CITY COUNCIL STAFF REPORT
Meeting Date: July 17, 2023
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
SUBJECT: ADOPT RESOLUTION NO. ___-23 APPROVING AND ADOPTING
DESIGNATED ALTERNATES TO SERVE AS STANDBY OFFICERS TO
ALLOW THE CITY COUNCIL TO RECONSTITUTE ITSELF IN THE
EVENT OF EMERGENCY-CAUSED VACANCIES AND RESCINDING
RESOLUTION NO. 11-23
SYNOPSIS
The City Council has historically adopted a resolution to designate alternates to serve as standby officers, which would allow the City Council to reconstitute itself in the event of emergencycaused vacancies and provide continuity of government. The resolution includes standby officers and appointment of a City Manager. With the recent appointment of Ethan Bindernagel as the new City Manager, a new resolution needs to be adopted updating the standby list to allow the City Council to reconstitute itself and appoint a City Manager in the event of emergency-caused vacancies and rescinding Resolution No. 11-23.
DISCUSSION
Background
The California Emergency Services Act provides for the preservation of local government in the event of a state of war emergency, state of emergency or a local emergency by allowing the City Council to appoint a succession of standby officers and a City Manager in order to preserve law and order and, so far as possible, continue or restore government services. With the recent appointment of Ethan Bindernagel as the City Manager, the resolution identifying standby officers and City Manager needs to be updated.
Analysis
Pursuant to Government Code § 8638, the City Council has the power to appoint three standby officers for each City Councilmember and the City Manager. The attached proposed resolution includes the names of standby officers that have been selected by each City Councilmember and the City Manager. Each designated standby officer is required to take an oath of office to be scheduled after adoption of the resolution by the City Council and before performing the duties of the office.
FISCAL IMPACT
There is no fiscal impact to the City.
