RESOLUTION NO. __-24
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANT HILL
AUTHORIZING THE CITY MANAGER TO EXECUTE A PROFESSIONAL SERVICES
AGREEMENT WITH HARRIS & ASSOCIATES FOR ASSEMENT ENGINEERING SERVICES FOR A PROPOSED RATE INCREASE FOR ASSESSMENT DISTRICT 20 AND ASSESSMENT DISTICT 22
WHEREAS, on August 1, 1988, by Resolution No. 75-88, the City Council of the City of Pleasant Hill ordered the formation of and levied the first assessment within Assessment District No. 20, City of Pleasant Hill, Contra Costa County, State of California (AD20), pursuant to the provisions of the Landscape and Lighting Act of 1972 (commencing at Section 22500 of the California Streets and Highways Code herein referred to as "the Act"); and WHEREAS, AD20 was amended in 1999 by creating a new zone (Zone 6) that includes the Downtown area; and
WHEREAS, on December 1, 1997, by Resolution No. 88-97, the City Council of the City of Pleasant Hill ordered the formation of and levied the first assessment within Assessment District No. 22, City of Pleasant Hill, Contra Costa County, State of California (AD22), pursuant to the provisions of the Act; and
WHEREAS, AD22 was amended in 2002 to include Subdivision 8304, Gallery Walk; and WHEREAS, Section 22620 et seq., of the Act provides for the levy of annual assessments after the formation of AD20 and AD22; and
WHEREAS, Harris & Associates, Inc. is designated as Engineer of Work for purposes of the AD20 and AD22 within the assessment districts; and
WHEREAS, the annual maintenance and servicing costs have increased while the assessment rates for AD20 and AD22 have remained relatively unchanged, and the City Council is initiating a Proposition 218 vote based on the requirements of the Act and Proposition 218.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Pleasant Hill that:
1. The City Council accepts the Harris & Associates cost proposal in the amount of $39,310 at the prices set forth in Exhibit A.
2. Authorizes the City Manager to execute a Professional Services Agreement (Exhibit B) with Harris & Associates for Assessment Engineering Services for a proposed rate increase for AD20 and AD22.
