ten (10) days from the date thereof. [Signatures on Following Page}
