CITY OF PLEASANT HILL

NOTICE OF

PUBLIC HEARING

CITY COUNCIL
APPEAL OF THE PLANNING COMMISSION’S DECISION TO DENY A VARIANCE REQUEST (PLN 22-0294) FOR A SIX-FOOT-TALL FENCE WITHIN A REQUIRED FRONT YARD IN AN R-10 RESIDENTIAL ZONING DISTRICT
2029 WESTOVER DRIVE
NOTICE IS HEREBY GIVEN by the City of Pleasant Hill that the City Council will hold a public hearing to consider an appeal, submitted by Christine and Kevin Finkas, of the Planning Commission’s denial of a Variance request, PLN 22-0294. The applicant is requesting approval of an after-the-fact Variance by the City Council to allow a fence height of six feet within the required front yard, where three feet would otherwise be allowed. The existing, unpermitted fence has a front setback of nine feet, nine inches, where 20 ft. would otherwise be required for a six foot high fence.

The project site is located at 2029 Westover Drive. The site is zoned R-10, Single-Family Residential (10,000 sq. ft. lots). Assessor Parcel Number: 152-111-023-7.

Pursuant to Section 15311 of the Guidelines for the Implementation of the California Environmental Quality Act (CEQA) of 1970, as amended, this project is determined to be Class 11 categorical exemption, because the project involves the construction of a small accessory structure.

A PUBLIC HEARING will be held by the CITY COUNCIL starting at 6:30 p.m. on Monday, April 17, 2023, in the Council Chambers, City Hall, at 100 Gregory Lane, Pleasant Hill and through Video/Teleconference via Zoom Conference Meetings. Interested persons will be heard at this time at the meeting, both in-person and those participating through Zoom. More information on how to participate via zoom, including providing live comments during the meeting, will be provided on the posted City Council Agenda.

NOTICE IS ALSO GIVEN pursuant to Government Code Section 65009(B) that, if this matter is subsequently challenged in Court by you or others, you may be limited to raising only those issues you or someone else has raised at a Public Hearing described in this notice or in written correspondence delivered to the City of Pleasant Hill at, or prior to, the Public Hearing.

For information on this matter, please call or email Andrew Shiflet at (925) 671-5211 or [email protected].
