Meeting Date: September 11, 2023
TO: THE HONORABLE MAYOR AND CITY COUNCILMEMBERS
SUBJECT: ADOPT RESOLUTION NO. ___ - 23 ACCEPTING THE SUBDIVISION IMPROVEMENTS FOR SUBDIVISION 9447 (RELIEZ TERRACE) AS
COMPLETE
SYNOPSIS
Ponderosa Homes II, Inc. (Developer), has constructed the improvements for Subdivision 9447 (Reliez Terrace) in accordance with the terms of the Subdivision Agreement with the City. It is now appropriate for the City to accept these improvements as complete.
DISCUSSION
On May 22, 2018, the Planning Commission adopted Resolution No. 06-18, approving Vesting Tentative Map (PLN 17-0013) for the Reliez Terraces Residential Major Subdivision at 2150 and 2189 Pleasant Hill Road. The Major Subdivision created two common area parcels and 17 new residential lots within the 4.42-acre project site, with residential lots ranging in size from 8,291 square feet to 12,808 square feet, at an average lot size of 9,424 square feet.
On August 19, 2019, the City Council adopted Resolution No. 45-19, approving the filing of the Final Map and authorizing the City Manager to execute a Subdivision Improvement Agreement.
The Developer entered into a Subdivision Improvement Agreement with the City of Pleasant Hill on January 27, 2020, for the construction of street and other subdivision improvements associated with Subdivision 9447. Public improvements were constructed along Pleasant Hill Road from Boyd Road, south to the project limits just beyond the new Molino Court. The improvements included sidewalks along both sides of Pleasant Hill Road, a new median island, bike lanes, an enhanced crosswalk across Pleasant Hill Road at Molino Court, and street resurfacing. In addition, new sidewalks and street repaving were constructed along the project limits of Boyd Road. Private improvements include a new street and sidewalks, landscaping, and storm drain improvements with stormwater treatment facilities.
The Developer provided a Faithful Performance Bond and a Labor and Material Bond to guarantee the construction of the improvements. The Subdivision improvements are now complete, and the developer is requesting the bonds for this work be released.
The work was secured with the following bonds:
Faithful Performance and Labor and Material Bond #929643363 for on-site improvements in the amount of $1,231,296;
Faithful Performance Bond and Labor and Material Bond #929643362 for off-site improvements in the amount of $600,748.
Prior to the release of the Faithful Performance Bonds, the Developer will provide a Warranty Bond in the amount of $274,807 which is 15% of the total cost of the on-site and off-site improvements. The warranty bond will be held for twelve months after acceptance of the improvements. The Labor and Material Bond will be released six months after the acceptance of the improvements. The release of all improvement securities is in accordance with Pleasant Hill Municipal Code Section 17.35.070.D.
FISCAL IMPACT
The requested action has an impact to the City’s General Fund in annual maintenance costs estimated at $7,000 for City-maintained off-site improvements such as median landscaping and irrigation on Pleasant Hill Road. There will be an increase in property tax revenue because of the higher value of the housing development as compared to the previous land use conditions.
The constructed private improvements (street and sidewalks) will be maintained by the abutting property owners or homeowners association.
PUBLIC CONTACT
Public contact was made through posting of the City Council agenda on the City’s official notice bulletin board, at the Pleasant Hill Senior Center, and at the Pleasant Hill Police Department.
The agenda and staff report are posted on the City’s web page.
RECOMMENDED CITY COUNCIL ACTION
Staff recommends the City Council adopt the proposed resolution accepting the improvements for Subdivision 9447 (Reliez Terrace) as complete.
ALTERNATIVES TO RECOMMENDED ACTION
None recommended. The City is required to accept the constructed improvements once the applicant complies with the terms of the Subdivision Improvement Agreement. The Warranty Bond ensures the constructed improvements will be guaranteed through the one-year maintenance and warranty period.
